Defense Seeks Texas EquuSearch Records

Judge Stan Strickland scheduled a hearing for Monday morning.

Her defense team wrote in its request to the judge that the team found volunteers who weren't on the list of 32 and did search the spot Caylee's bones were found but noticed nothing unusual. The defense now wants access to all of EquuSearch's records.

Casey&#8217;s lawyers maintain Texas EquuSearch volunteers searched the exact location where Caylee&#8217;s remains were found, but came up empty. But EquuSearch says they searched near the area and said Caylee's remains were found was under water.

Casey Anthony will head back to court next Monday.

This is part of the legal battle going on since November concerning Texas EquuSearch.

They're asking the judge for all of the names of EquuSearch volunteers and all the documents in possession of the group.

The hearing is set for 10 a.m. Monday. We'll have in-depth coverage on News 13 and CFNews13.com.

WHY I AM SHARING THIS
I debated whether or not to release the information I am about to share with you in this blog. I decided to do so because I believe that it is essential that the public should know everything related to the Casey Anthony Case and anyone that has any association with it.

George Anthony&#8217;s alleged mistress, River Cruise called me up two days ago to thank me for writing the blog I did where I discussed how her body language and her voice and speech content appeared to credible to me.

Because I am not River Cruz&#8217; licensed therapist, psychologist, psychiatrist, or any one else&#8217;s for that matter, and have never met or treated River, I am not bound by any confidentiality. So there is no issue here.

But as a voice and body language expert and a media personality, I am bound by the truth. I have no special interest or agenda as to why I support her statement, other than to state that based on my years of experience as a body language, voice and speech analyst, it seems to me that she was and is telling the truth. The circumstances of how she revealed the information also adds to her credibility in my view. She didn&#8217;t seek it out. Instead, she was sought out by law enforcement, so she felt compelled to come forward with all that she allegedly knew.

I also wanted to let the public know about the devastating effects of what can happen when people are suddenly thrust into the limelight unprepared and having to fend for themselves. Listening to and reading all of the hostile feedback can be devastating as River discovered and wrote on her twitter page.


A PHONE CALL TO ME FROM RIVER CRUZ
My phone conversation with River validated that she was indeed credible and had nothing to hide. I found her to be a very warm and sensitive person who was in a lot of pain over the public&#8217;s skepticism.

She then mentioned to me that she didn&#8217;t want to live and began to cry. I told her that she had a lot to live for and that the truth would prevail. River had nothing to gain by coming forth. In fact she chose to take this information to her grave. It was only when law enforcement contacted her that she reveal the information she was told by George.

She has not been gallivanting around in the press since she gave that initial interview, which is further indication that she isn&#8217;t out to make a quick buck off of Caylee&#8217;s death. After my conversation with her I found her to be a very lovely and sensitive woman and I am even more convinced that she was telling the truth.

I continue to pray for River. Maybe this suicide attempt is a blessing in disguise. Maybe it afforded her the help she desperately needed including possible medication to help her cope with this trying situation.

On Monday (10am), Casey Anthony will ask a judge to give her more information about the 4,000 volunteers from Texas Equusearch, the group that helped look for Caylee.

Last year, a judge ordered the company turn over personal contact information for only 32 of the volunteers since they had been the only ones in the Suburban Drive area where Caylee Anthony's body was found.

Organizers with Texas Equusearch said none of their volunteers were ever in the exact spot were Caylee Anthony's body was found by the meter reader, and added that Anthony's attorneys could visit their lawyer's office at any time to inspect the records.

Yet, as of a few weeks ago, the defense had never made a trip across town to look at the records they are now seeking.

Casey Anthony to return to court Monday

Casey Anthony's defense team will be in court Monday for a hearing over documents related to the search for Caylee. The defense wants to know more about Equusearch.

There have also been questions as to whether or not the wooded area along suburban drive where little Caylee's remains were found had been thoroughly searched.

Investigators now have their answer. No. Under oath, at least four different Equusearch volunteers say the area was underwater, preventing them from going back there. Those volunteers indicate they'd gone back several times to look for Caylee, but could not because of the high water levels.

WFTV found out the jail guard who allegedly helped Casey Anthony write an inmate pen pal in jail is now on suspension. Jail guard Silvia Hernandez is still being paid while the investigation plays out.

Also, there's another problem. Both Casey and Robyn were in protective custody at the jail when the letters were exchanged, which means they were not to have any contact or communication with one another. Hernandez is now under suspension with pay while the jail investigates whether she passed the letters from Casey to Robyn, as Robyn told investigators.

Hernandez was assigned to Dorm L as soon as she was hired and worked there for about a year before being transferred. Hernandez worked for the state prison system in Lake County before going to work at the jail. She's been disciplined for absences and tardiness, and once for not reporting her use of force to break up a fight between two inmates. She has also been praised for her writing skills and documentation, but she apparently did not document that she helped Casey write letters to Robyn.

The jail investigation could take another two weeks. Casey remains in Dorm L, but Robyn is now in federal prison.

The defense has until Friday to decide whether to ask the judge to seal Casey's letters from the public. The judge has already said he's not inclined to seal them.

