GUILTY MI - Charlie Bothuell, 12, Detroit, 16 June 2014

  • #761
I think that is quite likely, but why did they file a mp report? He sounds like he was a very isolated child. Was someone looking for him?

IIRC, friends and neighbors, extended family were looking for Charlie, but his parents didn't participate in searches.

Looks like Mr. Pesmark, the man with the shaved head seated at the prosecution table, has a black eye. :waitasec:

  • #763
Officer Dillon didn't talk to the prosecutor prior to her testimony.

She didn't think the dirty house was conducive for children. Smith tried to equate it with automatic abuse. Stress on dirty, stained carpets.

Lost feed just as Smith asks judge to disregard testimony about dirty house.
Missed the decision, but Goldfarb was complaining!

  • #764
Condition of house must be a sore spot for the defense.

  • #765
Request to strike the PVC pipe as evidence is denied.

  • #766
Smith wants pipe out of evidence b/c no DNA on it. Goldfarb objects since the Bothuells told her it was the pipe used. Judge denies. Dillard joins in the action and judge denies him too.

  • #767
^ I'll bet there have been multiple pipes used to discipline Charlie. :moo:

  • #768
Smith now goes on to the blue laundry bag with clothes Charlie was supposed to be wearing when he disappeared.

Smith wants to know why her "ultra-sophisticated" team didn't find them sooner. He also makes it sound like the house was searched for 11 days.

  • #769
WTF! Attorney trying to tell Officer Dillon what she said to herself?

  • #770
Now on to the jacket hanging in closet. She didn't search the closet on the 19th.

Trying to say that LE saw all this clothing and ignored it for many days.

Real question (from judge): Was she surprised? Yes, that the jacket Charlie was wearing was suddenly noticed hanging there?

Smith indicated it was possible Charlie had just come home and put the clothes there after returning to the home. The parents weren't there at the time. (We know where Daddy Dearest was!)

Now, he's asking her to describe the basement, which she already did yesterday.

  • #772
This attorney doesn't know how to ask "relevant" questions. :notgood:

  • #773
Attorney: "I'll move on."

Judge: "Yes, please do."

  • #774
Dillon did not search the basement. Others were assigned to do it. She only went down briefly.

So why 101 questions about the search of the basement that she didn't do.

  • #775
Did she see evidence that the officers were slacking off? NO SIR!

Earlier, he asked her if she found them playing cards would she report them. FGS!

She judges that it was a while after she was down there when they found Charlie. Smith wants to know if she made note of the time.

Lost feed again.

  • #776
Trying to get Dillon to say the basement was never fully searched. She did say it was so cluttered!

More irrelevance! This information needs to come from those who did the search.

Judge Holmes points out that no one testified that they searched the basement for 11 days.

  • #777
Judge is awesome!

  • #778
Smith SAYS this is the last question! Let's see.

Do you have first-hand knowledge of how many times the house was searched?

Dillon says she was only there two days when it was searched, the 18th 19th and the 25th.

  • #779
^ I thought Dillon said she was there on the 19th and the 25th.

  • #780
Hey Smith! You're asking more questions!

Charlie was wearing a T-shirt and pajama pants.

Smith asks if she immediately called and ambulance?

(We know the answer already!)

Smith: There's no need to get him to the hospital immediately, just sit on couch, give him a glass of water, talk to him.

Dillon: We were assessing him. It's preferred to take him to be interviewed at KidTalk first.

Smith points out she knows the rules. She says FBI wants interview first.

Last question, Smith?

Like, Dillon should have silently taken the frightened, thirsty boy for an interview? Be human, that's the first rule?

Smith keeps going on about protocol, a lot like Dillard went on about methodology and scientific method of diagnosing abuse as if the child was a machine or a blood test.
