My take on what's going on is that Board Certified Attorney, Lyons shared that the firm she worked for at one time did this fascinating work for families. I thought she was going to say low income families, but she meant rich, rich families. Off shore and such. Now they're talking about Family Planning including wills, probate, etc., She seems highly qualified, but not polished in from of the Jury. JMO

Side note: we were given so much more insight to Mark and his garbage than the jurors. SIGH..... I really was expecting more. What a shame!

Wonder if the life insurance was to be paid into a trust for the benefit of the girls.

  • #706
She's doing a horrible job explaining trusts.

She's worth more to Mark alive instead of dead ONLY if she doesn't divorce him. Unfortunately the neighbor was the only person that testified that revealed cracks in the marriage. I'm not forgetting anyone, am i?

Now I understand why they chose Lyons to be their last witness....

When we talk about a trust a settlor is the person who created the trust and is usually the person putting the assets into it.

An irrevocable trust cannot be amended once it is signed and it gets it's own tax ID number, Lyons said.

Lyons did estate planning for Teresa Sievers and Mark Sievers.

Lyons finished an irrevocable trust agreement for the Sievers in 2009.

Mark Sievers was the beneficiary on the trust agreement, Lyons said.

In 2008/2009 Lyons was working in trusts and estates and met Mark Sievers and Teresa Sievers.

A close friends of Lyons knew Sievers and the friend told Lyons Teresa was a good doctor.

CWW testified that MS had told him that TS would be leaving him after an affair. He was afraid that he would lose the girls.

Yes, it was, according to CourtTV commentators this morning.

She is. My live feed keeps freezing up and I don't even care. I'm sure I'm not missing much.

I wonder if she has MS or a processing disorder of some kind. Her halting way of speech is very distracting.

Ha! My mind literally went right over that! Just those two? No one close to TS? That's what the State needs right now.

You have given the assets away at the time of your death then the IRS will say you did not own the assets at the time of your death so it can save money, Lyons said.

This is a great planning method to minimize estate taxes, Lyons said.

Mummert is now going through the document. He asks Lyons why she would draft an irrevocable trust for someone.

The assets inside the irrevocable trust, if it's done properly, are usually outside your estate at the time of your death and won't be estate taxed, Lyons said.

You want the trustee to go out and buy a new policy, then if the insured died from the IRS stand point then the proceeds are not included in their estate.

Lyons is trying to explain the advantages of the trust and it's a little confusing.

That policy would then fund the trust that Lyons drafted, Lyons said.

The policy was for $2.5 million, Lyons said.
