That isn't at all my point. My point is trying to put myself into the position of an unbiased jury, and to me, this witness was not worth the effort. Yes, she's evasive and hositle, however, I do feel she is telling the truth that she did not see Berkowicz and Higgins in the sallyport when she thought she did. I feel like it would be better to try to figure out why she thought that. Did she see them at another time? Or did she hear that from someone? Or was it just a dream? It had to come from somewhere and I'm not sure if they can ask her any of that.You cannot threaten or charge someone with perjury who does not lie. If I were being truthful and someone ‘threatened’ me with perjury, I’d laugh in their faces. I think the real conversation was reminding Dever to be truthful on the stand. She chose to interpret it as a threat. MOO
To me, I feel if I was on the jury, I would feel sympathetic toward her.
