Baez Faces Foreclosure On Home
Casey Anthony's Attorney Faces Financial Problems

POSTED: 3:14 pm EDT July 28, 2010
UPDATED: 11:21 pm EDT July 28, 2010

The financial fallout from the case against Casey Anthony could cost lead defense attorney Jose Baez his home.

Foreclosure documents indicated Baez owes more than $650,000 to creditors. Baez said he blames his foreclosure on the real estate downturn.

Baez purchased his lakefront home three years ago for $670,000. On Wednesday, he admitted it's only worth about half of that amount.

In a foreclosure complaint, Baez's creditor, U.S. Bank, claimed, "the installment, which became due on the note and mortgage on Sept. 1, 2009, and each payment thereafter have not been paid."

Casey's Parents Save Home From Foreclosure
Posted: 5:44 pm EDT July 28, 2010

<snipped>
Casey Anthony's parents saved their home from foreclosure Wednesday and it only took them a few months to obtain the same loan modification that other homeowners have pursued for years. The Anthonys’ attorney said he thinks it’s because both parties wanted to keep the case out of court; if it went to court, it would have created a media frenzy.

For the past couple of months, people who live near the Anthony family thought their neighbors were going to move, but last month a new deal was made and now the Anthonys are going to be able to keep their home. Bank of America modified their loan. “This foreclosure was one of the fastest ones I handled,” Attorney Mark Lippman told WFTV. Lippman, who represents the Anthonys, said it only took four months to settle the issue. They qualified for the federal program called Making Homes Affordable.

Bank of America started the foreclosure process in February. Documents show the Anthonys bought the home for almost $91,000 in 1991, but now owe more than $115,000. Cindy is on disability and George lost his job. Lipton would not tell WFTV the amount of the new mortgage payment, but said it is 31 percent of their anticipated income.

BAEZ WANTS PARTS OF JAIL CALLS REDACTED
Casey’s lawyer, Jose Baez, is trying to get portions redacted from some recorded jail phone calls. An inmate told Baez that two other inmates, including Casey’s jail pen-pal, made up lies about her. But Baez says he can't remember being warned that their conversation was recorded. He's expected to ask a judge to at least edit out his comments before releasing the calls.

CASEY'S EX-FIANCE, KRONK TO BE QUESTIONED
Friday, Casey's ex-fiance Jesse Grund and his father will be questioned by defense lawyers. A paternity test proved Caylee was not Grund's child, but at one point Casey allegedly told her parents she didn't trust Grund and her parents asked detectives to investigate him as a suspect.

Also, Roy Kronk, the former meter reader who found Caylee's remains, will return for more questions. Kronk was also once talked about as a suspect.

Casey Anthony: Does Jose Baez’s foreclosure problem matter to Casey Anthony case?
July 28th, 2010 by halboedeker
<snipped>
“My personal affairs are just that — personal,” Anthony defense attorney Baez said in a text message to WESH.

He may have a point: Don’t his lawyering skills matter more? What do you think?

WESH’s Bob Kealing reported that Baez is in danger of losing his Kissimmee home and that a foreclosure document shows that he owes $655,000. Creditor U.S. Bank claims Baez hasn’t paid the mortgage since Sept. 1, 2009, Kealing reported — a startling detail.

Baez said the foreclosure won’t affect his representation of Anthony, Kealing said.

Casey Anthony Meets With Psychologist
POSTED: Wednesday, July 28, 2010

A psychologist who specializes in traumatic events has been visiting Anthony in the Orange County Jail.

Defense attorney Jose Baez said attorneys must explore potential mental health issues in any death penalty case. Other than members of her defense team, Anthony has had few outside visitors since she was put back in jail for the final time in October 2008, but earlier this week Anthony met with Dr. Steven Gold.

Gold is a psychologist with Nova Southeastern University in Fort Lauderdale. "Dr. Gold specializes in research, treatment of and training in psychological trauma and trauma-related disorders, disassociation, hypnosis and sexual addiction-compulsivity," Gold's website said.

Gold has written books about child abuse as well as the trauma endured by survivors of the Sept. 11 attacks.

The Osceola County home of Casey Anthony attorney Jose Baez is in foreclosure proceedings in court, the now well-known defense attorney confirmed this afternoon.

Osceola County Clerk of Courts online records also confirmed the foreclosure case, listing it as a foreclosure involving $250,001 or more. The foreclosure complaint was filed May 12, according to the online records.

When asked about the foreclosure case, Baez said, "I think it's personal."

"It has nothing to do with my case, my business and anything that has to do with Casey Anthony," he said. "I'll probably keep the house, even though it's worth half of what I owe."

It appears Casey Anthony's jail account is back in the black, as her mother deposited $140 on Wednesday.

A money order dated Tuesday has replenished her account, which dipped into red ink recently. A copy of the $140 money order released Wednesday shows it was purchased by Anthony's mother, Cindy Anthony.

