Next up: Deputy Faulder

Responded to missing persons report at Mrs. Bruck's (mom) place of work.

Recounts what info he gathered in the report. That Chelsea had gone to a party, her phone was left with a friend, no one has heard from her. (nothing new here)

Thanks so much for the updates, Vail

This is annoying that the speakers are not aligned with the video. At least for me..

Going through the players and steps involved in the initial investigation. The direct testimony in front of a jury of these guys will be more interesting - so far they are just recounting what they have done.

Interesting bits:

March 22, shoe recovered. Mom verified it as Chelsea's. Red American Eagle brand 8M. Got tip from resident, found north of the house in the ditch near where some woods begin at the edge of the property, while doing yard work. Approx 2-3 miles West and North from party location. Nothing else found in search of area.

John Marcon, property owner where Chelsea is found

Describing property, explaining the improvements they were making. There was a gate put at the head of the road. He had not noticed any damage to that gate.

April 24, he was with others (brother, truck drivers) at the property replacing fill (moving dirt). They had a semi, a dozer. Entered via the private drive that runs parallel to the tracks. He was in the vicinity of the area where the drive curves into the property (which he describes as a service area for the barn). He was operating the dozer. One of the semis got stuck while backing up near the tracks in the mud. There was a drain pipe running below ground towards the ditch by the tracks. (They had laid the pipe like the year before so it was there awhile. ) It was spring so it was wet back there, some low spots holding water, the point of filling the holes.

Walked around the back of the truck, thats when he found Chelsea. There was a "tree on top" and he thought someone was trespassing and a tree fell on them. He called police. He had not heard of Chelsea before this. He did not touch the body, only got 8-10 ft near, no one else went near it.

After this, (weeks, months? didnt catch how long) John was levelling some hills and saw a shoe. Called LE right away. It was 15-20 yards from the drive.

I apologize if there are errors in any of my updates, the witnesses are hard to hear and sometimes the video lags.

Had to shut down when carpet cleaner arrived. Forgot to take laptop out of den. Will read updates but have live stream on again.

Side note ( I drove by the house site about a year ago and it had a for sale sign and didn't look to have been built on any more.) I wonder if they prohibited the continuing of the building or the owner chose to stop.

Detective back on stand

describing the abandoned lot Inside found green leafy costume and red wig. Det Sgt Peterson with state police called out and took custody of evidence.

April 24th - responded to Briar Hill location. Was first on scene, as far as he knows no one else made contact with the body. Shown photo and asked to describe. West side of body looking east, mostly skeletal, little flesh on legs, chest area. Discussing something on the body (the branches?)

State Crime lab called, 2 came out and were there for several hours. Body unclothed, clothes not found in vicinity of body (they already knew about the wig and costume found at other scene). single green plastic ivy leaf found south along railroad tracks between utility road and ditch.

Sept 2, heard about green tights and shoe recovered (did not respond personally but has seen the photos). shoe matches one found on other property. Evidence turned over to Michigan State Police crime lab.

Detective describing codis DNA hit. Sample came from leotard/costume. Knew it was Daniel Clay.

Describing arrest of Daniel Clay and his attempt to flee out the back door.

Questioned, said he went to party, stayed for a couple hours then left. Originally denied seeing Chelsea. Questioned for 2 hours, eventually admitted to seeing her and having sex with someone at the party that maybe was Chelsea. When he left he went west and saw Chelsea walking, offered her a ride, they had sex somewhere off the road (LE believe somewhere around first shoe). Chelsea supposedly went to pee in the ditch then they got into the backseat and had sex. Daniel claimed she asked for rough sex. He stated she asked him to choke her, so he choked her for 20-30 seconds, then realized she wasn't moving. He checked for breath and there was none. (clearly he is lying here - 20seconds to strangle someone?). He claims he did CPR and freaked out, then began to drive around.

Difficult to listen to this. Must be awful for Chelsea's family :(

Detective testimony of Daniel Clay's account:

He drove around for 45 mins, ended up at Briar Hill area, carried her down tracks, couldn't carry her anymore and put her down and covered her with logs and sticks to conceal her. Said he then moved her further into the woods as we wasn't satisfied with the first spot.

Detective can't testify to exact locations of clothing found later on as he wasn't on the scene.

Detective allowed Daniel to make calls(multiple) from the interview room using one of the LE's phones. No one was in the room with Daniel. Detectives had been coming and going to fetch items like cigarettes, drinks, report to colleagues etc. During the calls, Daniel was apologizing (detective didn't testify who the calls were to or the exact content of the calls)

Detective describing body scene

She was in a depression in the earth, a log was on her chest and there were leaves stuck to her so they knew she had been covered elsewhere at some point.

There are a few LE mentioned here, Dept.Fauver and Det Craigmore (Predmore?) and Det Sroka, sorry I didn't catch exactly which one said what above since I am listening and the video is not matching the audio.

Defense questioning Sroka now if Daniel asked for an attorney. Sroka says he never said he wanted one specifically, only that he mentioned whether he should ask one about his rights. Sroka only saying he believes he only mentioned an attorney twice, and he was only in the room one of those times. According to Sroka he never asked to stop or specifically asked for an attorney.

Omg. Now they're repeatedly questioning the detective about if Daniel asked for an attorney. [emoji58] guess they have to go after anything they can.

Def asking Sroka if he collected DNA evidence. No he did not. Who swabbed the evidence? SPD crime lab. Sroka cannot testify about that chain of evidence. He was notified about the DNA match and sent a report. He is not a lab professional. Def asking about who was in charge of personnel, who assigned who to what, it wasn't Sroka (who was in charge of reports, reviewing tips). Def trying to poke holes in chain of custody.

More about the wine jug. How full was it when recovered by LE?

  • #579
The defense just cannot get over the wine bottle! Asking Det. to describe it in detail. Det. says the bottle was recovered between the bonfire and tent and was a 3 litre bottle of red wine. How full was it when recovered? Det. needs to refer to the report for that. Judge says OK. Stated to be about half empty. Party goers contacted LE about finding it and then LE collected it from them.

Det says Chelsea was described by some witnesses as intoxicated, and by some as not. Def asking Det if anything uncovered indicated Chelsea liked being choked during sex. Pro objects. Judge allows. Det. says several sources said yes, she did. Pro objects to Det having to testify to how many sources said this and says this is hearsay. Judge sustains.
