Phillip Garrido's attorney may be laying the groundwork for a mental health defense in his kidnapping-rape trial, citing "signs of serious mental illness" and saying he has "been hearing the voices of angels for years."
The statements, contained in filings made late today by public defender Susan Gellman, come in advance of Friday's hearing over whether Garrido can have contact with his wife, Nancy, in the El Dorado County Jail to prepare their defense and discuss family matters. The district attorney and sheriff oppose the move, but Gellman filed papers today saying she wants District Attorney Vern Pierson to turn over notes and/or recordings he made during a Feb. 8 meeting with the alleged victim, Jaycee Lee Dugard.
Gellman countered today in her filing, stating that the "characterization ignores the facts." "The District Attorney is making the very same mistake that parole authorities made concerning Mr. Garrido for many years," she wrote. "He is ignoring the signs of serious mental illness."
One legal expert said the filing shows Gellman may be preparing a mental health defense that could be used in trial or to try to have him deemed unfit for trial and sent to a mental hospital. Veteran Sacramento defense attorney and former prosecutor William Portanova said he doubted such a bid would work. "I think mental defenses work best in isolated incidents where people have an aberrational behavior explode once," he said. "But 18 years of violence, predatory behavior, conniving, manipulation and deceit will be very difficult to overcome."
