Public Ministery with no reasons to inquire McCanns again

The Ministerio Publico (MP) has not yet determined new inquiritions on Kate and Gerry McCann, because “new pieces of evidence that would justify new interrogations” have not been collected, after the questionings that were performed on the 7th and 8th of this month. This information is part of a note that was released by the Procuradoria Geral da Republica (PGR) [Attorney General] – the first that included concrete aspects of the ongoing investigation.

A new diligence with the couple – which was constituted arguido two weeks ago – and according to what JN could discover, will only occur after the forensic science lab in Birmingham releases the results of the analyses that were performed on residues that were found inside the Ocean Club apartment in Praia da Luz, where the girl disappeared from on the night of May 3.

Madeleine: Speculation boiling, waiting for breach of silence from Ministerio Publico [Attorney General]

Since Friday, the Policia Judiciaria stopped having a spokesman for the investigation that is ongoing to discover the circumstances of and the person(s) responsible for the disappearance of little Madeleine McCann, from the apartment where she was possibly sleeping in Praia da Luz.

Chief inspector Olegario Sousa, who liaised with the journalists since the first days after the girl’s disappearance, on May 3, was relieved from that task by the Central Management of the investigative police, as it considered that his functions “were no longer justified”, “given the fact that the process is now coordinated by the Ministerio Publico”, a source at the press cabinet of Policia Judiciaria referred.

The moment, which should only matter to the journalists, opens this article simply because it marks the beginning of a new phase in the process.

With Olegario Sousa exiting the scene, and the majority of sources connected to the process now being unavalilable, the journalists have nobody to turn to in order to confirm or deny any new information about the investigation that may appear in the newspapers, either Portuguese or English.

The result: any news is easily spread as being true, without having been sufficiently confirmed by other sources.

The examples are in the dozens, and they have sprinkled the newspaper pages throughout the week. “Police wants Kate’s diary”, “Police already have Kate’s diary” and “Police does not want Kate’s diary” were titles that followed one another, in a random order, without a single journalist being able to ascertain what he was reporting.

Safe for cases when the news were based on absolutely credible sources – which, for now, is impossible to confirm – most of the information resulted from rumours, from hearsay, which often starts by a British paper citing from a Portuguese one and vice-versa.

What is objective for now is that the Ministerio Publico has asked the Criminal Instruction Judge of the Circuit of Portimao, Pedro Frias, to validate and to authorize diligences, that could include searches, forensic tests or apprehensions.

On this search for objective information, and confronted with the insufficiency of the information flux that is being generated by the press cabinet of the Procuradoria-Geral da Republica [Attorney General], appealing to judge Pedro Frias might open a clear information door.

That door was closed on Tuesday, with the Conselho Superior da Magistratura [Judges Counsel] pushing the responsibility over to the Ministerio Publico.

Hopes are now focused on the Ministerio Publico and the interpretation it makes of the changes in the Penal Code, which became valid on Monday.

The process may become “public” and only be subject to judicial secret if any of its participants requests it.

Independently from that, the Procuradoria-Geral da Republica, which had kept rigorously silent until yesterday, said this Wednesday that for now the McCann couple will not be questioned, thus dismissing Portuguese and British newspaper titles over the last few days.

On Friday ends the ten days time limit for the criminal instruction judge to issue his dispatch, “determining the execution of diligences that are seen as necessary, the use of international cooperation mechanisms that are adequate and the measures that are to be taken, namely concerning the situation of the arguidos”, as the first statement from the PGR mentioned last week.

What crime Kate and Gerry McCann are suspected of, which evidence there is, which diligences are to be performed, these are all questions we expect to be answered on that day.

Until then, one keeps in mind that no information that is being published in the newspapers is believable, at the same time one realizes that the judicial system is not prepared for cases like “Madeleine”.

PJ investigates crematorium in Monchique

Dutchman defied PJ to see oven where he burns animals


More than a month after the last visible diligences on terrain, the Policia Judiciaria entered a property in the Monchique hills yesterday, where an animal crematorium is located which belongs to a Dutch citizen, Eef Hoop, approximately 50 years old, who lives there for almost a decade. As DN could verify, the purpose was to “calm down” the crematorium owner, as he asked the Criminal Investigation Department (CID) in Portimao for explanations about alleged investigations into such equipments, which could be connected with the disappearance of Madeleine McCann’s body.

PJ arrived on location in Castelo da Nave shortly after 3 p.m., and one of the two investigators that were on mission asked the Portuguese and foreign journalists not to film or photograph them. “Let us work”, they said. The inspectors didn’t give importance to the crematorium, which is called Creon Starlight (the name of a dog that belonged to the owner), the first private equipment of this kind in the Algarve. This happened in spite of Eef Hoop saying that a few months ago a foreign couple arrived there with a bag, in order to burn a dog, and he noticed that the people didn’t cry, contrary to what is usual. But he guarantees the bag contained a German shepherd dog.

