Zero evidence at trial about phone calls between them, and we all know if there had been evidence of any, it would have been brought up.
Don’t forget Higgins destroyed his SIM card and his phone.

The evidence that there had to have been other communication between BH and KRead beyond the texts (presumably, and logically, phone calls) is in the wording of the texts. IMO all we have to do is read those texts, with an eye to the times and dates and sequence, and it becomes obvious more was communicated and happening outside them.

"if there had been evidence of any, it would have been brought up [at trial]" -- I really don't think so. The texts were already in evidence, showing "something" had happened that seemed to have run its course, and all of that was discussed at trial. But what further would there have been to gain by chasing and proving to the jury they had apparently also talked on the phone here and there, but "sorry, no one knows what was said"? And which side would have wanted to use their efforts on that sort of dead end? The def wouldn't. Does the state want to try to force that info out of Higgins? Remember that he destroyed his phone so it would not be found, so he wasn't really that open to sharing all.

Am I saying the existence (or not) of phone conversations - given the known texts - changes anything at all as to what might have actually happened, and the trial? Not at all. I was just offering a side observation. But the fact her vehicle didn't hit JOK means she didn't kill him and was elsewhere (at home, obviously, or driving there) when someone else killed him and eventually put his body on the lawn that night. That's the bottom line.

So if you don't agree with me about the calls, fine by me. It's not a biggie either way imo, as the texts already told us what there is to know or infer about the relatonship between BH and KR.

It's just my 2c.
The matter of Higgins meeting up with an FBI friend who helped him extract items off his phone is pretty suspicious. What did he have extracted? Not to mention the presence of his lawyer by his side at the first trial. I definitely think there was more to Higgins' involvement than meets the eye, BUT, I want to respect Karen's privacy in this instance too.

He extracted ONLY what he wanted the authorities to see. Which of course would seem to indicate there were things he wanted kept hidden. We don't know if these were texts to Karen and/or texts to Albert-related people.

What he did was illegal, which is why he consulted a lawyer whilst on the stand last trial. Does he still have a job with ATF? If so, why? I've never heard one way or the other.

Just my opinion, but from seeing how Lally ran things in trial 1, I think he would have brought up a phone call if there was one between Brian and Karen. Lally's whole MO was to throw everything at the wall and see what sticks. Lally had BH read every one of the texts between the two of them and he also made BH testify about the kiss they exchanged. Why would he not mention any phone calls? It would support the commonwealth theory that Karen was angry at John and ready to move on to another guy. Just like the testimony of the Aruba girls', and the Dunkin' Donuts coffee given to JO's niece. There was no detail too small that Lally wasn't going to admit into evidence.

Now if we're talking about trial 2, that's a different matter. Brennan certainly pared down the prosecution case.

Right, but they had Karen's phone. She never deleted anything. If there was a call between BH and KR, the commonwealth would have been aware of it.

They first texted on January 16th.

On the 18th, BH mentions she "ghosted" him the day before, meaning they didn't talk on the 17th. Texts on the 18th happen from 5ish pm - ?

On the 19th, they start texting and she ends up going to his house, which we already knew, and was the first time, as you can tell by how he has to give her the right info to put in her GPS. She texts him that she's home around 11 pm.

On the 20th, there's a brief thread of about 12 messages around noon, then nothing. Nothing on the 21st, nothing on the 22nd, nothing on the 23rd until around 8 pm at which time KR says "I was at Hilly all weekend" so clearly she was not with BH.

There are no further texts until Friday when they're at the bar and BH sends the "Ummmm well?" text.

I agree that the texts already tell us what there is to know about the relationship between BH and KR, but I really can't see how you get to the conclusion that the texts reveal they were calling each other and seeing each other in between the text conversations when it's pretty clear they were not.

Yes, but Karen's phone was not destroyed and would have indicated any phone communications between them.

What is going on in Norfolk County?

I haven't paid all that much attention to goings on since verdict day, then I'm scrolling through my twitter feed, where the algorithm still feeds me with KR trial related content, and I find out that Adam Lally is right now being questioned under oath on the witness stand in some evidentiary hearing! And Proctor is going to be there later!

“Apparently, (Proctor) thinks he’s above the law,” said defense attorney Rosemary Scapiccio. “He was served in hand. He was told to be here this morning. Instead, his attorney showed up and said he left on vacation on Saturday.”

The hearing was continued to Aug 5 - his attorney said he is available to appear at that hearing


The defense said she is “concerned for every defendant out there as to whether or not they’re getting appropriate discovery through the Norfolk County District Attorney’s Office.”

“What we need to do is establish, is was the Karen Reed case a one off?” said Scapiccio. “And I would say it doesn’t appear to be, because here we are again with late discovery.”

Today Attorney Rosemary Scapiccio got high praise from Melanie Little and Peter @ LYK said RS gets a "chef's kiss".

IMO, Lally's testimony only furthered the view that the MSP is an infected part of the DA's office. His own failures to obtain discovery were exacerbated by the complete ignorance of Proctor and Tully regarding this case, (defendant's rights to a fair trial ) as well as the KR case. Heads should roll.

Holy crap! This is really bad. I thought Lally was having a bad day today but I think this is worse. How does Proctor expect to get his job back?

Apparently Karen Read herself showed up in Melanie's chat. I haven't gone back thru the whole thing but that's the word on the street.
I had ML on this morning in the background and also heard her say KR was in the chat.
