Divorce final for missing girl's dad, stepmother

"Investigators believe that Misty Croslin-Cummings continues to hold important answers in the case," the sheriff's office said in a written statement. "She has failed to provide any sort of detailed accounting of the hours during the late evening and early morning of Haleigh's disappearance. Furthermore, physical evidence at the scene contradicts Misty's sketchy account of her evening activities."

Under the divorce settlement approved Thursday by a St. John's County court, both sides permanently and irrevocably waive any rights to alimony and other types of financial payments.

A St. Johns County judge finalized the divorce between Ronald Cummings and Misty Cummings on Thursday.

Florida law never prevented the couple from testifying against each other, even when they were married, former State Attorney Rod Smith said. He said there is no husband-wife privilege if the victim is a child of one of the parents.

The disappearance of 5-year-old Haleigh Cummings eight months ago occurred about the time Ellen Johnson got Internet access at home in east Texas.

"I didn't even have a computer in my house until just before this," she said.

Johnson says her attraction to the case is not something she understands completely. She had never posted on an online forum but is now immersed in Haleigh's story.

Misty Cummings reportedly robbed

Palatka Police say they responded to a report of three women being robbed in the Ragsdale Apartment Complex located on Moody Road in Palatka. Police say one of the victims was identified as Misty Cummings, age 17.

According to one of the victims, Brandy Steedley, age 18, they had driven to the complex so that one of the girls in the car could make contact with a friend, reports say. As the girl was getting back to the vehicle, 2 or 3 unidentified black male suspects approached the vehicle, reports say. The men reportedly grabbed Misty Cummings and stole her purse.

Police said Cummings was able to get back in the vehicle, and she and Steedley drove off in the vehicle. The third girl, identified as 22-year-old Melinda Santmyer, ran off on foot.

Officers located and interviewed Santmyer at an apartment in the complex. She told officers that the three women came to the apartment complex attempting to buy drugs.

Police said she told them she got out of the car to look for an unidentified man the women gave money to for drugs, and as she was going back to the vehicle, the men came up to them and stole Cummings' purse and her purse.

One friend got out of the car to talk to someone and when she returned, "two or three black males jumped on Cummings taking her purse and pulling her out of the vehicle," the report said.

Cummings managed to get back into the car and the driver took off. The third woman, however, chased after the men. Cummings was taken to Putnam County Medical Center after complaining of minor injuries. Police found a purse strap and a "crushed pill bottle with unknown pills inside" at the scene.

One of the women in the car told police after the incident that she and Cummings had gone to the apartment complex to buy drugs. Police were called to another scene while interviewing the women and no one was arrested.

As she was walking back to the vehicle, two or three men came up to them. Police reported the second victim, Brandy Steedley, 18, said the men grabbed Croslin and stole her purse. Santmyer told police they also took her purse.

Griffith said at first police were told the three were at the complex so that one could visit a friend. He said police later learned the trip had been about purchasing drugs. Griffith said police did not know what type of drugs they were trying to buy.

On Monday night, Cummings and two friends had gone to Palatka's Ragsdale Apartment, looking for drugs, Palatka Assistant Police Chief James Griffith said. The women had given a man some money for drugs then he disappeared, Griffith said.

One of the women had grown impatient, gotten out of the car and was trying to track him down when two or three men grabbed her purse and the one belonging to Cummings, Griffith said.

He said authorities were looking for the suspects.

Putnam County Sheriff Jeff Hardy said during the first few days of the investigation that deputies also searched landfills, which is how Somer was found Wednesday.

Annette Sykes, Haleigh's paternal great grandmother, said today that she sympathizes with Somer's family, and she still holds out hope that Haleigh can be found alive.

Statistics compiled by the National Center for Missing & Exploited Children provide both hopeful and discouraging data relative to Haleigh's case.

For example, the center has determined that more children now are being returned safely to their homes than at any other time in U.S. history, with the recovery rate rising from 62 percent in 1990 to 96 percent in 2008.

Greenwood said investigators still believe what they believed the day Haleigh was reported missing.

"There are people out there -- at least one person out there -- who knows what has happened to her," Greenwood said. "Now it's a matter of someone slipping up -- or wanting to say what happened -- that will help solve this case."

Searcher Tim Miller convinced Haleigh dead

The founder of TES involved in the quest to find Haleigh Cummings says he believes the child is dead and authorities will be lucky to find her body.

Tim Miller, who has assisted law enforcement in the search for Haleigh since February, says the group focuses on finding children who still have a chance to be alive. That no longer includes the missing 6-year-old Haleigh Cummings from Satsuma.

"In no way possible do I believe Haleigh is alive," Tim Miller said. "Haleigh's going to be just as deceased tomorrow as she is today, or next week as she was six months ago, bottom line. And I hope I'm wrong about that. But let's try to save the ones that just disappeared or that we have leads on, with people that are cooperating, rather than fighting with these families."

After traveling to Jacksonville to assist in the search for 7-year-old Somer Thompson, whose body was discovered in a south Georgia landfill Thursday, Miller immediately jetted off to Oklahoma in his to aid in solving another disappearance.

Haleigh Cummings home is only a speck on the map of Palatka county. Even from a birds-eye view, it is hard to see the homes in Haleigh's neighborhood. Finding a six year old girl has been even harder.

Each step behind Haleigh's neighborhood takes you deeper and deeper into the woods. Action News found that once we hit certain spots in the woods, you could barely see a person in front of you, let alone a scrap of evidence at your feet. They are woods, a forest, that only experts can get through. Woods so deep and so thick, that even our camera had a hard time getting through some of the thickest terrain in Florida.

This is the first time the public gets to see why a search on this land is so difficult.
