Anthony civil case hearing in January

It appears the civil case against Casey Anthony could be around for a while. On Tuesday the judge scheduled a hearing for January 10, 2010.

In January the judge will decide if a private investigator will have to go through depositions with Gonzalez&#8217;s attorneys and if the private investigator Dominic Casey will be fined. They claim he lied under oath.

The state attorney's office filed a motion claiming that the defense is exaggerating their argument. They are also bashing the defense for not providing sworn statements from their "celebrity experts" saying how it would be useful. No hearing has been scheduled yet on this motion.

Prosecutors are challenging the defense team in the case against Casey Anthony. The prosecution filed a response to a defense motion Tuesday asking Casey's attorney, Jose Baez, and his team to prove the state kept defense experts from having adequate access to the site where Caylee's remains were found.

The defense wants the case dismissed because of issues with the crime scene.

Some suspect Cindy Anthony took the money in connection with her upcoming exclusive interview on the CBS news magazine show "48 Hours Mystery."

A representative for the show said, "CBS News did not pay for any interviews relating to the Anthony story. Licensing footage is a standard industry practice done by television news programs to produce a visually complete story."

For journalists, the Casey Anthony case is increasingly becoming a study in ethics. For the public, it's a matter of basic decency.

For the public, the issue is simpler. Many people simply see it as wrong that the Anthonys have benefited in any way from the story of their granddaughter's death. To those observers, George and Cindy Anthony betrayed their granddaughter and obscured the truth.

Morning programs, such as NBC's "Today," CNN's "Larry King Live" and CBS' "Early Show," have flown George and Cindy Anthony in for interviews and put them up in hotels. ABC News paid for the grandparents' stay in a posh local hotel after Caylee's remains were found.

But what have the Anthonys done to merit such treatment? It's not like they have a movie or a book to promote. No, they just have a story to tell, one that has changed over the months. They also seem to like the spotlight too much.

Television networks will hold to their line that the licensing is a standard practice, but the public senses something isn't right with the arrangement. It just took the shameless example of the Anthonys to give the issue new prominence.

The claim was based on a fingerprint examiner at the Federal Bureau of Investigation laboratory reporting that she saw the shape or outline of a heart on the duct tape.

But Local 6 has learned no one else will ever see what that examiner saw because all traces of it were destroyed by testing at the FBI lab.

How did this happen? "Any outline was obliterated in the fingerprint-testing process," Pipitone read from a report that station had obtained before its official release.

And Pipitone added that the FBI didn't take a photo of the heart-shaped image before the testing, which revealed no fingerprints on the duct tape.

The FBI had refused to comment on the revelation that it didn't take a photo, Pipitone said.

"We don't know if some other agency might have taken a similar picture that shows such an outline," Pipitone said. "But we know that there's no mention of such a photo in the 8,000 pages that have been released so far."

It was another first-rate report from Pipitone. And he promised a follow-up today: an interview with a former prosecutor about the revelation could mean to the case.

Orlando defense attorney Richard Hornsby said he believes prosecutors can still use similarity between the tape found on the child's skull with tape on a gas can from the Anthony home and detectives who saw residue of the sticker on the duct tape could testify it appeared to match stickers found in Casey Anthony's belongings.

"I'm not convinced Baez would be able to get this evidence excluded if it was destroyed in the process of trying to get a fingerprint," he said. "That is excusable conduct on the part of the state."

What could it mean at trial? The sticker development doesn't help the prosecution, which wants the strongest case in a "CSI"-savvy world, former prosecutor Elizabeth Rahter told Pipitone.

Pipitone added, "Now no jury can see it [the outline] and no analyst can compare the shape and size to the heart stickers found in Casey Anthony's arts-and-crafts closet." Casey Anthony is charged with the first-degree murder of her daughter, Caylee.

And yet, Rahter said the information could get into the trail if the lab employee testified about seeing the sticker outline. Pipitone said the loss of the image could allow the Anthony defense team to raise doubts about the FBI lab, which has tested other evidence in the case.

Casey Anthony: WKMG gives thumbs-up to book on Casey Anthony case

How often do you hear a book review on local news?

Just about never. But WKMG-Channel 6's Mike DeForest turned reviewer last night and gave a thumbs-up to a new, 352-page book about the Casey Anthony case. The book: "Mommy's Little Girl" by Diane Fanning. It will be out in early November.