UPDATED: Corrections officer connected to Casey Anthony case suspended

An Orange County Corrections officer who recently was suspended is the same officer whose name surfaced in connection with the Casey Anthony case.

Corrections employee Silvia Hernandez was suspended March 22, although an Orange County Jail spokesman declined to give the reasons for the discipline.

In March, Hernandez was interviewed as part of the Anthony case, according to documents released by the Orange-Osceola State Attorney's Office.

A judge banned the release of the letters until at least next week to give her defense attorneys time to review them and prepare any objection to making them public.

The Orange County Department of Corrections said it suspended officer Silvia Hernandez on Wednesday with pay because Hernandez is accused of passing letters between Casey Anthony and another inmate.

The department said it will conduct a thorough investigation into allegations of Hernandez's inappropriate behavior.

A representative for the Orange County Department of Corrections said the letters were a a violation of security protocol. Any corrections officer who facilitated the correspondence could face punishment, as well as Anthony herself.

Prosectors alleged Anthony was somehow able to exchange the letters with Robyn Adam, who is being referred to by Anthony's defense team as a "jailhouse snitch." According to court documents there are 258 pages believed to be handwritten by Anthony.

The Orange County correctional officer questioned about the passing of notes between accused child killer Casey Anthony and another inmate has been suspended with pay, pending an internal investigation.

Silvia Hernandez was among several officers responsible for the dormitory where Anthony and now-convicted drug dealer Robyn Adams were housed when more than 50 notes totalling some 258 pages were passed from Anthony to Adams, according to jail and court records.

The contents of the notes remain sealed, while Anthony's attorneys decide whether to ask Judge Stan Strickland to keep any portion of them exempt from release to the public.

“But Casey needed help to getting her letters to Robyn because both of them were in protective custody,” Belich added. “Robyn told murder investigators that jail guard Silvia Hernandez delivered Casey’s letters to her.”

Belich said the public soon should know the letters’ contents, because a judge has suggested he won’t seal them.

Jail officer in Anthony case relieved of duty

Silvia Hernandez received a letter from the Orange County Corrections Chief almost two weeks ago. It states that she is under investigation for inappropriate behavior.

Officer Hernandez has been relieved from her duty, with pay and is being administratively transferred to a day shift. Although the reasons have not been released, we do know that she had been assigned to the female detention center before being moved to booking and release.

Hernandez has been employed by the Department of Corrections since January of 2008.

Casey Anthony&#8217;s defense team wants more Texas EquuSearch&#8217;s records.

A lawyer for the volunteer group that helped search for Casey Anthony's daughter, Caylee, will be in court Monday for a hearing about access to its records.

In a written response filed in court today, Texas EquuSearch's attorney, Mark NeJame, wrote that the defense team never came to his office to review the files on the 32 people. In October, NeJame's office had the records hand delivered the material to the defense team, he said.

NeJame also disagrees with the defense that there were volunteers who searched the exact area. However, if the defense identifies some, Texas EquuSearch can show Strickland the documents on those searchers behind closed doors to determine if the material should be released.

The hearing is at 10 a.m. Monday.

The search group that volunteered to look for Caylee Anthony has picked a fight in court.

Mark NeJame, representing Texas EquuSearch, said he opened his doors for the defense representing Caylee&#8217;s mother, Casey Anthony, to come look through all the names of the organization&#8217;s volunteers, but they never showed up to seek the documents.

EquuSearch said should the defense want to question any other volunteers, there should be a private meeting with the judge, and he should decide.

A motion filed Friday by NeJame&#8217;s law firm said Casey Anthony&#8217;s defense &#8220;is unneccessarily wasting this Honorable Court&#8217;s time, the taxpayer&#8217;s money and the undersigned&#8217;s resources by filing these frivolous motions.&#8221;

Casey&#8217;s Defense Accused Of Wasting Tax Money

Texas EquuSearch accused Casey Anthony&#8217;s defense team of wasting tax money and wants her to pay the volunteer group's legal fees for having to handle what it calls frivolous defense motions. EquuSearch says the defense never reviewed records it requested on the 4,000 people who helped search for Caylee Anthony.

Also, in court papers released Thursday, EquuSearch says, if Casey's lawyers had reviewed those records, they would know whether or not what they're looking for exists instead of having to file more motions. Taxpayers are now paying Casey's defense costs.

In the meantime, Friday is the defense's deadline if it wants to ask the judge to seal 50 letters Casey wrote to another Orange County inmate. Investigators say the letters are incriminating and the judge has said he'll probably release them.

Casey Anthony: WESH explains how guard helped inmates exchange letters

A jail guard felt sorry for Casey Anthony and another inmate at Orange County Jail and helped the two exchange letters, WESH-Channel 2 reported tonight.

Guard Silvia Hernandez befriended inmate Robyn Adams and helped Adams communicate with Anthony through a small vent and hide letters in a common area, WESH&#8217;s Bob Kealing said.

A deadline is nearing for Casey Anthony's defense team to appeal the release of more than 250 pages of secret notes and letters exchanged with another inmate.

A 15-day deadline imposed by Judge Stan Strickland will pass on Sunday, a source close to the investigation said.

A court hearing is scheduled in the investigation on Monday to discuss the release of records relating to searches performed by Texas EquuSearch.
