A judge says he'll announce in two weeks whether a northern Michigan man will be tried on a charge of murdering his baby daughter, whose body has never been found.

A probable cause hearing for 24-year-old Sean Phillips on an open murder charge wrapped up Thursday in district court in Ludington.

Judge Peter Wadel says he'll weigh the testimony before making his decision on whether to try Phillips.

When these poor kids disappear into thin air under shady circumstances then the last person with them needs to be held accountable!!! If you can't produce your child that was last seen with you then you should be punished!

Just scroll through these threads, how many missing kids are there that we're last with a parent that have mysteriously vanished! Aliens..... I think not!

These people keep getting away with it because there is no body!

The Sean Phillips case returns to a Mason County courtroom, Friday. The Circuit Court judge hearing arguments decided there was enough evidence to reopen the case.

Baby Kate disappeared from her Ludington home more than three years ago, and still hasn't been found.

Arguments will take place in Circuit Court to see if the murder case against Sean Phillips will be re-opened.

Prosecutors filed an appeal in October, after the judge dismissed the open murder charge against him citing a lack of evidence.

Phillips is currently serving 10 to 15 years for unlawful imprisonment, related to Baby Kate's disappearance.

baby kate's father is currently standing trial for her murder.......i've been doing some research and i'm going to catch up the thread and post some articles.....there is a hearing tomorrow regarding the judge in this case.......bear with me.........articles to come.......

so the sitting judge dismissed the murder case, the prosecutor filed an appeal, the appeal was granted and the charges were re-instated, the father appealed and the appeal was denied....

with me so far? at this point the prosecutor and the attorney general's office file for the sitting judge (that originally dismissed the murder charge) to step down.....two other judges had already recused themselves as they had worked on the case as lawyers that the father is currently serving time for in regard to baby kate.....the sitting judge is the chief judge btw....here's where we pick up.....

Prosecutors want new judge in ‘Baby Kate’ case

LUDINGTON, Mich. — Officials at the state and county level are pushing to keep a judge from presiding over the murder trial of Sean Phillips in Mason County.

Phillips is the father of ‘Baby Kate’ who went missing in July 2011 and was never found.

Both the Mason County prosecutor and the state Attorney General’s Office want to keep Judge Peter Wadel from presiding over the trial, after Wadel dismissed the murder charged against Phillips at an earlier preliminary hearing.

Wadel to decide whether he will hear Sean Phillips’ case

For the case to go before a different judge, Wadel first has to rule on the prosecutors’ motion. If Wadel complies with the motion and disqualifies himself, the State Court Administrative Office would appoint a new judge to hear the case. If Wadel overrules the motion, the prosecutors would have the right to appeal, in which case the SCAO would appoint a judge to hear the appeal.

That judge could either overrule their appeal and give the case back to Wadel, or sustain the motion for disqualification. If that were to happen, the SCAO would have to appoint a judge to hear the case, which may or may not be the judge who ruled on the motion.

Mason County appeals judge’s recusal refusal in Baby Kate murder case

During a motion hearing Monday morning, Judge Peter Wadel declined to recuse himself from overseeing the trial. Mason County’s other two judges previously recused themselves because they participated as attorneys in related cases.

“We are appealing Judge Wadel’s decision from this morning,” Mason County prosecutor Paul Spaniola told FOX 17 NEWS.

The state court administrator will assign a judge to decide whether Wadel will be recused from the case.

Mecosta Co. judge will hear Phillips murder trial dispute

The state court administrator’s office named Judge Scott Hill-Kennedy to hear the motion about whether to disqualify Mason County Judge Peter Wadel from the Phillips case. A hearing on the matter is scheduled for June 8.

Last month, Wadel refused to recuse himself from Phillps’ trial despite a complaint from the state Attorney General’s Office and county prosecutors, who are working together on the murder case.

Wadel previously dismissed the murder charge against Phillips for the death of his baby daughter Katherine, saying prosecutors had not presented enough evidence to justify it. The charge was reinstated by Mason County Circuit Court Chief Judge Richard Cooper.

After Cooper retired, Wadel took over as chief judge and assigned himself Phillips’ case. In response, prosecutors filed a motion saying it would be improper for Wadel to hear the case because he has already ruled on many of the issues that will come up at trial. They asked for a new judge.
