IU By me,, so in a provoked flight , officers still have the right to pursue , correct? So why even say whether it's provoked or unprovoked . It sounds like LE has the right to pursue you if you run for any reason .

Imo, someone may have finally realized the millions paid out for LE to not use seatbelts is ridiculous. Surely this amount could be better spent in the community?

And what about the officer injuries from close contact with irate arrestees while attempting to seatbelt in close quarters?

That assertion came from a "family source" of the van driver. It might be true, but it makes more sense to me for it to be the responsibility of the two police van officers to secure arrestees in the van than for bike officers who need to get back to work asap.
There is only one van driver.

I am sad that a sworn officer of the court is having her integrity questioned.

FG was a victim here. Yes, he may have been a criminal in the past or on that day but once he was handcuffed and shackled the officers had a duty to protect his health and safety. Are we not a victim friendly site? FG was not saint but he died handcuffed/shackled on the floor of a police van.

In Ferguson, the police stood down on the first nights. Similar, no?

We may not like that the officers have been charged but why do people need to see the prosecutor as against LE? In Ferguson, many questioned the prosecutor but the general tone was that it was his call to go to the Grand Jury. She makes a call and every move she makes is seen as done based on her leanings toward the youth of Baltimore.

I understand your point but using Ferg-son as a model of what to do leaves you with a weak argument, sorry.

Lots of PD sources being cited. How will their unattributed comments help to heal the situation? I don't see that it will. More divisions between protestors and LEO based on insiders and rabble-rousers. IT is a shame to me. All of the officers will have their day in court. We have to trust in the legal system to settle this all out.

He was just saying that in this instance it was unprovoked but they still have a right to pursue. jmo

I thought the stand down there was ridiculous as well. But, it is important to know that I am not on the inside. It is not just the leadership of Baltimore that makes statements and decisions I don't understand. Leadership does the best they can. Hopefully each town learns from another. The civil court liability is a tough one because it is impossible to anticipate what is going to happen.

"Headlong flight -- wherever it occurs -- is the consummate act of evasion: it is not necessarily indicative of wrongdoing, but it is certainly suggestive of such."

"Therefore, the court held that, while presence in a high crime area, standing alone, is not sufficient to establish reasonable suspicion[SUP],[/SUP] when coupled with unprovoked flight at the sight of the police, this amounted to sufficient reasonable suspicion to justify the stop."
