Okay so I'm in the UK so not fully aware of the US judicial system - what happens if they hang on one of the three charges?

What does Judge Bev have to gain from a guilty verdict or hung jury? (Genuinely asking)
I don't think she's gaining anything either way. I think she doesn't want the verdict slip changed and she doesn't want to clear up the questions because she's not willing to admit she was wrong. The verdict slip is confusing. The jurors don't understand. We are right back where we were last year.

That charge will be retried. This was the issue with T1. The jury was so confused on the verdict slip that they told Cannone they were hung, when in reality, they had all decided she was NG on counts 1 and 3. They were hung on count 2.

The reality is that only the charges in which the jury could not reach a unanimous verdict on will be retried, but an official vote and verdict needs to come in from the jury on the NG charges. So the simple answer is NO, if you are locked on one count, that does not trigger a mistrial for all counts.

In trial 1 judge Cannone did not allow the jury the give their verdict on the acquittals, because they never officially voted on the Murder 2 and leaving the scene counts while they were deliberating on Manslaughter. She declared a mistrial on ALL the charges.

Edits: grammar and clarity.

THANK YOU!! This has been confusing me for ages when I was reading about trial one.

Also I appreciate everyone answering my questions about trial one and stuff that came before. I know it must be annoying to retread old ground.

"Person of the Year"
🙄
The good news is that you usually get that award right before you are out the door - retirement or otherwise. But that does not help this situation.

Her bias and yes, animosity towards the Defense is through the roof.
She is the DA's "girl" so she fears no consequences imo and does his bidding
I hope they both get taken down

I sure hope that the next jury note doesn’t say that they are at an impasse…because of this!!!!!!

Hopefully a lifetime of ridicule, distrust, people leaving restaurants whenever she enters and a * after her name in every law book, article, newspaper, magazine and history book from now and forever. Just my opinion.

Moo the word charge refers to the lessers in count 2. I think their question pertains to the slew of lesser charges within count 2. Specifically the oui. It's clear for the individual counts they can consider them and tick the Ng boxes, then go on to consider count 2 with all its complications. The prob is there are no ng options on each of the lessers. Which becomes a problem only if they are hung on one of them ( the Oui imo judging from the prior questions).

ETA, theoretically and legally imo she could be retried on the whole of count two even if the jury is only hung on the oui. This has always been the problem with not having Ng options for the lessers as the jury moves down the slip . It is completely unjust

It's a mistrial. If the judge declares it a mistrial without prejudice, then KR can be tried AGAIN.

I agree. I still think they’re hung on the OUI as well.

I'll allow it.

The satisfaction of sending someone to prison just because she thinks they are guilty?

She clearly has something to gain in her own mind.

Wonder if she or her husband are gamblers and placed a big wager on a guilty verdict on murder?

I do not understand why she can't answer it. They are just asking how it works. Why can't she just simply say how it works?

And maybe a scarlet letter branded on her forehead?

This time the Defense will poll the jury on each charge if necessary - and that should alleviate what happened last time if we get the same verdict.
Bev shut things down last time before anyone could think and ask for a poll

I'm just going to carefully say that it's a small area, everyone knows everyone, and there are many connections. Family, friends, etc...
And those bonds are extra-tight, especially since JOK died and KR was charged.
IMO and just what I've read/observed.

Who knows. It may work out in Karen’s favor. If they’re G on OUI, or hung on OUI, they’re more likely to acquit if they think that charging with OUI could result in greater charges, or hanging on OUI could hang on all charges… MOO
