Just reported on WWJ radio (CBS, Detroit): The trial to determine whether or not Charlie Bothuell will remain with his father and stepmother has been pushed back to next month. Nothing on WWJ website yet, but I'll post a link when it's available.

Prosecutor Kym L. Worthy has charged Charles Bothuell IV, and his wife, Monique Dillard-Bothuell, with Torture and second degree Child Abuse.

Allegations against the parents of Charlie Bothuell came on June, 2014, when Bothuell IV called the police to report his 12-year-old son missing. Charlie was found behind boxes in the basement of the home in the 1300 block of Nicolet Place in Detroit on June 25.

"We are thankful that the victim was found alive," Worthy said. "This is the first time that the Wayne County Prosecutor's Office has charged torture for a living child. Based upon the allegations, if any case warrants child torture charges, this one certainly does." ...

It's been so long since I've seen Charlie's name in the news that I was losing hope. I'm pleased that this case will go to trial.

There hasn't been recent news of the custody case lately, however.

^ The custody case has been postponed several times. I think the Court was waiting for charges against the parents as that will likely have an impact on the custody case. I will try to watch arraignment this afternoon (2:30).

Detroit — On Friday, Wayne County Prosecutor Kym Worthy lodged torture and child abuse charges against the father and stepmother of the "Basement Boy," a 12-year-old allegedly found hidden in their basement on June 25, 11 days after he was reported missing.

Charles Bothuell IV, and his wife, Monique Dillard-Bothuell, were arrested Friday morning.

Each has been charged with one count of torture and child abuse in the second degree, which is punishable by any term of years in prison up to life...

I rarely watch HLN these days but noticed that Nancy Grace covered the Charlie Bothuell case this evening. I will post the transcript tomorrow. Dr. Drew covered the case, as well. I don't think his transcripts are published on the CNN/HLN site.

Of note on Dr. Drew tonight: Mr. Bothuell failed a polygraph. Mrs. Dillard-Bothuell refused to take a polygraph. 'Nuff said.

Detroit — The father and stepmother of the 12-year-old “Basement Boy” are expected in court Friday after the boy allegedly was found hidden in their basement last summer, 11 days after he was reported missing.

Charles Bothuell IV, and his wife, Monique Dillard-Bothuell, are expected to appear for a probable cause hearing in Frank Murphy Hall of Justice before Judge Shannon Holmes.

Each was charged last week with one count of torture and child abuse in the second degree, which is punishable by up to life in prison...

ETA: Discussion of reduction in bond. Discussion of living conditions of the family. Residency discrepancies. Indigence hearing next Friday, March 6. Mr. Bothuell is self-employed but doesn't make enough money to pay for legal counsel. Mrs. Dillard-Bothuell is a housewife and can't afford attorney. Each has their own attorney. Judge orders no contact with young Charlie.

I had trouble with audio during the hearing and did not realize that Mr. Bothuell has relinquished his parental rights to young Charlie. Also, Mrs. Dillard-Bothuell no longer has custody of the two young children. :waitasec: Wonder when this came about? Do they think that giving up custody/parental rights will result in acquittal - assuming the case goes to trial?

I didn't hear the audio or see video of the hearing. There was no mention of Mr. Bothuell relinquishing parental rights on either of the news reports. Seems strange they would court order him not to have any contact with the child or the child's mother if he had relinquished. The step mother would not have any rights to this child - but her own children she would be allowed supervised visits (unless the court ordered that would be not in the best interest of the children).

I assume that Child Protection Services (CPS) would have picked up any children in their care at the time they found Charlie. After their investigation, they would determine if the kids would be able to be safely returned to that home. Federal and State laws require the children have visits with their parents while in foster or kinship care - unless the visits would be harmful to the children. They may require supervised visits or therapeutic visits (with a qualified mental health provider present) but to suspend any and all visits is a huge step and must be court ordered.

Either way, I hope Charlie is doing much better now that he is out of the h*ll hole! The punishment these parents forced upon him was just sadistic (IMO) they wanted him to suffer. They wanted him to experience pain and anguish. I am so glad they were exposed, and I am proud of this little guy taking care of himself to avoid the suffering.

It's in Tweets from reporter Holly Fournier. I wasn't sure exactly what was said when I heard something about "parental rights" because audio during the hearing had gaps.

Bothuell has released parental rights to his son, Charlie Bothuell.

The Judge said that neither Mr. Bothuell or Mrs. Dillard-Bothuel are allowed to have contact with any of their children.

Bond for Monique Dillard-Bothuell has been lowered to $50,000, 10 percent. She must wear a GPS tether and have no contact with her kids.

Dillard-Bothuell does not have custody of her kids, prosecutor says. Therefore, she is not needed at home to care for them.

13-year-old Charlie Bothuell has been living with his biological mother after the basement incident. IIRC, his father was not to have contact with him. The two younger children were placed with a relative of Mrs. Dillard-Bothuell with limited visitations for the parents. From the sound of things during this morning's hearing, the Bothuells are not living together: She is living in the home where she grew up, and Mr. Bothuell was "squatting" in a home north of Detroit. It's a convoluted mess, to be sure.

The video from this morning's hearing isn't available on the WDIV site, but I will post if/when it becomes available. The audio was so poor that they might not offer it again.
