It was a week that began and ended with heartache.

As the families of two North County teenagers found some closure, the criminal justice system moved ahead in the prosecution of registered sex offender John Albert Gardner III and politicians began calling for investigations and new laws.

The deaths of Amber Dubois, 14, of Escondido and Chelsea King, 17, of Poway continued to draw national attention as their families planned memorial services.

Several thousand people attended a sunflower-filled memorial yesterday to celebrate the life of Chelsea,&#65279; who disappeared Feb. 25 while running in Rancho Bernardo Community Park. Her body was found five days later. Gardner, 30, of Lake Elsinore has pleaded not guilty to murder and rape.

Amber&#8217;s family began planning a similar service after police announced last Sunday &#65279;that her remains had been found the day before. Amber disappeared 13 months ago while walking to Escondido High School. Escondido police have said Gardner is a focus of the investigation.

Joining me to talk about the aftermath of these events are KPBS reporters Amita Sharma and Ana Tintocalis. And thank you both for joining us. So, Ana, what is the mood in the county over these deaths?

ANA TINTOCALIS (KPBS News): Well, I talked to a number of parents and obviously the loss of these two teenagers has touched everyone&#8217;s heart. Nationally in the world, and of course here in San Diego County. I think there is deep sadness, grief, just a deep sense of loss. And I think there's also disbelief. I heard a lot of parents say, &#8220;I can't believe this has happened in our community.&#8221; And I think that has led into this feeling of uneasiness. I think parents feel &#8211; the parents I talked to &#8211; feel like they have to rethink their own approach to child safety and neighborhood safety. I also get a sense of determination, like parents want to take back their neighborhoods. They want to get involved with helping legislation become more strict on sex offenders.

Documents in 2000 conviction reviewed

Documents in the case, reviewed by the experts, show that Dr. Matthew Carroll, a psychiatrist who had evaluated him, said Gardner lacked remorse and &#8220;would be a continued danger to underage girls in the community.&#8221;

&#8220;As far as slipping through the cracks, I do not believe this occurred here. In my opinion, this is a horrible situation. His previous event would not have cause for a harsher sentence in this jurisdiction than yours.

&#8220;Gardner completed his prison sentence and was released. I do not know the circumstances of the murder case, but it is not unusual for an offender to graduate from attempting to have sex (or simulating a sexual event) to actually performing it.

&#8220;There is actually no way to predict whether or not this person would have offended again. The criminal-justice system can take its best guess as far as future offending. But the system is constrained by the rights of the accused. In other words, he did his time, he did not perform an act that would qualify for a civil commitment, and was released.

&#8220;The Chelsea King case is a horrible event. But I do not think that any of the people involved in the 2000 case could have predicted that this would occur. The system is set up to keep jail/prison overcrowding low and keep the public safe at the same time. It doesn&#8217;t always work.&#8221;

Amber Dubois' Parents Want Answers

The mother of Escondido&#8217;s Amber Dubois wants answers from prosecutors &#8211; how did her daughter die, when did she die and did she suffer? Carrie McGonigle talked to CNN&#8217;s Larry King Tuesday about the status of her daughter&#8217;s case.Amber disappeared in February 2009 and her remains were found near the Pala Casino on March 6.

John Albert Gardner III, the man facing charges in the death and disappearance of Poway teenager Chelsea King, has been called the &#8220;focus&#8221; of the Amber Dubois investigation.

McGonigle said authorities aren't telling her anything about why they believe Gardner may be responsible for her daughter's death.
"They said, 'In time, you will find out,'" McGonigle said.

Dubois&#8217; mother said the family doesn&#8217;t even know how investigators got the information that led them to Amber&#8217;s body.

In 2006, Californian&#8217;s voted to pass Proposition 83, otherwise known as Jessica&#8217;s Law. Among other things Jessica&#8217;s Law mandates that, prior to release from prison, violent sex offenders who meet certain offense criteria be evaluated in person by two expert psychiatrists or psychologists. If the experts agree that the prisoner is a violent sexual predator with a high risk of reoffending the prisoner must be referred to the District Attorney for civil commitment proceedings.

Currently, California&#8217;s Department of Mental Health (DMH) Sex Offender Commitment Program managers are simply providing a cursory &#8216;paper screening&#8217; or record review of potential predators by one mental health professional in lieu of an expert panel in-person evaluation. This violation of California law has thus far dumped more than 17,000 potential sexual predators back into society.