The visit of Judiciaria at the crematorium, whose activity was suspended in March by ASAE because it lacked a proper license, happened after the Dutch citizen asked for explanations at the DIC in Portimao yesterday morning, as he alleged the police were investigating crematoria and he felt “persecuted and watched” by inspectors that he recognized close to his girlfriend’s home, in Portimao. The Judiciaria promised Hoop it would visit his crematorium. Hoop rapidly informed the journalists of the action, as they were concentrated in front of Portimao’s courthouse.

PJ awaits decisive exams

At a time when the DNA tests and other biological samples that were detected in the apartment where Maddie disappeared from, and in the car that was rented by her parents, three weeks later, are not determmining evidence to incriminate the McCanns, PJ awaits the arrival of the rest of forensic testing that was performed in Birmingham, which may have more consistency for the investigators.

As DN could find out, those exams are related to alleged traces of medication that was given to Maddie. It is apparently toxicology indicators that one intends to clarify if they are related to the DNA tests from the British child. This means the purpose is to discover if Kate or Gerry gave any medication to their daughter, what medication and what dosage, as the investigators are increasingly convinced that Maddie is dead.

Parents hire President of the Bar


Kate and Gerry have a new lawyer. Joining the powerful team they had already hired in London, the British couple that is suspected of their daughter’s deatch now counts on the services of the President of the Portuguese Bar himself, Rogerio Alves.

The lawyer thus joins Carlos Pinto Abreu, another director of the Bar (the president of the Human Rights Committee and a candidate for the Lisbon District Counsel’s presidency), thus ensuring one of the most expensive defenses, for arguidos who are just subject to ‘termo de identidade e residencia’ [duty to inform about their identity and residence].

Clarence Mitchell, the new spokesman for the couple (and until two days ago, an advisor to the British prime minister), announced the hiring of the lawyer yesterday, also informing that the couple met in London, during the afternoon, with their English and Portuguese lawyers.

While Maddie’s parents reinforce the team that will take care of the legal offensive, Policia Judiciaria is still at an impasse. The process is still with the instruction judge in Portimao and no visible diligences to search for the child’s body are being made.

The largest expectations are now concentrated in Birmingham, from where at any moment more results from dozens of analyses that were requested by the Policia Judiciaria could arrive. Based on these new elements, the investigators believe they can reinforce the evidence against the parents, namely through analyses that were performed on the hair that was found inside the Renault Scenic that was rented on May 27. Those tests will verify if the residues came from a child or from a corpse, which could change the investigation’s course.

The results of the residues that were collected inside the Ocean Club’s apartment are also awaited, as well as the results of a collection of residues that were found inside the McCanns’ rental car.

For now, authorities are preparing the request letters that are to be sent to England, asking for dozens of diligences. Among others, new questioning of the child’s parents and friends that were spending their holidays in the Algarve with them should be requested, and the authorities will also request home searches, as CM has reported.

Kate’s diary will be apprehended in that diligence, as it has been considered fundamental to define the child’s mother’s psychological profile by the Policia Judiciaria. The apprehension of that document was validated by the judge, given the fact that it is a manuscript that invades the owner’s personal sphere and its apprehension must be validated in a separate document.

Crematorium visited by PJ

Two inspectors from Policia Judiciaria (PJ) visited an animal crematorium yesterday, in Monchique, and its owner was questioned about Madeleine’s disappearance.

Hendrick Hoos – a Dutch citizen, 61, who was imprisoned for seven years in Holland for attempted political murder – told CM he was “persecuted in Portimao” and therefore decided to “ask the police for explanations”, yesterday morning, and went to the PJ.

“They asked me if I had ever talked to the English girl’s parents and friends and if I had been to Praia da Luz in the last few months and I said no”, the Dutchman said.

The inspectors analysed the crematorium for ten minutes and asked Hendrick to go to the PJ on Monday, at 10 a.m.

If Kate really was worried about being stalked all week, as some reports say she was, then one has to wonder why the patio door was left unlocked and why the Tapas 9 did such a sloppy job of checking on the children.

A commonplace, though not "innocent", explanation is that they were schnockered on all that wine.

Another good reason not to get plastered when responsible for children!

Mr Matias said: "It was a perfectly normal, relaxed, happy, family scene. The little girl was even dancing on the esplanade with her dad to the sound of music that was playing. "We couldn't believe it when we found out what had happened because nothing we saw gave any sign of what was coming.

"We didn't see anyone suspicious looking at the girl or the people on the other tables. Nor did we see anything out of the ordinary between the families and the children.'

Mr Matias's evidence confirms Madeleine was alive and well at 6pm, when the family left the restaurant.

To a tight trio of trusted colleagues he had confided that he was ''unhappy" about the inquiry and ''exasperated" with the constant leaks from junior officers who, in exchange for extravagant meals, were willing to either reveal snippets of confidential information, or to embroider vague facts if they felt that was what their moles in the Portuguese media wanted.

