Casey Anthony: '48 Hours Mystery' did license footage

The newsmagazine issued a statement: "In keeping with longstanding policy and practice, CBS News did not pay for any interviews relating to the Anthony story. Licensing footage is a standard industry practice done by television news programs to produce a visually complete story."

A Web site promo for the program shows Cindy Anthony, Casey's mom, talking in an interview. An announcer says, "The case that riveted the country. Her granddaughter dead. Her own daughter accused. Now Casey Anthony's parents are fighting to save her life." Casey Anthony is charged with the first-degree murder of her 2-year-old daughter, Caylee.

A CBS News spokeswoman said the program isn't finished, that the snippet of Cindy Anthony is a small part of the program and that "48 Hours Mystery" gives both sides of a story.

Casey's Defense Files Motions In Murder Case

The defense team's "Amended Motion for Venue Change" asks the judge to either throw out the murder case against Casey Anthony or move the trial to south Florida.

A "Motion To Dismiss Due To Spoliation Of Evidence" has the defense saying the state failed to preserve any evidence that could clear Casey by not allowing defense experts to be present where Caylee's remains were found in December while investigators were processing the area.

The defense also wants the jail videos of Casey and her family to be destroyed and submitted a "Protective Order" requesting such action.

The defense also issued a response to the state's request to "compel reciprocal evidence" and asked that attorney visits with Casey not be videotaped.

Lawyers Want All Charges Dropped In Anthony Murder Case

The motion filed Thursday afternoon seeks dismissal of all charges because evidence was not properly preserved.

Defense lawyers said exculpatory evidence was not preserved and that violates Casey Anthony's rights. Exculpatory evidence supports a defendant's claim of innocence.

The motion says the only evidence suggesting a homicide are conflicting reports of where the remains were found, and without evidence the defense cannot challenge the opinions the state is bringing to court.

They contend Casey Anthony's rights were denied because lawyers can't effectively confront and cross examine witnesses.

Another motion asks the court to block recordings of Casey Anthony when her lawyers are present and when she receives visits from her parents, George and Cindy Anthony.

The defense team says in their motion they want the charges dropped because the evidence is spoiled because it was not preserved by the state.

Anthony&#8217;s attorney&#8217;s say the state destroyed the area where Caylee&#8217;s remains were found by Orange County Meter reader Roy Kronk on December 11, 2008 and by doing so the state has prevented the defense team from gather evidence.

Attorneys for Anthony are also asking that a change of venue for the murder trial be ruled upon within 30 days

A hearing date on the motions has not been schedueled.

Central Florida News 13 said one motion asks that recording at the jail be stopped when Anthony is talking to her lawyers and family.

The attorneys said they also want a change of venue, maybe in Miami-Dade, Broward or Palm Beach counties, and they want a ruling in 30 days.

They said they also want all video and audio tape of their client recorded by the Orange County Jail to be destroyed.

Casey Anthony's defense team asked that the murder case against her be dismissed because the state prevented her attorneys and their experts from properly inspecting the scene where her daughter's remains were found, according to court documents filed late Thursday.

In addition, Anthony's lawyers asked Orange Circuit Judge Stan Strickland to stop the Orange County Jail from videotaping her visits with them and with her family.

&#8226;The defense agreed to the state's request for a transcript of George Anthony's grand-jury testimony. He testified before his daughter was indicted for murder.

&#8226;Her attorneys also filed a response to prosecutors' request for evidence supporting a defense claim that someone other than Casey Anthony placed Caylee's body in the woods. Anthony's attorneys wrote that their claim was based on documents, pictures and video provided by the state.

Anthony's lawyers filed the motion Thursday night. They also asked the judge to stop the Orange County jail from videotaping Anthony's visits with them and with her family.

The defense said Anthony needs family support and releasing the recordings of her jail visits could be an attempt to punish her before the trial.

A message left for a state attorney's office spokeswoman was not immediately returned early Friday.

Anthony's defense team also said they would like the trial, if it proceeds, to be moved to Miami-Dade, Broward or Palm Beach counties. They said they want a ruling on the matter in 30 days.

Brad Conway, the attorney for Casey&#8217;s parents, George and Cindy Anthony, told News 13 Friday that his clients have no problem with their visits with Casey being recorded, but unless it has some value as evidence, they do not want it released to the public.

Conway said he felt pretty confident the motion would be granted to keep those visits sealed unless they would be used some way in trial.

A representative with the Orange County Jail told News 13 visits are always monitored for the client&#8217;s safety. The representative added they have no intention of offering special treatment to Casey Anthony, and she would be treated like every other inmate.

Prosecutors want a transcript of George Anthony's secret grand jury testimony that led to the first-degree murder indictment against his daughter Casey.

George, a former detective, told investigators he recognized the unmistakable odor of a dead body in the trunk of Casey's car when he picked it up at a wrecker service.

Prosecutors presented the grand jury case and George is working with the defense team, so both sides likely already know a lot about the testimony, which is supposed to be secret.

Lawyers for Casey Anthony not only want all charges dropped against her in her murder trial, but they also want to stop authorities from videotaping her meetings with her family and attorneys.

This second motion, filed Thursday along with the bombshell request to drop all murder charges, deals more with Casey&#8217;s family. The Orange County Jail has recorded video every meeting she has had with both attorneys and family members -- all without audio, to respect attorney-client privilege.

That, however, is not the case with regular jail visitation.

The state has requested a copy of George Anthony's testimony before a grand jury last October because it says what Anthony said in a later deposition was inconsistent with those statements.

Ashton wants a judge to allow him to view that testimony and, if his suspicions are correct, unseal the information and provide it to Casey Anthony's defense.

George Anthony testified before a grand jury on Oct. 14. His daughter, Casey Anthony, was later indicted on first-degree murder charge following that hearing.

The State Attorney's Office wants the the court to unseal George Anthony's testimony so it can be reviewed.

But could conflicting comments by George Anthony be catching up with him? Prosecutors are asking Judge Stan Strickland to order a transcript of Anthony's grand jury testimony.

What if inconsistencies are found? Ashton hopes the information will be unsealed and shared with Casey Anthony's defense team, Kealing explained. The defense team is not contesting Ashton's request.

Prosecutors want Casey Anthony's lawyers to prove how the state prevented them from inspecting the scene where Caylee's remains were found.

Ashton wrote how it was "baffling" that the defense filed the request before their experts examined the evidence already collected.

"What are noticeably absent are the affidavits from their panel of celebrity experts, who appeared for a photo opportunity at the crime scene, indicating that they have examined the available evidence and photographs and find they are insufficient to allow them to arrive at reliable conclusions which might challenge those of the state's experts," the prosecutor wrote.

The state asked a list of the defense witness and for a hearing so prosecutors could cross-examine them. They also want the opportunity to depose the witnesses before the hearing.

"It is clear this matter will require a lengthy evidentiary hearing with the burden of proof on the defendant," Ashton wrote.

Prosecutors are challenging the defense team in the case against Casey Anthony. The prosecution filed a motion Tuesday asking Casey's attorney, Jose Baez, and his team to prove the state kept defense experts from having adequate access to the site where Caylee's remains were found.

The defense wants the case dismissed because of issues with the crime scene.
