Right, so they would have to respond to her and say ‘We are locked on a count. If we hang, will we hang on all counts?’Well, I'm not sure how else they could ask some questions then. I think it's asking for clarification, and it isn't hypothetical really. If they want to find her guilty on one of those included there, they are asking if it makes her guilty of all of them. I guess they could have said is count 2 all or nothing. If it's confusing, that is the judge's fault, and she should be able to clear it up weather it's a hypothetical question or not. That is a big charge included there with the OUI one and if they don't think she's guilty of count 2, but do think she was guilty of OUI, then I can see needing clarification because I'd vote NG on all before, I'd vote guilt on OUI if it meant she was guilty of count 2. Why is the form so confusing would be my question.