In 2007, convicted rapist Gilton Petri was released as a result of a &#8216;paper screening&#8217; and within 4 days kidnapped, raped, and murdered 15-year old Alyssa Gomez. Petri is currently awaiting trial for Alyssa&#8217;s murder.

Are you as outraged as I am that California&#8217;s DMH is ignoring the law at the expense of public safety? If so, contact Attorney General Jerry Brown and demand that he take appropriate action now. For maximum effect call, fax, write and email him now. I have provided his contact information below.

REGION: Department of Corrections releases Gardner's central file

The state Department of Corrections and Rehabilitation on Wednesday released the central file for John Albert Gardner III, the registered sex offender accused of killing 17-year-old Chelsea King and suspect in the disappearance and death of 14-year-old Amber Dubois.

Department of Corrections spokesman Gordon Hinkle called the release "unprecedented," saying intense public interest in Gardner and his supervision after his release prompted the department to release the files.

"We wanted to be completely open," Hinkle said.

The California Public Records Act allows the state to keep much of an offender's central file confidential, and the Department of Corrections normally declines to disclose entire files, Hinkle said.

However, department officials believe the public interest in releasing Gardner's file outweighs the interest in withholding it, Hinkle said.

ESCONDIDO: Joggers, walkers to meet Saturday to Finish Chelsea's Run
Slain teen to be remembered by hundreds in Lake Hodges event

Chelsea King never got to finish her jog through the trails around Lake Hodges, but hundreds of runners are expected to finish it for her in a heartfelt memorial Saturday. "I never met Chelsea," said Rancho Penasquitos resident Tommy Sablan. "I never met Amber. But I love them both."

Sablan is not a runner, but as a father of two teenagers he was moved to action by the deaths of Amber Dubois and Chelsea. Along with friends Todd Velasquez and Dave Jewell, who are runners, Sablan organized the Saturday event and created the Facebook page Finish Chelsea's Run.

Participants are asked to meet in the parking lot of Westfield North County, 272 E. Via Rancho Parkway, to catch shuttles to Rancho Bernardo Community Park beginning at 7 a.m. A three-mile run/walk through the trails will begin at 9 a.m. Pets on leashes and children are welcome. "It's a statement that we're going to take this park back," Sablan said.

Chelsea went for an afternoon run Feb. 25 on the south shore of Lake Hodges at Rancho Bernardo Community Park and never returned. Her body was found in a shallow grave near Lake Hodges on March 2.


Jeff Garvik and his dog, Cody, walked along the trails of Lake Hodges the day after authorities recovered the body of Poway teen Chelsea King. "This was my and my dog's special hang out," Garvik said. "It will never be the same."

Calif. rape suspect lived by school for 16 months

A convicted sex offender charged with murdering a California teenager lived near a preschool for at least 16 months before parole agents forced him to move, according to state corrections records released Wednesday.

A regional administrator let John Albert Gardner III continue living within 126 yards of the San Diego County preschool until his lease expired in 2006, a top corrections official told The Associated Press. But no one noticed he was still living there until a year later.

Assistant Secretary Oscar Hidalgo said there was confusion in part because of a change in parole agents.

Parole and prison records released to the AP under a records request and made public Wednesday show Gardner was living little more than a football field's length from the preschool on the Miramar College campus after he was paroled from prison in 2005 after serving five years for molesting a 13-year-old girl. :furious:

A day after Amber Dubois' mother said in a national television interview that police were not giving her any information about her daughter's death, she got some answers.

Carrie McGonigle and Maurice Dubois, the parents of the Escondido teen whose remains were found earlier this month near the Pala Indian Reservation, said they spoke with law enforcement officials Wednesday.

"We had a conversation with them," Dubois said. "We have received answers to some of the questions that we had, and we are satisfied with the investigation at this point."

Dubois and McGonigle declined to comment further on what they learned.

Reached by phone Wednesday afternoon, McGonigle would only say that she spoke with law enforcement and that she was satisfied with the conversation she had.

Authorities have been tight-lipped about their investigation, saying that any comments they make could jeopardize their case

New John Gardner file sheds light on prison, parole time

The 282-page file sheds light on incidents involving Gardner during his prison sentence from September, 2000 to September, 2005 for lewd and lascivious acts with a minor under 14 and his subsequent parole and supervision.