Orange County Jail spokesman Allen Moore said in an email that Casey Anthony's account balance Wednesday was $94.49.

Jose Baez May Lose $670K Kissimmee Home
Posted: 11:49 am EDT July 29, 2010
Updated: 11:52 am EDT July 30, 2010
<snipped>
The case against Casey Anthony could be taking a financial toll on her lead defense attorney, Jose Baez. Court records show Jose Baez's house, which he bought for $670,000, is in foreclosure. His top client, Casey Anthony, hasn't been able to pay him in months, but taxpayers are funding Casey's defense.

Baez and his wife live less than one mile inside the gates of Kissimmee Bay, which is a country club community in Osceola County. It's a private community and it's close to his office, but now he could lose it. Defense attorney Jose Baez borrowed $603,000 three years ago, to buy the $670,000 house. The home has a screened-in pool and a fireplace. His monthly mortgage payment is $4,500.

The problem is court records show he hasn't made a payment for about one year, since August 2009. But that didn't stop him from skipping his client Casey Anthony's hearing on June 21 because of his vacation in Paris, according to his co-counsel. Even though the ABC Network paid Casey more than $200,000 for all of her photos and videos of Caylee, Baez said the fee he was paid for handling her check fraud and murder cases was less than $90,000.

CASEY VISITED BY DOCTOR
Casey's had few outside visitors besides her defense team, until last Friday. Dr. Steven Gold specializes in psychological trauma, dissociation, hypnosis and sex addiction at Nova University in Fort Lauderdale. He met with Casey for nearly four hours.

Jail records show Casey bought medication three times since mid-May and visited with the nurse twice. Her jail account is no longer overdrawn, thanks to a $140 check her parents deposited Wednesday.

Attorney: Kronk Ready To Testify In Casey Case
Defense Points To Kronk As Possible Suspect

POSTED: 4:49 pm EDT July 29, 2010
UPDATED: 5:08 pm EDT July 29, 2010

An attorney for former meter reader Roy Kronk said his client is ready to testify Friday under oath and take questions from Anthony's defense team.

After Kronk's first session, Anthony’s defense filed paperwork suggesting the man who found Caylee's Anthony's remains should have been investigated as a suspect.

An Orlando criminal defense attorney said Friday is the day Anthony’s defense team can solidify their theory that Kronk is someone they could point the finger at in Casey's trial.

“Either he's the guy, or he's not the guy,” criminal defense attorney Richard Hornsby said.

The defense team filed court papers, saying Roy Kronk should have been investigated more thoroughly.

Kronk’s attorney, David Evans, said he is anxious for his client to get it done. Evans said Kronk is still living in Orange County, but he has not been working, and has stopped volunteering with dishonorably discharged veterans. He also added that his client has been following the case against Casey Anthony closely.

Attorney: New Law Prevents Baez From Stepping Down
POSTED: 5:21 pm EDT July 29, 2010
UPDATED: 5:40 pm EDT July 29, 2010

Attorney Jose Baez insists the foreclosure on his Kissimmee home will not affect his defense of Casey Anthony. Baez said he has no desire to leave the capital case despite financial trouble.

Legal experts said they doubt Baez would even be allowed to withdraw from the case.

An amendment went into effect this month in Florida that bans judges from appointing attorneys where an indigent client has already retained and paid a lawyer. Experts said the idea is to prevent a private attorney from pulling out once a client’s money runs out.

Casey Anthony: WESH explains why Jose Baez is here to stay
posted by halboedeker on July, 29 2010 6:17 PM
<snipped>
WESH-Ch. 2 headlined its Baez story “Foreclosure Fallout,” a follow-up on the station’s Wednesday report about Baez facing foreclosure on his Kissimmee home.

But the main point of Bob Kealing’s reporting tonight was that Baez can’t withdraw as the attorney for Casey Anthony. She is charged with first-degree murder in the death of her daughter, Caylee. “I would be shocked if Judge [Belvin] Perry let anybody withdraw now,” criminal defense attorney Jeff Deen said in offering analysis for WESH.

Kealing and Deen pointed to new law passed in reaction to the Anthony case. The law aims to prevent a private attorney from leaving a case when a client becomes indigent.

Deen explained: “If you start out with a private lawyer and you pay that lawyer, and then you go to the court and ask that the state pay your costs, if that lawyer now tries to withdraw, it’s not permitted by statute anymore that the person would get a state-appointed lawyer.” The law went into effect July 1, meaning that Baez’s window for getting out had closed. Kealing said that Baez had not responded to requests for comment.

Anthony Defense Questions Roy Kronk
Anthony's Attorneys Suggest Kronk May Have Kidnapped, Killed Toddler

POSTED: Thursday, July 29, 2010
UPDATED: 12:25 pm EDT July 30, 2010
<snipped>
Local 6 has learned of another discovery that Kronk made years earlier in Tennessee that could impact the Anthony case. Anthony’s defense team has suggested that Kronk may have kidnapped and killed Anthony's daughter, Caylee. Anthony is charged with first-degree murder in Caylee's death.

