Judge Cannone will say yes, videos are evidence. Weigh them as evidence and give whatever weight you deem appropriate.

She WILL read digital evidence and human practice instruction.

Once the jury gets answers to their questions, I am hoping they will be able to reach a verdict and it can be announced this afternoon

It would really stink if the jury planned to fully acquit but come back with OUI and Bev gives her 2.5 years in jail.
I think that’s a legit worry. Apparently, Cannone has gone with tough OUI sentences in the past, although most first time offenders get fines without incarceration.

I’ll be surprised if deliberations go past 5 this evening.

Lunch is usually 1:30 to 2:30. Verdict at 3 is my prediction.
IMO.

Now onto ‘Does convicting guilty on a surcharge convict on the overall charge?’

AJ: The verdict slip answers Q3. The answer is no.

Sounds like Bev is open to changing some of the language in the verdict slip.

At this point it is kind of like - OK jury...what are you trying to do here....let's figure this out...

Wow this Judge wants another hung jury

To keep changing verdict slip is crazy at this point in the trial. All of this is due to Bev.

Brennan’s answer to Q3: No disagreement with edits to verdict slip!

Judge Cannone wants to give the jury a copy of the amended verdict slip and walk them through it.

AJ: One more thing - digital instruction. Defense waives it and Cannone agrees.

Don't think she wants to do this again... I'm surprised that the CW is so willing to make the changes and so is the judge...

This sounds like an unnecessary mess. The verdict form should not be confusing.

If I were a juror I would not be able to check the BAC level over 0.08 question since her BAC was not tested until the next day (no to the retrograde testing). I would only be able to honestly say she was operating a motor vehicle under the influence of alcohol.

Not sure if the jury will be advised on the form what time the test was taken. Kinda confused about that. But I believe it to be after 6 AM? Seems they were questioning the timing......