In a document dated Sept. 13, 2007, the Division of Adult Parole Operations reports that Gardner was in violation of his parole by residing within a half mile of any private or public school from kindergarten through 12th grade (page 231).

The document states that Gardner&#8217;s Mira Mesa residence was within 125.5 yards of the child development center for ages 2-5 at Miramar College. The document goes on to state &#8220;also located in the surrounding area is Scrips (sic) High School 356.2 yards and San Diego County Regional Park (Hourglass Park) 478.8 yards.&#8221;

In response to the violation of his parole, the Department of Corrections and Rehabilitation ordered Gardner to be monitored via GPS from Sept. 25, 2007 through Sept. 26, 2008. (page 233). Gardner remains a suspect in the investigation in the death of 14-year-old Amber Dubois, who went missing Feb. 13, 2009. Dubois&#8217; remains were discovered in Pala on March 7. She disappeared Feb. 13, 2009, four months after Gardner&#8217;s GPS monitoring expired.

The preliminary hearing for Gardner is set for Aug. 4, 2010 and a gag order was signed in the case on March 9.

A 282-page document released in an &#8220;unprecedented&#8221; move by state officials reveals new details about Chelsea King&#8217;s accused killer.

John Gardner was kept in protective custody while in state prison and was disciplined several times for smoking but was also commended for his work as a teacher's assistant in a prison classroom, according to his central file.

The file on Chelsea King's accused killer assembled by state officials reveals Gardner had minor run-ins with prison guards, and at least one fight with another inmate.

The file contains Gardner's probation officer's report and documents hand written by Gardner in prison defending his actions when he got in trouble.

Gardner pleaded not guilty earlier this month to murdering 17-year-old Chelsea King, whose presumed body was found in a park near her hometown of Poway north of San Diego. He also is charged with assaulting a woman in the same park last year and is under investigation in the death of 14-year-old Amber Dubois in Escondido in early 2009.

Gardner is not due back in court until August.

State releases Gardner's prison file

John Albert Gardner III got into relatively minor trouble while in prison, primarily for smoking and ditching work, but he also excelled as a teaching assistant, according to records released Wednesday by state corrections officials.

The records show he was moved in and out of solitary confinement, had privileges taken away and restored, and was involved in at least one &#8220;mutual combat.&#8221; &#8220;I don&#8217;t even know this guy, but I don&#8217;t want to be near him,&#8221; Gardner is quoted as telling prison guards after a fight at Avenal State Prison in July 2005. The paper trail recounts Gardner&#8217;s time in custody and the three years he spent on parole following his release on Sept. 26, 2005.

Paul Sutton, a criminal justice professor at San Diego State University, said first-time convicts typically have a difficult time adjusting to the inmate hierarchy. &#8220;The first thing the shot-callers want to know is what are you in for,&#8221; Sutton said. &#8220;They don&#8217;t ask you; they want to see your paperwork. If you don&#8217;t provide your paperwork, they&#8217;re going to hit you.&#8221;

Child molesters are considered extremely vulnerable in general prison populations, Sutton said. So Gardner would typically have faced threats from other prisoners during the five years he was incarcerated. &#8220;When you come in as a sex offender, the guards don&#8217;t like you and the inmates don&#8217;t like you,&#8221; he said. &#8220;He may have gotten himself in trouble to get off the yard.&#8221;

Lance Corcoran, a spokesman for the union that represents California prison guards, said prisons have special rules for child molesters. &#8220;It&#8217;s no secret that child molestation is looked down on &#8212; not just by society but by the prison population,&#8221; he said. &#8220;So the prison does everything it can to provide opportunities to ensure the safety of the offender.&#8221;

The Sexual Habitual Offender Program of the state Department of Justice requested at least portions of the Gardner file on March 2, the day Chelsea&#8217;s body was found along a tributary of the lake.

Aftermath of Chelsea King killing: Advocates push for self-defense training

Thirty-year-old John Albert Gardner is a repeat sex offender accused in the death of 17-year-old Chelsea King. The high school honors student from San Diego County went for a jog in a park near her house last month and never came back. Police found her body in a shallow grave. Gardner is accused of attacking and killing other teenage girls as well. Chelsea King&#8217;s parents are calling for stricter laws to prevent repeat offenders from striking again. But Jessica&#8217;s Law, Megan&#8217;s Law and Amber alerts are already on the books, named for other young crime victims. Some advocates of self-defense training say another approach is needed as well. They want more women and girls empowered with training to respond in violent situations.

