UPDATED: Judge allows release of autopsy

The attorney representing George and Cindy Anthony filed the motion on June 10 to prevent the release of the report because the information contained inside &#8220;will cause great anguish to the Anthony family&#8221; who are still struggling with the loss of their only granddaughter.

The motion reads that the two understand the report will eventually be released during the murder trial of their daughter, Casey. Releasing the information now would &#8220;cause endless comment and speculation in the media and public forums.&#8221;

The motion was denied by Circuit Court Judge Stan Strickland during a hearing this morning which lasted around 30 minutes.

WFTV legal analyst Bill Sheaffer said the grandparents had no legal standing in the case and predicted the judge will release the autopsy, a public document. Belich said the hearing might last just 15 minutes.

WESH-Channel 2 reported that Casey Anthony won't attend the hearing. "Those who've seen the autopsy report tell me that there's nothing in it that really resembles a smoking gun of any sort in the overall case against Casey," WESH's Bob Kealing said.

George or Cindy Anthony might take the stand in the hearing, their attorney, Brad Conway, told Kealing.

Kealing also talked to a journalism expert who said the Anthony coverage has been overblown but who also predicted that the judge would release the autopsy.

"We have a very open system in Florida, and we work really hard to keep it that way," said Al Tompkins of the Poynter Institute. He said the Anthonys' argument of suffering anguish isn't enough to block the autopsy's release.

Cindy Anthony, the grandmother of Caylee, was also in the courtroom for the hearing and appeared to be crying during the testimony, holding her head in her hands.

Cindy Anthony shook her head back and forth as the ruling was announced.

"I'm not happy to make the ruling. In fact, I wish I didn't have to, but it's something that I legally have to do," Strickland said.

Jose Baez, the defense attorney for Casey Anthony, asked that the release of the report be delayed for 48 hours to allow the defense team time to prepare. Strickland denied the request.

The autopsy report for slain toddler Caylee Anthony agrees with authorities' contention the girl was killed, but says the method is unclear.

The report says there was no trauma to Caylee's skeleton, but notes duct tape was over the lower part of her face. The autopsy says the tape was clearly placed before the body began to decompose.

At the court hearing, George and Cindy Anthony did not get the answer they wanted. George was emotional as he spoke to Judge Stan Strickland to try to convince him not to release his granddaughter's autopsy report.

"Please show us some peace and some dignity by keeping this report sealed," said George Anthony to Judge Strickland.

The Anthonys said releasing the report would cause them even more anguish and they were afraid that the results will be exploited.

The autopsy for Caylee Anthony reveals that "several pieces of overlapping duct tape" were found on the toddler's jaw and upper lip, WFTV-Channel 9 reported this afternoon.

The ABC affiliate said its Kathi Belich was the only local reporter with the autopsy at 12:30.

"The medical examiner believes that tape was applied before decomposition started," Belich said. "So that would imply before Caylee's death. The medical examiner says no drugs were found in Caylee's body."

Belich reported that the medical examiner wrote that the child's body was placed in a bag and in the woods shortly after the toddler was murdered.

During 12 days of examination, Dr. Jan C. Garavaglia concluded that there was no evident trauma to Caylee's skeleton. The duct tape found on the head of the skeleton was clearly placed prior to decomposition, according to the autopsy report.

Garavaglia also concluded, according to the autopsy report, that there is nothing inconsistent with the body being placed in the wooded area soon after the date of last being seen alive, and that although a cause of death cannot be determined with certainty, the manner of death is homicide.


The forensic report for Casey Anthony's 1998 Pontiac Sunfire was also released. The report noted that there were no maggots in the box of pizza that was inside the car. Earlier in the investigation, Cindy Anthony blamed the pizza for the "dead body" smell coming from the car, saying it had been left in there for a long period of time. The reported concluded that materials associated with decomposition were found in air samples taken from the car.

Authorities were investigating for a brief time this afternoon whether autopsy photos of Caylee Marie Anthony were released today to a member of the public in violation of state law.

They were not released.

