GUILTY MI - Katherine 'Kate' Phillips, 4 mos, Ludington, 29 June 2011 (Deceased/Not Found)

I am guessing that since the DNA test makes him safe on the kidnapping charge and there is no body his attorney probably thinks he can get him off. IMO the baby clothes in his pocket say it all.

I imagine that any plea deal would also involve giving up the location of the baby.

From the article linked:

Spaniola said the infant's mother, Ariel Courtland, “has been cooperative from the onset” of the case and continues to work with detectives. She was ruled out as a suspect early on, Spaniola said.

This is one case where I wish LE would get aggressive and force him to tell them what he did with the baby.
Also sounds like he is charged with parental kidnapping. I hope with all my heart that he gave her to someone who is taking care of her.

I really do not think she had anything to do with it. Of course I could be wrong but it's just the feeling I get when I watch her.

As for the "Dad", I think he probably killed her and that was why he had her clothes so it would be hard to spot the body. I will always hope that he gave her to a relative though.
