Documents show that on Oct. 9, Orlando police responded to two separate calls from neighbors near the Anthony home.

The callers told police they heard calls for help from the wooded area where later Caylee's remains were found.

A teacher at nearby Hidden Oaks Elementary School said an austistic child was yelling around that time but not the word "help"

Officers said they did not go into the wooded area because of thick vegetation and that the ground was very wet -- some parts covered in deep water.

Now we know that the real prize to the State is the thirteen felony fraud convictions for use as impeachment in the Murder case. Thus we know that the defense wants to avoid trying the Check Fraud case before the Murder case at all costs.

However, with Judge Strickland having granted the State’s Motion to Set a Trial Date in the Check Fraud case, it seems likely that the Check Fraud case would be tried first.

Now here is where things get dicey for me – because, as Blaise on WebSleuths would say, I am not Judge Strickland and he is not me, for I am the Walrus. Meaning that Judge Strickland has options at this point and only he knows what he will do.

Strickland told prosecutors to issue a investigative subpoena. If anything else comes out, the court can address it next week, which was when the initial deposition was scheduled.

Ashton said Caylee died with duct tape over her nose and mouth. A child that age should have been able to remove the tape -- so she must have been chemically or physically restrained, he said.

There is a misunderstanding why the state opts to seek the death penalty, he said. A jury will decide this case, and then the court. The state isn't deciding to seek the death penalty.

Strickland said he would rule as quickly as possible, and told the court he saw "good lawyering.".

Lyon said even if their meetings are just to say "I love you," it will appear on the front page of the paper and on TV.

The judge did not rule on the jail video issue.

Casey broke down in tears when Judge Strickland basically didn't rule on much, saving rulings on the most important motions for either later Friday or next week.

Casey cried as her attorneys explained that she's had no conversations with her parents for one year because all of them are recorded inside the Orange County jail. Casey’s attorneys say, more importantly, their conversations with their client are compromised when security cameras are on them inside the jail.

Casey broke down in tears yet again when a prosecutor described a scenario that might have led to Caylee’s death.

“If she was physically restrained, her killer would have to restrain her arms by some means, applying tape while she was conscious,” the prosecutor said. “As the killer looked into her face, maybe her killer even looked into her eyes as the tape was applied. First one piece, then two, then three, so that no breath was possible.”

UPDATED: Will Casey Face Death Penalty?

The judge in the case against Casey Anthony heard three key motions, including whether the state should be able to seek the death penalty.

Judge Strickland said the check fraud case will be resolved before the capital case, either by plea or trial, and that she would be treated fairly by the judge, as she has no priors.

The judge said he would likely rule on all three of the motions later Friday or early next week.

Friday’s proceedings may have been especially hard for the Anthony family, as it marked the one-year anniversary of the day little Caylee’s body was found.

An Orange County utility worker discovered a child's remains among vines and twigs about two blocks from the home on Hopespring Drive where Caylee lived with her mother and grandparents.

"The bottom line is real simple, folks," Sheriff Kevin Beary said. "We recovered this human skull. It appears to be that of a small child. Now the investigation continues."

I was away, and we installed a new way of doing the blog yesterday afternoon.

I didn’t see much — I had access to HLN and Fox News Channel, and that’s all. HLN played up Anthony’s tears in court and the questions to Jose Baez outside the court. I think I heard WESH-Channel 2’s Bob Kealing and WFTV-Channel 9’s Kathi Belich pose questions. I was waiting for Nancy Grace to say more, but she turned her attention to Tiger Woods.

So in the instant case, even if Dominic Casey had privileged information that belonged to George and Cindy Anthony, the State could offer use immunity that would allow them to pierce the privilege and ascertain what he knows. If he divulged something that could get him, George, or Cindy into trouble, he (and presumably they, not quite sure) would be immune from prosecution based upon discovery of this information.

Before I go any further though, a lot of people have asked why Judge Strickland did not rule right away – and here are my thoughts.

Because it allows the attorneys who argued the (likely) losing side to save face during the hearing and break the bad news to their clients in private (Casey, we almost convinced him otherwise he would not have waited to rule – next time).

Reading Between the Lines
So reading between the lines, it seems clear how he will rule on the motion (and how meritorious he thinks it is) – MOTION DENIED (I bet he even cites State v. Sholl).

The Real Issue is Punishment

Now Why Did He Do This?

The Reality Check
The most interesting part of the hearing to the lay person was obviously the remarks given by Jeff Ashton in his rebuttal to Ms. Lyon’s argument to preclude the death penalty..

But aside from his legal argument, which he could have rested on – he then went onto give the proverbial b**** slap to the defense and provided a much needed reality check as to how serious the state is about prosecuting Casey Anthony – and how strong they think their case is.
