Chief Judge Belvin Perry rejected a motion on Tuesday to keep Casey Anthony's jail visit records confidential.

Prosecutors said confidentiality would amount to special treatment for Anthony, and if the motion were granted, dozens of other inmates would be entitled to the same treatment.

Meanwhile, a hearing in the Anthony case slated for June 17 was rescheduled to July 15 at 2 p.m. A status conference remains scheduled for June 21, but Anthony is not expected to attend.

In orders signed on Tuesday, Perry:
&#8226;Denied Anthony's request that prosecutors turn over a secretly recorded tape made by Joe Jordan while he was interviewed by a defense investigator in October.
&#8226; Denied a new request to produce a transcript of George Anthony's grand jury testimony from October 2008. "Parties seeking disclosure must make a strong showing of a particularized need in order to outweigh the public interests in the secrecy of the grand jury proceeding," Perry stated in his ruling. "Reported inconsistencies as to testimony is not enough."
&#8226;Granted Anthony's motion that the defense team not be required to pay up front the costs of compiling and copying some 5,000 tips collected by the Orange County Sheriff's Office.

In earlier orders signed on Monday, Perry:
&#8226;Ruled that Anthony's wish to keep confidential her visitors at the Orange County Jail "in a high profile case does not qualify as a lawful exemption." Further, there is no exemption in state law that allows the court the seal such public records.
&#8226;Declined to strike prosecutors' filing of its notice of aggravating circumstances &#8212; reasons why it will seek the death penalty. Anthony's attorneys had argued that the state "merely filed a list of factors on which it may rely, failed to serve the defense with notice, and failed to provide any indication of the evidence it would use to prove the existence of those factors.
&#8226;And ruled that prosecutors do not have to provide some forensic evidence from Oak Ridge Laboratories. However, Perry said the defense could re-file a similar motion as long as it has a narrower focus.

Overall, Monday wasn&#8217;t a good for the defense. Bell added, &#8220;The judge also shot down other motions from the defense regarding the death penalty and forensic evidence.&#8221;

Casey Anthony case: Prosecutors argue jury should hear 911 calls

Prosecutors in the Casey Anthony case filed a document Wednesday laying out arguments for letting jurors hear 911 calls made at the very start of the child murder case in July 2008.

Anthony's legal team has argued that dozens of statements made by her friends and family amount to hearsay and should be kept out at her trial scheduled for next year.

But in Monday's nine-page filing, Assistant State Attorney Linda Drane Burdick argues that the 911 calls made by Cindy Anthony, the defendant's mother, should be heard. The prosecutor contends that the calls help show the progression of stories Casey Anthony told to explain the disappearance of her daughter Caylee Marie.

Just days after Judge Belvin Perry denied a series of motions filed by the defense, Casey and her attorneys face the possibility that more incriminating material could be allowed in her murder trial.

It&#8217;s just the latest blow to Casey&#8217;s defense as they try to keep what they said they consider hearsay out of court.

Prosecutors Wednesday filed documents laying out their arguments for why the jury should be able to hear 911 calls made by Casey&#8217;s mother, Cindy Anthony, in July 2008.

A frantic Cindy Anthony is heard on the 911 call saying, "It smells like there's a dead body in the damn car." Prosecutors want the call heard in court and said the calls could be a key piece of evidence in Anthony's trial.

Anthony's defense team has also filed documents claiming that the 911 call, and other evidence, should not be used during the trial. Defense attorney's said the call is heresy and should not be heard in court.

The calls were placed on July 15, 2008 when Cindy Anthony finally located her daughter, Casey, and found out her granddaughter was missing.

"There's something wrong," Cindy Anthony said in the call. "I found my daughter's car today, and it smells like there's been a dead body in the car."

The defense argues the calls are hear-say, but a motion filed Wednesday by prosecutors says they can be used to show Casey made up the nanny kidnapping story.

"She's been my nanny for a year and a half, almost two years," Casey says to the operator.

Could 911 calls placed by Cindy Anthony in the early days of her granddaughter's disappearance be significant in the proving the guilt or innocence of Casey Anthony? Prosecutors in Casey Anthony's murder trial believe they are and have filed a motion that would allow jurors to hear three of the calls placed in July 2008.

The calls were all placed on July 15, approximately one month after Casey Anthony said her daughter was kidnapped by a babysitter. In the first call, Casey's mother, Cindy, calls to report that Casey has stolen a car and money and hints at first signs of Caylee's disappearance.

Prosecutors in the case against Casey Anthony say that 911 calls made by Casey&#8217;s mother, Cindy, should be heard during her murder trial. "There's something wrong. I found my daughter's car today and it smells like there's been a dead body in the damn car," Cindy Anthony said in the 911 call.

Prosecutors filed a motion Wednesday to include the calls, saying they help show the progression of stories Casey Anthony told to explain the disappearance of her daughter Caylee. But the defense team says the calls should be excluded because they're "testimonial."

Chief Judge Belvin Perry says he will decide on the issue later on in the case.

The hearing originally scheduled for June 17 has been rescheduled for July 15 at 2:00pm. Also, a status hearing is scheduled for June 21 at 1:30pm. Casey will not be attending the status hearing.

Prosecutors were questioning the lead investigator in the case against Casey Anthony at a deposition Friday.

Orange County Sheriff's Office Sergeant John Allen has been on the case since Caylee Anthony disappeared. His deposition is just one of dozens in recent weeks.

WFTV reported last week when Casey's defense team deposed several prosecution witnesses, including a neighbor who let Casey borrow his shovel just days after Caylee disappeared.

Casey Anthony defense again argues against death penalty aggravators

Attorneys for Casey Anthony submitted three new arguments against reasons that would be used to secure a death sentence in the child murder case.

One speaks about a capital felony &#8212; the murder &#8212; being committed while Anthony engaged in another felony, in this case aggravated child abuse. The defense argues that when examining if an aggravator might be overbroad, "the Court looks to whether there is a risk that the statute will result in capricious or arbitrary imposition of death."

The second circumstance questions whether 2-year-old Caylee Marie Anthony's death "especially heinous, atrocious or cruel," as defined in Florida's death penalty statute. The defense says prosecutors have not cited case law that "substantively address the constitutionality of the aggravator itself."

The third aggravator involves the capital felony, whether it was a homicide and "committed in a cold, calculated and premeditated manner without any pretense of moral or legal justification," as defined in the statute. The defense cites case law brought up in an earlier filing and argues that the cases "illustrate that the constitutionality of the cold, calculated and premeditated aggravator has not been resolved &#8211; as the state argues&#8230;"

Window For Anthony Civil Trial Set
Anthony Being Sued For Defamation Of Character

Judge Jose Rodriguez has set a three-week trail docket beginning Aug. 29, 2011, in the civil case against Casey Anthony.

The move means the trial will begin sometime from late August until mid-September of next year, which would be shortly after the conclusion of Anthony's murder trial, if it proceeds as scheduled on May 9, 2011. The civil trial is expected to last five days.

Rodriguez referred the case to mediation, which must be completed before pretrial hearings.
