I think it is fairly safe to say that if hubby's alibi holds up the grandparents can kiss those kids goodbye forever.

Nope. Not the case in Michigan, which was at the forefront of developing Grandparents' Rights in the US.

Because Michigan courts are currently handling custody matters of the children, Larry and Therese McComb are pretty much guaranteed at the very least visitation under current Michigan statute:

This new law provides the safeguards required by the Michigan Supreme Court, which would protect parental rights, as guaranteed by the Constitution, while setting in place standards for grandparents who have been denied seeing their grandchildren and gives them an opportunity to come to court and show why they should have a right to see their grandchildren, if that request has been unreasonably denied.

Standing

The new law provides grandparents, in the following circumstances, rights
to request relief from the courts to see their grandchildren, if they have
been denied visitation by a parent:

1. If there is a divorce, separate maintenance, or annulment action pending
between the child's parents, or such an action has already been finalized.

2. The grandchild was born out-of-wedlock and the parents are not living
together. However, this only applies, to grandparents of the alleged father
if he has been declared legally to be the father of the child by a proper
court proceeding and the child's father provides child support in
accordance with his ability to provide support or care for his child.

3. Legal custody of the child has been given to a person other than the
child's parent or the child does not live in the parent's home (other than a
child who has been adopted by a person who is not the child's stepparent).

4. A grandparent has taken care of a grandchild during the year before they
request visitation, whether or not they have done so by a valid court order.

5. The child’s parent, who is a child of the grandparent, is deceased.


A hearing will be granted on a grandparent's request in the circuit
court/family division assigned to the case. At the hearing, the court will
presume that a "fit" parent's decision to deny a grandparent visitation
request does not create harm to the child (mental, physical or emotional
health). The grandparent who is requesting visitation has the duty to show
the court by a preponderance of the evidence (51% or more) that the
parent's decision to deny visitation to the grandparent does create harm,
either mental, physical, or to the emotional health, of the child. If the
grandparent does not prove this to the court, by a preponderance of proof,
the court will dismiss the grandparent's petition. But, if the court is
convinced that the denial of visitation has the potential to create a risk of
harm either to the physical, mental or emotional health of the child, then
the court will follow a set of factors in determining what amount of
grandparent visitation would be in the child's best interest.

After watching NG, I was surprised to hear LM say that he had not spoke to the neighbor that had reported seeing the man crouching next to the pickup truck. IIRC, he said he wasn't sure if it was the neighbor across the street or the neighbor up the road. So, obviously he doesn't know which neighbor it is but wouldn't you try to find out?



I'm in no way knocking LM who is a grieving father obviously but more surprised that they wouldn't have knocked on doors wanting to know the exact details from the neighbor or show the neighbor a picture of the son-in-law. They are better people than I am by letting law enforcement do their job and not interfering. His statement just surprised me a little. Did anyone else catch that?


(I'm still praying for Phuong's safety. I want her to be found but not this way.)

Has it been posted on here that there was blood found in the vehicles of the ex - husband?

I totally get you. I would have wanted to talk to the person, too--and I'd have wanted to talk to the police after the K9s searched my property, too.

Maybe they are completely overwhelmed with trying to keep the girls safe. I really hope that police in NN are keeping DS under surveillance so that he can't try to return to CT to take the girls. Even if it's irrational to worry about it, if I were the McCombs, that thought would occupy my every waking minute--the very few that I'd be getting were my daughter missing.

Nothing like that has been posted... only that the warrant to search the vehicles stated that LE would be looking for blood and such. And a tarp.

What will happen to the children now that Mom is missing? Does DS petition the court for custody immediately? At what point do the grandparents have to petition for temporary custody?

With the key witness to the court allegations missing, I worry about who will end up with the little girls. This poor family. The sad thing is that this is only just begun.

Breaking news! Apparent blood stains found in both vehicles belonging to the estranged husband of a Michigan mom abducted when she went to the mailbox in her pajamas to post a letter!

I wonder if the tarp wrapper they found had the UPC code on it. If so, it would hopefully match the number on the receipt.

Well a receipt for a shovel, thats it, you don't need a shovel when you live on the 9th floor of an apt building and you certainly don't need one to deliver food.
The guy is really a fool for saving a receipt. He's done, burned by his own ignorance and self-centered attitude.

Now this is more like the evidence we've been hoping to hear about this whole time. Hopefully they make an arrest soon.

Wow, really. This guy apparently wants to get caught so bad he may as well have video taped the murder and uploaded it to youtube. Could be deer blood, blood from bloody noses, etc too. I don't think he'd lend his vehicle to someone to do the dirty deed, one of the perks of having someone else off your ex would be that the evidence would be in their vehicle.
He had time to get rid of that stuff, though, so why didn't he? Guess murder makes your brains fall out.
