Madeleine McCann: German Prisoner Identified as Suspect, #41

The important point is evidence of what.

Collecting swims suits is not a crime. Perhaps owning starter pistols isn’t either.

CSA images are a crime but what is most puzzling is that he hasn’t been charged for this offence despite many reports of 8,000 images… something is amiss.

This is evidence that CB has a sexual interest in children. But that is already established, his criminal record proves this.

This information may convince you but it a very low threshold. As we saw in the rape trials, the fact that he had visited HaB’s apartment block, and that the profiler said he was extremely dangerous did help secure a conviction.

Circumstantial evidence requires inference. What we can infer from all the information that has been leaked is that CB is a sexual criminal - hardly a revelation.

What this evidence does not infer is that CB committed a crime against MM.
Collecting swimsuits could be considered an unusual and interesting hobby or it could fall within the definition of sexual deviancy depending on the circumstances in which the items were acquired.

For example had the owner collected them legitimately or was it an indication of a fetish driven by the illegal and criminal action of acquisition from a drying area or a burglary.

Interestingly CB’s criminal conviction for the aggravated rape of DM recalls to mind the opinion of the expert opinion voiced at CB’s trial which outlined the level of his dangerousness in no uncertain terms.

An Examination of the Home-Intruder Sex Offender

Abstract

One particular crime location in sexual assaults is the victim's residence.

Similar to sexual burglars, "home-intruder" sex offenders choose to assault the victim in her residence, most likely in their bedroom.

The aim of the current study is to analyse modus operandi, temporal factors, and victim characteristics in a sample of 347 stranger sexual assaults committed by 69 serial sex offenders to determine which factors may be more relevant to sexual assaults committed in the victim's residence compared with sexual assaults committed at another type of location. Our hypothesis is that offenders who choose to sexually assault victims in their home constitute a specific type of sex offender, one that resembles the sexual burglar. Results showed that modus operandi (e.g., burglary), temporal factors (e.g., time at crime scene with victim), and victim characteristics (e.g., age, victim-offender relationship) were significant in predicting whether the victim encounter, crime site, and victim release site were located at the victim's residence or not. Moreover, these findings were generally significant across the three crime locations, which can be explained by the high consistency in location during home-intrusion sexual assaults. Situational crime prevention strategies aimed at making a residence less attractive for offenders should help reducing this particular type of sexual assault.

Keywords: decision making; home-intruder sex offender; prevention; rape; sexual burglary.

None of that bears any reference to the circumstantial evidence in the MM case; nor does it lend inference to her case.
That evidence painfully collected and collated over the years by many different investigations and investigators including those presently tasked with working the case, will be the stand alone evidence unique to the circumstances of the case which kicked off in 2007. And which will decide whether or not CB will be indicted and brought to trial.

This point puzzles me, too. Perhaps the image possession charge is being kept in reserve, in case LE need a way to keep CB in custody while the MM evidence collection/interpretation trundles on.

IMO the latest search was based on a specific tip-off. It was clearly targeted on a precise location & they finished early, having found what they wanted. The gun at the bottom of a well may not have any direct relevance to the MM case, but perhaps it confirms that their informant is reliable? That could be important if the same person also has information which *does* relate more directly to CB's involvement with MM.
Being kept in reserve for what? There are only two options: the evidence is insufficient to obtain a conviction so they can’t charge him or it was collected in a way that makes it inadmissible.

It is hard to understand what the BKA is actually investigating in relation to MM given the extended timeframe.

It may be that the informant gave the tip-off about the gun but it hasn’t been reported that CB has committed any armed offences so even if there is a good source, it’s hard to see the relevance of such a find. It’s equally possible that this is a known meeting location of petty criminals and any one of hundreds of them could have thrown a gun down the well.

The media strategy is just to keep CB in the frame. So called evidence, like chemicals in a car unrelated to the MM case or a gun of no known origin could mean something but it’s more likely that they are meaningless and spun to align to the official narrative. None of this stuff has even been reported as having a connection to MM probably because there isn’t one.

It’s minimising. 75 swimsuits are highly significant. I think we all know that.

Certainly very odd but then so many of CB's reported behaviours are decidedly odd.
It may not be illegal to pose naked by a lakeside with a black mask superimposed on his face. But it is illegal to choose a victim and enact a fantasy involving vicious rape on her in her home where she should have been safe, while replicating his waterside private exhibition complete with mask.

This proves an offender who enacts and inflicts his vilest intentions on unwilling victims. Expert opinion is that he will do so again given the opportunity provided by his release into society.
As far as his connection with MM is concerned need one ignore what has been flagged up in reference to his electronic forays.

Now if it were pyjamas it might have some worth.
Seldom does one get a real glimpse of what motivates the actions of a recidivist sex offender who operates across the spectrum. But investigators have it illustrated first hand in CB's fantasies in which none are safe ranging from older women to very young children = what happened to DM and his former girlfriend's daughter.
None are safe from a predator such as CB. Bad enough what was done to her daughter the girlfriend must heave a sigh of relief when reading about his fictional plans for a mother and child.

There is no doubt that CB enacts fantasies. There is no doubt that he enacts entering people's homes to do so.
Perhaps the opportunity was to much to be resisted when he came across MM asleep in bed. And there one has the link to MM.

Jim Gamble said the celebrations may have indicated a significant discovery.
Celebrations? Or shaking hands to say goodbye?
Imo there'd be a major leak if the smoking gun had been found maybe not what was found but something major had.

One really should not comment since missing the incident mentioned.
But am happy to go with the opinion of a highly trained and experienced observer giving his professional take on police reactions to events in the field.

Had they been saying their goodbyes if the operation had not shown signs they would have been glum.

No leaks because experience shows that is not their practice. Nor is it required; the prosecutors' objective is locating sufficient evidence to justify charging the suspect.
Perhaps they are in the process of successfully finalising that.

It’s an interesting take from Jim because of his experience.

It could have been niceties & an appreciation of the team work, especially if it is planned that they will do another. It was “very constructive” - a phrase being perceived in different ways, but perhaps it’s a reflection of the way they all worked together.

Celebrating, clapping & sharing a drink would be very inappropriate if they had all just finalised a £300000 failed operation, especially given the magnitude of this case & what they were looking for.

Those involved will have signed the equivalent of NDA/confidentially agreement and breaching this would lead to serious repercussions.

The Portuguese were primarily tasked to run the barriers & control of logistics into the site. The German’s were running the search. Although there probably were opportunities for other eyes to see & words to reach the barriers. Judging by the secrecy & how highly co-ordinated this was, I imagine they had a strategy for preventing what they found from being articulated correctly to those manning the fences.

Race against time for German OM

Main suspect in Madeleine McCann case may be released: anonymous donor pays outstanding fine Christian Brückner

Braunschweig

"According to the German newspaper Bild, an anonymous donor paid the fine. It concerns an amount of 1446 euros, which was outstanding from an earlier conviction from 2015. If Brückner could not pay that, he would have had to serve another 56 days after September 17 as an alternative punishment. Thanks to the donor, that scenario now seems to have been avoided."
