GUILTY MI - Carnel Chamberlain, 4, Mount Pleasant, 21 June 2012 #2

  • #541
I took this from the link Knox had above about Carnel's Memorial Service. I didn't realize his birth father spent anytime with him...

Carnel’s grandfather concluded the ceremony by reading a letter from Carnel’s birth father, Byron Keith Frances.
Frances is currently in prison on assault charges.
In his letter, Frances told stories about the experiences and memories he made with his son, including fishing, going to the zoo, visiting other family members, watching TV shows and playing on swingsets.
He offered his thanks to those who participated in the search to try and find Carnel, and apologized that he could not have spent more time with his youngest son.
Frances said he would always remember June 22, when he heard the news about his son.
“I’m sorry, son. I couldn’t be there for you,” his letter said. “Now I’m stuck in a single man cell, angry hearted, broken and trying to figure out how to deal with tomorrow.”

Bless you both - Longtallcold and JusticeForCarnel. You both have lived close to the reality of Carnel's abuse and death. Thank you for sharing with WS members you personal, local experiences regarding the search, the community spirit, and the memorial service. May you both find healing soon knowing that you both have pure love for Carnel and he has now at peace

So glad the memorial service was a healing celeration of Carnel's short life!

Now let's get to the business of putting this monster away where he can never hurt another child, woman, or animal AGAIN!

REMINDER: AB's arraignment is today at 4pm.

He faces 5 years for the crimes he is currently accused of.

I sure hope they can get enough forensics to get him for murder...

BBM. I too hope they get him for murder. It's like a kick in the gut everytime I read, no one has yet been charged with this death. Praying those murder charges come soon.

The 5 yr max sentence for the charges with which AB has been charged, since those are federal, I assume the MI state habitual offender law to increase the sentence does not apply here? Or am I misunderstanding how the MI habitual offender laws might coincide with federal charges since the crime occured in MI?

Thanks laniefi. I wonder if a verified attorney or paralegal, or someone with better knowledge of the law could chime in here. My concerns are with the actual amount of sentence served. We see some that are 85% of the sentence or even 50% or less.

IIRC, AB was out early on something for which he was previously sentenced, which if he was required to do the full sentence, he would still be incarcerated.

I have to run out for a bit but will try to look back at that again later.

Also. With AB's mother and sisters knowledge of exactly how dangerous this 🤬🤬🤬 is, why didn't they ever make contact with JC stating, my brother or son is a very dangerous man his sealed juvenille records include .....

MANY people knew how dangerous AB is, including his mother, sister and parole officer and NO ONE bothered to keep this 🤬🤬🤬 locked up with his previous sentences, nor was he required to be on any violent offender list. I could go on, but have to be somewhere soon and don't want to be late.

BBL.

Cubby, there is a Federal '3 Strikes Law' IF the tribe allows it. At this time we don't know if he has 2 Federal charges against him, do we? This will be worked out with the Federal prosecutor, the tribe and the lawyers. I do hope the tribe allows the death penalty and/or the '3 Strikes' law.

Bennett, his hair slicked back with gel and clad in orange from his neck to his feet, appeared before U.S. District Magistrate Charles E. Binder this afternoon for arraignment on a charge of assaulting a person younger than 16 causing substantial bodily injury. The charge is a felony punishable by up to five years in prison and a $250,000 fine.

Binder on June 29 arraigned the 20-year-old Bennett on a criminal complaint of the same charge. Due to a federal grand jury having indicted Bennett with the count on Wednesday, he had to once again be arraigned on the same count.

Bennett, standing beside attorney Anthony Chambers, only spoke to answer the magistrate’s yes-or-no questions. At Chambers’ request, Binder entered a not guilty plea on Bennett’s behalf.

I thought the abuse charges were laid AFTER Carnel went missing. Confused.

Is this something the tribe looks at/allows on a case by case basis? Or is this a one time opt in or opt out? Or is it voted on every so often?

I'm curious as to how this works with this particular tribe/the tribe for which would have jurisdiction in this case/the tribe that AB belongs to.

I think it meant AB was charged with abusing Carnel in the days before he disappeared, not that he was charged prior to the disappearance. :)

I'm in a time crunch, end of the day. Check here, I'll look at my tribal law books when I get home. This is a question Kevin Chamberlain might be able to answer, I wish he posted here. :)

Hi Everyone,

I'm new to Web Sleuths, registered against my better judgment. It's one more thing that takes my attention away from things I should be doing. But this is an excellent site. I've learned things here and am impressed by the professionalism and knowledge brought to the pages. This case surely breaks my heart.

Jacie Estes, you posted a link about the effects of the past on Native Americans. I believe there is a medical term to describe it. We carry in our genes what our ancestors experienced. Looks as tho I don't have permission to look up posts by any one member. Would you please post that link again?

Also, has anyone gotten more info on the involvement of BIA? Particularly regarding access to the house when Carnel was first missing?