DeForest interviewed Fanning, who said the Anthony story is so odd that readers wouldn't believe it in a mystery novel. Fanning, who has written other true-crime books, said she hoped the Anthony book will "help people understand the red flags so that it will help someone save another child's life."

DeForest kept returning to the critic's role: "The author weaves a compelling narrative about Casey Anthony's often peculiar life."

FBI didn't photograph Caylee Anthony sticker residue

The residue from a heart-shaped sticker found on duct tape stretched across Caylee Marie Anthony's mouth couldn't be detected after FBI officials processed the evidence for fingerprints, according to court documents.

And, FBI officials failed to take a picture of the residue before it was destroyed.

Prosecutors are not commenting about the case.

An FBI laboratory activity and communication log, which was included with the defense's motion to dismiss filed earlier this month, had handwritten notes by lab technicians.

On Dec. 13, a technician wrote "a heart shape/outline was noticed on tape but unable to see it after (fingerprint) powder process &#8212; no photo of image."

State law-enforcement officials took pictures of the duct tape attached to the skull, but it was unclear whether the pictures reveal the residue.

Also on Friday, Cindy Anthony's attorney Brad Conway said no interview has ever been paid for during his representation of the Anthonys.

In Lee Anthony's most recent sworn deposition, his former attorney said prosecutors asked him an unexpected question.

"The question was, 'It came out in your mother's sworn deposition yesterday she was taking remuneration from this case,' and they asked my client, and he said 'no,'" Attorney Tom Luka said.

Some suspect Cindy Anthony took the money in connection with her upcoming exclusive interview on the CBS news magazine show "48 Hours Mystery."

"Mommy's Little Girl" breaks down thousands of court documents in the case to make them easy to understand.

The book also provides some insight into the Anthony family.

Fanning also speculates about how Anthony might have killed her daughter, Caylee Anthony.

A spokeswoman for state attorney Lawson Lamar said the office anticipates releasing between 1,000 and 2,000 pages of material Tuesday morning.

FBI Intelligence Analyst Karen B. Cowan wrote in an e-mail dated Tuesday, Sept. 30, 2008, that "a very interesting photo exists of the trunk liner, which you have, which highlights the very large stain. If you look closely at this photo, there appears to be the outline or silhouette of a child in the fetal position. You can make out what may be the back, bottom, and legs most clearly. The image is best viewed on a computer screen, rather than a printout, but several of us can see this image and agree there is good chance we are seeing something significant."

The e-mail was addressed to Erin P. Martin of the FBI, and can be found on page 34 of Document VII.

Book About Casey Anthony Expected In November

You can now read up on the case against Casey Anthony through a new book hitting the shelves in November.

In "Mommy's Little Girl," true crime author Diane Fanning poured through thousands of public court documents to deliver Casey's story and a picture of her family life in novel form.

Casey is presumed innocent until proven guilty in a court of law, but the author also theorizes about why Casey might've killed Caylee.

The state attorney's office on Tuesday will release 1,000 to 2,000 pages in the case against Casey Anthony, WESH said. WOFL-Channel 35 described the release as "a slew of new information."

Dominic Casey, the private investigator working for George Anthony and Cindy Anthony, kept a cheat sheet on the people involved in the Casey Anthony case, including reporters and hecklers, according to the documents.

His report shows pictures and notes on the probability of the individuals carrying a weapon.

George and Cindy Anthony signed a contract with the private investigator on Oct. 31, 2008.

"The investigator will focus primarily on investigating the circumstance surrounding the disappearance of Caylee Marie Anthony, follow up on all information and leads resulting from the investigation, leads provided by the client search and pursue the return of Caylee Marie Anthony," the contract stated.

The attorney for Casey Anthony's parents said he will release evidence that raises "serious questions about the case" on Wednesday.

Tuesday, prosecutors in the Anthony investigation released more than 1,000 pages of documents related to the case.

Brad Conway said the evidence he intends to release contains information the state "should have released today, but didn't."

A female DNA profile was discovered, but it did not belong to Caylee, Casey Anthony or Cindy Anthony.

That prompted the FBI to scour its own personnel to determine who handled the tape, and tests indicated the DNA belonged to one of their own female technicians. When that information is coupled with revelations from last week about testing obliterating residue of a heart-shaped sticker on the duct tape, it could leave the lab's methods open to criticism.
