The DNA of blood found in six additional locations at the scene of a slain New Baltimore couple will be tested after a report indicated DNA found on one of the victims did not belong to their accused murderer, their son.

Judge Richard Caretti of Macomb County Circuit Court approved six more DNA tests from the garage where the beaten and stabbed bodies of Ronald G. and Christine Jabalee, both 58, were found in October 2006. That will be in addition to six spots already tested.

Ronald F. Jabalee, 41, of Clinton Township, is

charged with first-degree murder for the 2006 death of his parents at their residence. Jabalee was indicted last June by a circuit court grand jury.

Gail Pamukov, one of Jabalee's attorneys, told the judge there was "an enormous amount of blood" found at the scene — on the garage floor, including under a vehicle, in a vehicle wheel-well and on a garage door.

"It's all over the place," she said.

The judge's approval came after it was revealed in court Wednesday during a pretrial hearing that DNA found under the nails on the right and left hands of the male victim were a mixture of his own DNA and that of "an additional donor," according to a Michigan State Police lab report.

That provides ammunition for Jabalee's defense that another person other than him, as contended by the prosecution, may have been present at the murder scene.

"It could point to who might've been there," Pamukov remarked in court.

Presentation of the report produced a tense exchange between the judge and assistant Macomb prosecutor Steven Kaplan, who contradicted the written report handed to the judge. Kaplan said the DNA evidence was inconclusive because there was an "insufficient" amount of DNA to collect.

"I think there is an embellishment," Kaplan told the judge. "It's not as represented."

Stevens noted that police in most cases are limited to submitting three DNA samples to the crime lab but were able to gain six in this case. Caretti's court order will allow another six tests.

FBI testimony questioned in NB murder case

An FBI agent testified Friday that the person who killed a New Baltimore couple more than three years ago surprised them with the attack because he knew them.

Agent Robert Morton, an expert in crime scene assessment, testified via video hookup from Virginia that the motive for the violent slayings of Ronald G. and Christine Jabalee, both 58, at their home in 2006 was “personal cause.”

“The homicide basically occurred as a result of some conflict, either contemporaneous right then or a long-standing conflict … ending with the offender required to kill both,” Morton said at an evidentiary hearing.

old story now, but one with no link here so i thought i'd throw it up. it talks about a hair follicle that was found in ron sr's hand that is being sent out to an independent lab (not mi state police) for testing because they can run a mitochondrial dna test on it whereas msp does not do mdna testing. mdna testing is the gold standard for identifying bodies when they're completely blown apart - it was used after the twin towers collapsed and to identify soldier's remains. the only bad part is that it does not identify a specific person, instead a specific family lineage. mdna is passed from mother to child in families. so ron, ryan & nikki would all have the same mdna. so would their mother's (chris) brothers & sisters and the children of her sisters. so a positive match does NOT mean that ron is guilty, but no match shows absolutely that he NOT GUILTY. can't wait to findout the results of the test!

Thank you sad, I had not seen that story. If the results are back in six weeks, that's approximately June 11th. I imagine Ron and his Attorney's are hoping the results will indicate someone else was the killer. But, as you pointed out, if they come back as familial MDNA, the results will not exclude him. His Attorney's will use this to create reasonable doubt for the Jury by pointing a finger at the other siblings or family members. If IRCC, the only other family member looked at in this case was Ron Sr.'s brother.

I wonder if MDNA results are kept in the nationwide DNA database? If the results are not from family, they can run the results to see if there are any matches? I'll have to research that.

Sad, I think you are either a local or know a few of the Jabalee family members.
How is Ron Jr. doing? Has the business suffered with all this? Are Ryan, Nikki and the other family members supportive of Ron Jr and believe in his innocence?

in it it tells how presecutors plan to appeal the judge's ruling of not allowing the FBI profiler to testify that the crime was committed by someone who knew/was familiar with the jabalee. but what really surprized me was the defense's withdrawl of the request for the mDNA. they site high cost & minimal value which sounds like crap to me. 1) they would have looked into the cost to have Ron agree to the testing before putting the request in & 2) the value would only be minimal if a family member with the same mDNA were the one who committed the crime. so why the change of heart now? mDNA requires only the tiniest bit of DNA and is very accurate. a negitive match would exclude him 100% unless the prosecution then changed their theory & said more than 1 person was involved. right now they say it was Ron & Ron alone. would be interesting to hear from Ron's family again to get their take on this baffeling move.

to knox - i no longer keep in touch with the family since moving and don't have an answer to your question. was just around when all of this happened & before so am very interested in the outcome.

Hi Sad,

I agree, the move to withdraw the Mitochondrial DNA test motion is strange. Seems like his attorney's would have thought of all the possible repercussions prior to making the request, now they look foolish. The expense of testing is a pittance in comparison with a guilty verdict.

When I first thought about the testing, I felt even if it resulted in a match to Ron, it could have created reasonable doubt in the jury's mind. But to do so, Ron would have to agree to throw his siblings under the bus. The defense on the other hand, would have a field day with a match.

Here's a thought; the issue of the hair is going to be far more valuable in his upcoming trial as an unknown variable, than an absolute ...

Mount Clemens -- Macomb County prosecutors have lost an attempt to allow an FBI expert to testify at the murder trial of Ronald F. Jabalee.

The state Court of Appeals has refused to hear prosecutors' appeal of a circuit court judge's decision to bar the expert's testimony.

The appeals court released the order Wednesday, noting only that prosecutors "failed to persuade the court of the need for immediate appellate review."

if you look at the video of the 1st 2 days of trial on wxyz - that is the ron i knew. not the crazy, cracked-out on painkillers guy that everyone likes to post pic's of, but the well groomed, sweet family guy who worked hard and thought family was everything. interesting that on the 1st day of testimony you get 2 very different pic's of ron on the day his parents were found. 1 from j. pollito that sheds him in a negative light, and the other from rosie who actually talked to him & saw him that day that show's a more accurate pic of how he was. i should know, i was working down there & saw him too. he was shocked & devastated - some cracked-out killer can't fake that. will be watching for more testimony. any family out there care to weigh in?

From what I have seen so far there is more evidence Ron Jr. didn't do this crime. He would have been covered in blood and most likely he would have had wounds on himself from the knife slipping, his behavior afterwards don't surprise me. He had a lot going on, now with his father not there to lean on I think he was trying to keep it together, but the drugs, lack of sleep was just over whelmed him. I have seen people do and act many strange ways after losing a loved one. JMO but I will have to see much more to think he is guilty. I feel bad he has to be going through all this, I can't imagine being charged with the deaths of my parents.

With the amount of injuries this couple had, I think there should have been two suspects. They had multiple blows to the head and multiple stab wounds. I just can't see one person wailing a bat/or object and a knife at the same time. Plus wasn't there two knifes missing?
