O’Mara questioned why former defense attorney Linda Kenney Baden described former client Anthony as a liar. “I guess she’s enjoying her time on camera, but she’s doing it at the expense of a client and and I think her own ethical obligations,” O’Mara said of Kenney Baden.


The discussion came around to whether this is a death-penalty case. Rowe showed footage of Attorney General Bondi telling “48 Hours Mystery”: “This isn’t ‘CSI.’ This is real life. … These are very good prosecutors. They are going to establish a timeline that no one else could have murdered little Caylee but her mother.”

O’Mara said, “I don’t see the type of normally compelling aggravating circumstances in this case that would justify a death-penalty request.”

Pipitone asked, “Can you really prove beyond a reasonable doubt that this was cold, calculated and premeditated … when you don’t even know how the child died?”

What do you think?

Pipitone predicted that there would be no trouble, despite the heavy press coverage, in seating a jury in a week.

O’Mara cited West Palm Beach as a good place to find the jurors.

Casey Anthony: How Orlando is preparing for a 'trial event'

ORLANDO -- When Casey Anthony goes to trial in May, it will be more than just another court case. It will be an event, and the city of Orlando said it's planning accordingly.

"We have 'events' like this all the time," said city spokesman Heather Fagan.

So does the same planning that goes into, say, the NBA All-Star Game next year go into Casey Anthony trial?

According to Fagan, "The only difference is the length of time."

Officials from a variety of city and county departments met Friday to talk logistics, including permits, parking and protesters.

ORLANDO -- There is a connection between the Casey Anthony case and the search for bodies at Charles Manson's last hideout.

The cold case investigation involves a deserted ranch in a remote area of California.

Scientists who examined that case are the same ones who studied the air samples from Anthony's car.

After we put in a public records request, it took almost three months and a county commission vote for News 13 to get a copy of these law enforcement sensitive reports prepared for authorities in California.

A cold case detective and a police dog K-9 handler wanted to know if there were more missing victims from the Manson era buried on a ranch near Death Valley.

So he contacted scientists at the Oak Ridge National Lab in Tennessee for their help.

(CNN) -- Baez pushed Friday to prohibit cameras at jury selection for Casey Anthony's upcoming trial -- judge said he would consider, but was not likely to support.

"There's a thing called the First Amendment.

The court's jury selection will be from an undisclosed area, that will not be revealed publicly until the morning that it begins. The jurors would be transported to OC for the trial.

Perry said that a single person each with the defense and prosecution teams would be told in advance where the proceedings would be, only so they can make logistical arrangements.

Baez, said he doubted that a jury could be seated promptly anywhere in Florida, given all the public attention.

"If the media is the culprit of the damage of us being able to seat a fair and impartial jury, I think what the logical choice to do would be to place some types of restrictions on the media," Baez said.

Jose Baez specifically urged Perry not to allow media to broadcast the proceedings.


Will the jury see photos of Casey Anthony dancing at the Fusion Ultra Lounge in Longwood, Florida?

"There is nothing in those photographs that relate to the (alleged) crime," Baez said. "They're completely irrelevant and highly prejudicial."

But prosecutors said that Anthony's actions in June and July, between when her daughter was last seen and when she was reported missing, are relevant in proving her guilt. Moreover, they claimed that the nightclub photos paint a picture contrary to what the suspect had told police about her demeanor in that period.

"During Ms. Anthony's conversations with police, she indicated that she was looking for her daughter," said Frank George, a member of the prosecution team.
Judge Perry denied the defense's plea and allowed the pictures to be submitted as evidence.

CBS News officials said they did not pay jury consultant Richard Gabriel to participate in the show, and he was not allowed to keep the nearly 500 hours of video showing panelists discussing the case.

CBS did allow Gabriel to share the detailed results from the focus group with Anthony's defense. That information includes the panel's reaction to Anthony's mother's 911 call reporting Caylee missing in July 2008, as well as to photos showing Anthony partying while Caylee was missing.

"Maybe she was afraid she would be accused of child abuse. I don't think she meant to kill," a panelist said.

CBS affiliate WKMG-Channel 6 last night took a behind-the-scenes look at its network’s “48 Hours Mystery” on the Casey Anthony case. There was more troubling information about how journalists inserted themselves into the legal process. In effect, “48 Hours Mystery” was making news rather than reporting it.

He said that items that come in contact with chlorine, a common pool chemical, will test positive for bromine.

"You see the brominated compounds as well as the chloroform signature, so you see both. Whereas with the chloroform only, you would only see chloroform," he said.

Scientists at the Oak Ridge National Laboratory in Tennessee found the air in Anthony's trunk was saturated with vaporized chloroform.

"The level of concentration from a saturated source would be much higher than that from a trace quantity in a bathing suit," said Flowers.

Veteran attorney Jeff Deen said the state's case for premeditation hinges on the chloroform.

"If those issues of chloroform weren't there, there would be real problem showing any kind of overact to kill that child," said Deen.

The judge is expected to rule this week on whether prosecutors can use air tests performed, whether the jury will hear evidence that cadaver dogs alerted on Casey's trunk and her back yard.

ORLANDO -- TES volunteers could play a big role in the upcoming Casey Anthony murder trial.


Casey's defense team combed through documents, looking for all the volunteers they could find who searched in the area Caylee's remains were found in.

In each of the five depositions, attorneys ask the former volunteer searcher to identify exactly where they searched on Suburban Drive.

William Breiling, was in the area where the remains were found.

Here's what he told prosecutor Linda Burdick:

Breiling: "That whole area was submerged underwater. I believe, you know, at that time we had a lot of rain."

Burdick: "All right. So correct me if I'm wrong, but it's your testimony, you didn't go into the tree line because within 10 feet of the tree line it was submerged?"

Breiling: "Yeah. I mean, it was just water in there."
Some other volunteers said they just looked into the woods, and one didn't even get out of the car.

About a year and a half later, while reviewing that video, Local 6 noticed a roll of duct tape lying on a table.

Jurors exposed to positive publicity tend to favor the defendant; negative coverage can lead to guilty verdicts.

From a judicial standpoint, it makes sense to create as much of a separation between the pretrial coverage and the jury pool.

Consider Ruva's work: She exposed mock jurors to articles about other criminal cases. Those articles were perceived as both negative and positive. Ruva then had the participants observe video of the actual trials. After viewing the videos, the mock jurors gave verdicts.

The research, she said, found the participants often experienced "source memory errors," in which they confused pre-trial information with the evidence presented at trial.

"Even when they're trying to be good jurors, they're probably not going to be able to do this," Ruva said. "If exposed to [pretrial publicity] they were angrier. It drives behavior. It drives opinion."

This may be a reason why Anthony's defense team cooperated with – and played a prominent role in — "48 Hours Mystery" on CBS.