Kendall Sallay graduated recently from Poway High School &#8211; the same school where Chelsea King would have graduated in a few months. "You know, it&#8217;s terrifying," she said. "It is terrifying for the whole community."

So Sallay initiated a petition drive to get self-defense courses taught in high schools as a physical education credit. "We want it to be part of the academic curriculum. This is something that would be so useful to girls more than games like over the line or other games that seem to be popular in high school P.E. courses."

Kendall Sallay is in college now. She says self-defense is actually an important college prep course. A U.S. Justice Department report says nearly one in five women experiences rape or attempted rape while in college. Self-defense instructor Ellen Snortland says personal safety courses should be routine as fire drills.

Poway High School officials say they&#8217;ll meet with Sallay soon. She and other self defense advocates say they&#8217;re working to have schools across California offer personal safety courses.

Expert Analyzes Gardner Handwriting Samples

Taken from Gardner's prison file, I-Team reporter Mitch Blacher had the samples analyzed by a handwriting expert. She was not aware that the signature belonged to a man accused of murder.

Of Gardner's sample, Sassi said, "The writing itself is all kind of low-form level, intense, so this is a person who just can't control themselves."

"You can tell all of that stuff from his signature?" asked Blacher.

"Oh yes, definitely," said Sassi.

"In the 'g' we have a hook at the beginning, and that shows they want to take or gain. This is sometimes a sign of someone who will steal. The upper part of the 'g' is kind of twisted and strange in several parts of the signatures which shows twisted and strange thinking. The 'd' in Gardner is very slanted to the right, which we call this the manic d, which means it is a person who has trouble controlling their impulses," said Sassi.

Gardner remained free after repeated run-ins
In one, he was with another sex offender -- and that man was sent back to prison

One night in November 2008, a police cruiser rolled up on two registered sex offenders drinking beer and smoking marijuana in the bed of a truck at an Oceanside city park.

One was returned to prison on a parole violation. The other, John Albert Gardner III, had been off parole for two months and so remained free, according to records obtained by The San Diego Union-Tribune.

The encounter was typical of life for Gardner after he got out of prison for molesting and beating a former Rancho Bernardo neighbor, a 13-year-old girl.

Time after time, he came in contact with law enforcement. Time after time, he walked away.

The episode did become a parole violation for Dominique Whitehair, who&#8217;s a registered sex offender for the misdemeanor charge of annoying or molesting a minor. Whitehair was sent back to prison for more than nine months, according to the state Department of Corrections and Rehabilitation.

For Gardner, it was merely a $640 lapse in judgment, one of three San Diego County Superior Court fines that a court spokeswoman said Gardner has had referred to collections.

Oceanside police Sgt. Jeff Brandt said coded driver&#8217;s licenses aren&#8217;t a bad idea but noted that some registrants may not hand over identification and others aren&#8217;t at real risk of reoffending.

&#8220;They still have rights,&#8221; he said. &#8220;I guess society has to decide how far we want to go with it.&#8221;

Search Planned for Missing Teen

The cases of Chelsea King and Amber Dubois are calling attention to other cases of missing people -- including a 16-year-old boy from the North County.

Mickey Guidry from San Marcos disappeared during a Thanksgiving camping trip last year in the Anza Borrego Desert near Ocotillo Wells.


Family friend Chris Crawford says Mickey was put on restriction by his parents, but took a family car to where his friends were camping. He didn&#8217;t have driver&#8217;s license. His friends gave him some gas money and told him to go home. Instead, he went driving alone in the desert and his car got stuck. "I don't know if he walked out and somebody picked him up or if he didn't make it out or what," Crawford said.

He says Mickey thinks he&#8217;s invincible and probably got in over his head. "He's a good kid he's just a 16-year-old knucklehead,&#8221; family friend Chris Crawford said.

It's been nearly four months and there is still no sign of the North County teenager. A search is planned Saturday in the area Mickey was last seen.

The family of Escondido teenager Amber Dubois has spoken publicly about the case -- urging people to help find Mickey.
