Here is what I don't get though. If he were going to dispose of her, in a lake or in the woods, why would he take off her clothes and put them in his pockets?

I want to believe that she went to a black market adoption, but I feel that there would have been evidence on his phone or computer if he had been in touch with anyone like that.

Clothing could be identifiable when remains are found. However I don't have any answer either as to why he would've left the clothes in his pockets. It wouldn't make sense either to sell her on the black-market and keep her clothing. I also believe there would be some evidence on his cell phone, etc. if he had been in contact with anyone re: such an adoption.

Still where we were before the show, the baby is missing, he is in jail, he was found with her clothes, he wont give up location, neither one of them wanted the baby. Dont know much about the mom from my limited reading but she didn't want her either. Could they have sold her for any reason and he's just taking the rap or am I way out of line here?

I agree, why in the heck would he have her clothes if he was going to kill her. Unless hes just that stupid thinking she wouldn't be identified without clothes.
Could be, but I don't think so, given this economy and desperation anything is possible IMO

According to an article I just read earlier in this thread (post #159) and what was on NG's show tonight, the mother refused to go along with adoption. They had just come from DHS, he let Kate's mom out of the car, and took off with Kate. So it wouldn't seem either of them had anything set up for a black market adoption, otherwise what would be the purpose of going to DHS?

Honestly I don't know, just look everyday to see if has been found.

I don't have a link as it was a televised clip. Mother broke down in Court hearing when clothing was produced found in Dads pocket. She identified them as what baby Katherine was wearing.

Has there been any mention of any other clothing missing, such as he could have possibly changed her clothes? Sadly I'm still going back to my original thought, however, that the clothing was removed to hinder identification.

Nothing on other clothes as far as i know. I've been following this from the start and i am starting to think that whatever happened to Kate, we might never know. He isn't in court until October now and the mom is posting on his sister's FB page like nothing has happened. There are quite a few rumors out there if you look ;-)

LUDINGTON — A motion has been filed to dismiss the criminal case against a missing Ludington baby's alleged abductor, Sean Michael Phillips, who has been officially named the baby's biological father, according to results of a DNA test, authorities confirmed.

I'm not surprised. If there isn't a custody order, you cannot kidnap your own biological child. Both of you have a right to the child.

The sticking point is going to be whether or not he KNEW she was his biological child when he took her. The DNA results were not back yet.

Maybe he didn't have to know she was his child, if she WAS that's all that is needed to make him not guilty of kidnapping her?

It's going to be a single detail I think that decides it.
When DNA results came in, what his belief about paternity was at the time, who signed the birth certificate... something like that.

I've been following this case somewhat and I am sickened by all these innocent children and baby whose parents don't care about them. I hope in this case he met or knew someone who was interested in Kate as their own and he gave her to them, to provide a better life for her. With this senerio there may not be any phone/computer records. He may have removed Kates clothing because the other person/people feared with her own clothing on, if by chance they were pulled over or seen, she would be easily recongized by what she was wearing. Same goes for the car seat and diaper bag. The person/people who took her bought new items. I bet he was paid for her, but where is the $ hidden or who has it now? As creepy as he seems, I hope baby Kate is alive and well with loving people. Praying for baby Kate.

Regardless, if he just handed her off without going through the legal channels, i think he should be punished beyond a year in Jail. I cannot imagine how cold you must have to be to give away a Child that you have had around for 4 months.

The fact that AC mentioned paying for a funeral makes me think Kate is no longer with us and sadly i think he is holding out in hopes they never find her. Sadly, a body so small would be easy to hide, animals would scatter her bones.

MsF- i think he knew she was his, how could he not? She looks like him. Not that it matters, the law will likely rule in his favor, he will get out in a year and Kate's case may never be solved.

I think he was scared to leave another child with AC, family members of hers have stated they felt the kids deserved better and that they knew what AC got up to, i suspect they meant drug wise. Seeing her comment on Sean's sister's FB page like they are good friends just makes me think she knows what happened and she's already over it.

I hope i am wrong, but each day i check on this and i feel like not many people care. I don't mean here, just that the media doesn't report much, the reward is really low and there's a man sitting in Jail with all the answers to where this baby girl is.

It's a sad world we live in when a perpetrators rights come before a missing child's rights.

They argued about adoption often. I'm guessing he talked to others about it. What if a friend, or a friend of a friend offered to take her, if they were concerned about the mom's parenting (for the dad to have primary custody of their older child is unusual). There might not be any written record of the conversations. And it would explain why it didn't take long for him to get rid of her, once the last attempt at adoption failed.
I wonder if LE has investigated all friends and family, and whether they've investigated any significant purchases of baby stuff around that time. If Kate is alive, he didn't take her far that day.

One thing i often think back to is a rumor i read at the start of this where a woman posted that a member of the Phillips family has a home in a remote location and she had experienced something similar with them that was resolved in the end. I just hope LE looked into that even if it was bogus. But, in the end i come back to thinking that IF someone he knew did hide her, surely they would have come forward afraid of being charged. AC must be a terrible mother for him to feel the need to hide baby Kate....what about Haley? Why hide one and not the other?

Nothing about this makes much sense.