He believes that the concerted fightback by the McCanns will reveal that, for all the police posturing when they named the couple as suspects, their evidence was at best flimsy, at worst supposition. ''He has told me he always worried that the evidence against the McCanns was weak," says one former policeman. ''He was worried it would not bear scrutiny."
He has complained that while fellow officers were leaking information illegally — Portugal has strict secrecy laws — the same officers would instruct him to deny the stories when printed. The problem for Sousa was that the denials rarely got into the media.

The result has been endless column inches slandering the McCanns. ''Some Portuguese journalists were fairly convinced the so-called evidence passed on to them by police was nowhere near as concrete as their sources suggested," says Jose Lugios, a freelance reporter based in the Algarve.

Such lax practice has shocked even the country's politicians. ''The leaks to the press of some details that are supposed to be classified have been used as an easy way to manipulate and shape public opinion," says Francisco Louçã, leader of a Portuguese opposition party.

New contradictions


Madeleine’s trail in the last hours before she disappeared is fundamental for the investigation. The parents told the PJ that the girl was in the Ocean Club crèche until 6 p.m. But the owner of a restaurant at the beach in Praia da Luz guarantees that, at that time, the family was at his business.

Madeleine’s last picture was allegedly taken by Kate at 2.29 p.m. On the photo, the girl, her twin siblings and Gerry can be seen at the Ocean Club’s pool, in the same area where the crèche is located.

According to the statetments of friends that were cited by the English press, the children were at the crèche during the afternoon, while Gerry attended tennis lessons and Kate was at the pool. According to this version, Madeleine had tea at the crèche around 5.30 and her parents picked her up shortly before 6 p.m. They went into the apartment, where the parents left from to attend dinner with their friends at the Tapas restaurant, where they arrived at 8.20 p.m. “There are records and witnesses”, a source says, “Kate was never alone with Madeleine during the afternoon”, another stresses, both cited in the English press.

Miguel Matias contradicts this version. The owner of Paraiso restaurant, on Praia da Luz beach, guarantees the McCanns were at his restaurant during the afternoon. And he guarantees he has evidence. Video surveillance tapes that are already in possession of the PJ. “The date is on the images”, he assured CM.

It was a week after the disappearance, when the image of the girl and of her parents was filling up news reports, that an employee alerted his boss. He remembered the face of one of the couple’s friends.

Miguel Matias took the recordings home and saw them. He guarantees it was the McCanns with their three children, plus two couples and other two children. He also says he thinks he sees an elderly woman. He assures that the girl ate at the restaurant. An employee says they left around 6.15 p.m., because it was the time she left herself. Other employees have doubts, “with all this confusion”.

Gerry close to abductor

Gerry McCann is convinced that the kidnapper was inside the apartment when he went to check on his sleeping children at 9.05 p.m. on May 3. At 10 p.m., Kate noticed her daughter Madeleine was missing. According to the English press, which cites a friend of the couple, Gerry found the door to the children’s room open. He thought it was strange because he had left it closed, but he thought Madeleine had gone to fetch some water. Now he concludes that the kidnapper was hiding inside the apartment at that moment. He didn’t see him. Kate now remembers that the bedroom door slammed shut because of an air current when she entered the apartment at 10 p.m. They insist the adbductor fled with their daughter through the bedroom window.

The McCanns believe that their daughter was abducted to order. The theory was revealed by friends, and reported in the English press. The couple suspects that the girl was being watched. Madeleine disappeared on the sixth day of the family’s holiday in Praia da Luz.

Malinka

Sergei Malinka, who is cited by ‘The Sun’, said he is going to sue policemen for “violent behaviour” during the questioning that he was subject to at the PJ in Portimao. The Russian, who lives in Luz, was questioned on the night of May 16 to 17, for suspicions of being connected to Robert Murat, who is an arguido in the process. The issue was an alleged phonecall that was made on the night that Maddie disappeared.

Marie Pollard contacted police to say she was certain she had seen Madeleine at the garage shop, with a man. The little girl looked sad and, in good English, said to him: “Can I see mummy soon?” A man from Yorkshire visiting Marakech called police around the same time, and reported a similar sighting.

Though both were guests at the Ibis hotel, there is no connection between Ms Pollard and the Yorkshireman. Today we also disclose that these sightings led to a massive operation by secret police in Morocco.

Today, he said: 'They are always very pleased to hear of any situation no matter how long after (she disappeared). Any sighting anywhere is of value.'”


So they knew about it then, but are having it reported as news now? Just as Colomom (I think it was) said, they are trotting out old old news and trying to make it sound new. That's awful and just makes them look bad.

The Daily Express can reveal that their seven holiday friends may now be named as suspects as police believe they are hiding the truth about Madeleine’s death.

POLICE last night showed they think Madeleine McCann’s parents are lying over her disappearance as they declared the only other suspect innocent.

Detectives revealed they now believe ex-pat Brit property developer Robert Murat, 33, has nothing to do with the case.

They think he is the victim of a plot by the McCanns and their pals to frame him for Madeleine’s abduction and murder. The seven friends on holiday with the couple could all now be named suspects..................




Not the most credible of sources but the Daily Star has been the most even reporting newspaper during this media circus.