State Attorney's Office spokesman Randy Means expressed concern earlier today that two autopsy photos could have been accidentally released to a legal analyst for WFTV Channel 9, which was the first station to get the autopsy report of the slain 2-year-old from east Orange County.

Legal analyst Bill Shaeffer told the Orlando Sentinel the copy he received from the judge's office did not contain any autopsy photos. That copy was released about 30 minutes prior the release from the State Attorney's Office.
After the judge's ruling, Shaeffer, a legal analyst for Channel 9, received a copy of the autopsy report from a person in Circuit Court Judge Stan Strickland's office, Means said.

The report he picked up may have included two autopsy photos, Means said. Shaeffer said the photos were not included in the report he received.

When Belich joined a group of reporters, Baez told her, "You're screwing up everybody's sound bites."

Later, he asked Belich if her name is really Gallagher.

She said she didn't understand his question. Later, she asked: "Has your private investigator been looking into me instead of Casey's case? Why are you asking me the question?"

Baez shot back: "Another reporter told me. You're well thought of among your colleagues."

Autopsy of Caylee Marie released
The Medical Examiner's autopsy report on Caylee Marie Anthony released today showed there were no drugs found in the body of the 2-year-old at the time her death.

Also released today were reports from the Oak Ridge National Laboratory in Tennessee, where scientists analyzed decomposed pizza and a squirrel.

The report shows several overlapping pieces of duct tape on Caylee's skull.

"Although there is no trauma evident on the skeleton, there is duct tape over the lower facial region still attached to head hair," the report said. "This duct tape was clearly placed prior to decomposition keeping the mandible in place."

They also noted that a portion of her skeletal remains were intermixed with two plastic trash bags and a canvas laundry bag. "The bags have a woodsy, outdoor odor with no smell of decomposition," the report said.

Of the 51 chemicals identified from Anthony's trunk carpet sample, 80 percent were consistent with decompositional events, the report said.

"Nearly all the compounds present in early human decomposition were detected in the trunk samples if their concentrations were high enough to detect," the report said.

WFTV's Kathi Belich zeroed in on a central irony in coverage of the case. "George Anthony got very, very emotional as he tried to convince the judge that releasing the autopsy report would hurt his family even more," she said. "But the emotion disappeared when he was asked by a media attorney how many times the Anthonys have appeared on national television."

Rachel Fugate, attorney for the Orlando Sentinel, posed the question. And if George couldn't remember, it seems like dozens of times.

Attorney Brad Conway said George and Cindy had not read the autopsy or heard the details, but that the duct tape was the difficult information for them, Belich reported.

The remains of murdered Orlando girl Caylee Anthony found near her home included a nearly complete skeleton, and the 2-year-old didn't have any drugs in her system when she died, according to autopsy and toxicology reports released Friday.

The autopsy says investigators collected "an almost complete skeleton of a young child with only multiple small bones missing. The missing bones include small bones from the wrists and hands, as well as fingers and ankle, hyoid and patella."

There were also several overlapping pieces of duct tape on the toddler's skull, according to the report, penned by Orange County Chief Medical Examiner Dr. Jan Garavaglia and others.

"Although there is no trauma evident on the skeleton, there is duct tape over the lower facial region still attached to head hair," the autopsy says. "This duct tape was clearly placed prior to decomposition keeping the mandible in place."

Zenaida's Attorneys File Motion Against P.I.

An ongoing legal battle continues over whether private investigator Dominic Casey should be held in contempt of court in the civil case against Casey Anthony.

In a motion filed Friday, Zenaida Gonzalez's attorneys say Dominic Casey should still be held in contempt for not showing up to a scheduled deposition in March.

However, Dominic Casey's attorney told a judge that he notified her lawyers before the deposition that he needed more time to get a legal counsel.

Casey Anthony case: Zenaida Gonzalez's attorneys fire back

Private investigator Dominic Casey needs to show up for deposition "as witnesses do every single day," Gonzalez's lawyer John Morgan argued in a motion filed in Orange County Circuit Court.