Local 6 has obtained a police report from Tennessee that sources said may be used by the Anthony’s defense team to attack Kronk’s credibility.

Now, Local 6 has learned that 11 years earlier Kronk called authorities to another wooded area in Tennessee, but that once again officers who responded to that scene were unable to find what Kronk had been describing.

According to a 1997 report from Kingsport, Tenn., Kronk told investigators they would find several stolen guns and other stolen items in a wooded field. But when officers searched the field, they were unable to find any of the items Kronk was talking about. According to sources, Casey Anthony’s defense team found it odd that Kronk would call police twice to two different wooded areas where nothing was found.

Kronk opened up to the media for the first time on Friday.

Roy Kronk Questioned By Casey's Defense Team
Posted: 8:44 am EDT July 30, 2010
Updated: 6:23 pm EDT July 30, 2010
<snipped>
Roy Kronk is a key prosecution witness and the defense wants to discredit him. The defense is trying to make connections between the duct tape that was found layered over Caylee's face and the man who found her. But Kronk said the defense’s theory doesn't make sense. Roy Kronk has faced rumor and ridicule since he found Caylee Marie Anthony.

Investigators say her mother, Casey Anthony, dumped her body in the woods near her house hoping she'd never be found.

Still, Kronk said he'd do it again. “Doing the right thing is its own reward,” Kronk told WFTV.

The defense canceled Friday’s depositions of Casey's ex-fiance Jesse Grund and his father, but has rescheduled them for August 11.

The defense has also scheduled depositions with seven investigators from the sheriff's and medical examiner's offices for August and September.

Kronk's attorney called some allegations against his client "ridiculous" and said it "doesn't take much preparation to tell the truth."

An Orlando criminal defense attorney said the deposition will give Anthony’s defense team the chance to solidify their theory that Kronk is someone they could point the finger at in Casey's trial. “Either he's the guy, or he's not the guy,” criminal defense attorney Richard Hornsby said.

Hornsby said Anthony's defense team can gain valuable information against Roy Kronk, but they still have to commit fully to the theory that Kronk was behind Caylee Anthony's disappearance.

“The state has a solid theory it's Casey Anthony. The defense does not have a solid theory if they're just kind of pointing at Roy Kronk and saying he wasn't investigated enough,” Hornsby said. “You can't have it both ways.”

Meter reader who found Caylee's remains deposed in Casey Anthony case
5:46 p.m. EDT, July 30, 2010
<snipped>
The attorney representing Roy Kronk, the former meter reader who found Caylee Marie Anthony's remains in late 2008, said his client answered "truthfully and honestly" during the second part of a deposition held Friday. "It's been hard on Roy to be made out to be a target of this activity, to make him out to be a villain when all he did was find Caylee's remains and report it to law enforcement," said attorney David Evans.

"In the two days we examined him, we learned a great deal about Mr. Kronk and his actions," Baez said. Baez said the defense team's questioning of Kronk is consistent with a strategy of "leaving no stone unturned." "If law enforcement had done its job thoroughly, there wouldn't be any questions," he said. But Baez would not explain specifically how Kronk's statements Friday and during the first part of his deposition last November will help the defense. "That's something you're going to have to wait until trial to find out," he said.

Evans, meanwhile, said he provided prosecutors with receipts proving that Kronk had car problems on the day before he found Caylee's remains to dispel any suspicions about why he took that day off from work.

Casey's lawyers depose Kronk again

The man who found Caylee Anthony's remains says despite all he's been through, he'd do it all over again if he had to. But Roy Kronk said not all things are looking good for the former Orange County meter reader. He said he just wants his life back.

On Friday, after the second round of questioning by Casey Anthony's defense, Kronk maintains he was using the restroom when he found Caylee's remains.

For the first time, Kronk's responding to allegations he's abused his wife, and told family members before he discovered the remains, he was going to be on TV. "Of anybody involved in this mess, he's going to be one guy who's going to come out with his reputation intact and his dignity intact," said David Evans, Kronk’s attorney.

However, Kronk said his name and reputation have been pulled through the mud. "It’s been very difficult for me,” Kronk said. “That's all I'll say. There's been some horrible things said about me. Said I was a child predator, child molester, all this other stuff and some people believe it."

Former meter reader Roy Kronk is being deposed today in the Casey Anthony case.

But Anthony attorney Jose Baez took time to weigh in on coverage that his Kissimmee home is in foreclosure. WESH-Ch. 2’s Bob Kealing said Baez “joked” about the reporting, but Baez sure didn’t seem like he was joking.

A spokeswoman for the State Attorney's office said she hopes to make public more information in the case against Casey Anthony this week.

Meanwhile, court records show the latest evidence to be turned over to her defense by prosecutors is a DVD of an interview given by Casey's mother, Cindy Anthony.

The interview is with the Orange County investigators on July 31, 2008. It is unclear why the interview, now two years old, is being made available at this time.