"The amount of stonewalling that has taken place in the discovery phase of this lawsuit by both the defendant and some of the witnesses is extraordinary," the motion states.

Gonzalez wants Orange County Jose R. Rodriguez Circuit Court Judge to declare Casey in contempt of court.

Casey worked for the Anthony family, and argued in a prior motion that he should not have to appear. Because he collected information on the case as part of his job, by law, that information does not have to be disclosed, his lawyer argued.

He also pointed to chemicals found in the trunk of Casey Anthony's car that suggest the child was deprived of oxygen. Anthony is charged with the first-degree murder of her child.

"All in all, I think that's why the state is seeking the death penalty," Hornsby said. "Caylee Anthony, no matter how she died, whether it was from the duct tape or being in the trunk, suffered. For a few minutes, she knew she was dying. She knew she was in pain. She suffered tremendously."

My take: The autopsy can only make the public care more about Caylee. If you don't understand why so many people care about this little girl, reading the autopsy will bring that point home.

Technicians spent more than a week scouring woods off Suburban Drive in east Orange County to locate her remains. They found bones buried in muck, and even found one partly buried under the trunk of a palmetto.

By the time Caylee Anthony's body was found in December -- six months after she was last seen alive -- roots began to grow through her remains and other items at the scene, including a plastic garbage bag and blanket.

Scientists at the Oak Ridge National Laboratory in Tennessee provided local investigators with a detailed report, released Friday as part of the autopsy documents, in which they analyzed the decomposition of a squirrel and a piece of pizza and compared it to evidence collected from Casey Anthony's car.

The scientists also got an adult squirrel -- apparently the victim of a hit-and-run. The researchers let the animal decompose outside for about 10 days in a trash can. They noted that "results of this analysis showed very little similarity to the Florida carpet sample."

Conway appeared on a morning news program Monday and said the release of Caylee's autopsy report and Father's Day made things tough for the Anthonys.

"This was a very difficult weekend for both George and Cindy and they got through it as best they could, but it was very, very hard," said Conway.

An attorney for the family of Caylee Anthony appeared on NBC's "Today" show on Monday to discuss the release of an autopsy report on the toddler.

Judge Stan Strickland ordered the report released on Friday after hearing an emotional plea from George Anthony to keep the results private.

A portion of the report indicated duct tape found on the head of the skeleton -- and that the tape was clearly placed prior to decomposition, according to Orange County Medical Examiner Dr. Jan Garavaglia.

Conway said the family was disappointed about the release of the report, but he said it would remain to be seen whether it would affect a jury pool.

State Wants To Photo Anthony's Tattoo
Prosecution Requests Trial Within 60 Days In Check Fraud Case

The state attorney's office has filed motions in two different cases against Casey Anthony, including a request to photograph one her tattoos from jail.

In motions filed on Monday, the prosecution requested to take photographs of a tattoo on Anthony's shoulder.

Tattoo artist Danny Colomarino told investigators he gave Anthony the tattoo in early July 2008, two weeks after her daughter, Caylee Anthony, went missing.

In the other motion, prosecutors asked that a trial date be set in the check fraud case against Anthony.

Last fall, Anthony's defense asked that the check fraud trial be delayed so they could focus on the murder charges against Anthony, but in a motion filed on Friday, the prosecution asked that the trial be set for a date within the next 60 days.

The check fraud charges against Anthony stem from accusations from former friend Amy Huizenga that Anthony made several purchases at Target using Huizenga's checks.

The "View" panelists wanted guest Nancy Grace's take on the saga of slain toddler Caylee Anthony and her mother, Casey, who is charged with the child's murder.

HLN host Grace talked about the autopsy and the finding of duct tape on the child's face -- "prior to decomposition, most likely while the girl was alive."

The "View" team reacted with revulsion.

"But there's no motive?" Barbara Walters asked.

"Don't need motive," Grace said. "If I had to crawl into every murderers' head that I ever prosecuted, I'd still be trying to prove my first murder. Why would you murder anybody? But it does help the state to have a motive."
