I agree TGI, that's our job as parents/grandparents/aunts/uncles/(family in general) to keep the children in our lives safe at any measure.

I can't fault these grandparents for wanting to keep those girls safe. I think they believe 100% DS either killed VS or has her somewhere. They believe he already got their child, and they want to protect those grandbabies from him.

Terry Evans, St. Joseph County Juvenile Court director, said a hearing has been scheduled for Friday on a child neglect petition filed by St. Joseph County Child Protective Services.

St. Joseph County Prosecutor John McDonough said he will represent DHS Child Protective Services at the hearing on Friday.

A juvenile court referee is scheduled to determine if a child neglect petition should be authorized.

If the petition is approved, it begins the process for DHS, under the court’s jurisdiction, to assume legal responsibility for the children and decide who will have at least temporary custody.

McDonough said Monday that he will recommend Douglas Stewart not be granted custody of the two girls “for pretty obvious reasons.”

“We don’t have any idea where Venus Stewart is and he’s the only person of interest in the case,” McDonough said.

I'm not sure I understand this. Who is the neglect petition against? Or is it just a general "mom's missing, dad's a POI, nobody has official temp custody right now since mom's missing, we - DHS - better do something" petition?

Sounds like it's against Doug Stewart, since McDonough (DHS lawyer) is saying that he recommends that Doug not have the children.

Or it may be a legal maneuver to remove the children from Venus' custody to place them in the legal custody of Venus' parents. I hate even typing this, but maybe since she's missing, the kids are considered "neglected" and a new custody hearing has to be held to figure out where to place them. I'm so glad to read that DHS lawyer doesn't want the children with Doug. Am hoping the judge agrees.

ETA: OOPS! Didn't mean to doop. I see everyone has the same idea. *palm to forehead* I'll read ahead before replying next time.

It is my opinion the State of Michigan aka children's services, is stepping in to counteract Doug's petition for full legal, full physical custody of the girls.

Why do I say this? Because of the timing. Doug files so they file.

Up until now, the State of Michigan had no problem with the girl's being in the custody of Venus's parents.

Let's just hope they don't put the girls into foster care to hide their whereabouts from Doug but rather place them with Venus's parents.

The neglect charges would be against Venus who had temporary custody of the girls, both physical and legal, because she has abandoned the children.

The State of Michigan is fully aware of the circumstances surrounding Venus's disappearance but need legitimate reason to petition the court that the girls be made wards of the state.

It is clear they don't want the girls with Doug and are doing everything possible to make certain that doesn't happen.

Furthermore, they are saving Venus's parents legal fees because they won't have to file for guardianship or custody. So, they are apparently doing them a service out of the goodness of their hearts. JMO

As they agonize over the whereabouts of their daughter, the McCombs have accepted even unconventional offers of help.

“We’ve had calls from psychics and they’ve come to the house saying they can help find her,” Larry McComb said. “I gave one of them one of her shirts and another one took a Walmart card she had.”

But still there’s been no resolution.

I don't think so. The state would have had to do something about it, Venus is a missing person and the grandparents had no legal standing, that left the children in limbo as far as the law was concerned. They couldn't have allowed that situation to continue indefinitely. Also, because of the implicit allegations against the father it would be foolish to allow him custody at this point, so the state needs to act on behalf of the children.

Given the contentious nature of the current relationship between the father and the grandparents I think having the state assume tempory guardianship of the kids until all of this is resolved wouldn't be a bad thing, at the very least it would force the parties involved to at least be civil to each other in the presence of the children (because it sure as hell doesn't look like that is happening right now).

I have a six-foot wood privacy fence around my backyard, and a 65 pound dog who loves kids, friends and family, but sounds vicious enough when strangers come around. Most of the homes in my neighborhood have high fences and dogs, and there are probably a few with security cameras, but I've never looked for them. I would bet that most of them have at least one gun, for hunting or personal protection as well. I happen to have a husband in LE, so the gun is a given.

With today's technology, security cameras can be very inconspicuous. They are "everywhere", and go largely unnoticed. I think that it would be possible to make a home relatively secure without making it look like a prison. Think about school playgrounds and daycare centers. Kids feel safe in those places. Security measures can be reassuring.

If the grandparents present the added security measures as a matter of being safer and secure, rather than scared and hiding, I think the kids will be reassured and empowered. I know I would feel very protected if my grandpa had a gun and was willing to do whatever it took to protect me.

Calm and prepared, that's the way to live, IMO.

I'm originally from South Africa. Nowdays things like high walls, razor wire, electrified fences, private security, dogs and all those sorts of things are normal there, but they don't protect you. If someone wants to get in and possibly hurt you, they are going to do it. Those measures make you feel safe, but it's a false sense of security. In a way you kind of build your own prison.

The best defence is alert and proactive neighbors, but of course, finding those can be a little tricky.

My heart goes out to her parents - they must be exhausted and about to tear their hair out by now. And the poor innocent children. This case is tragic on all levels. moo

At this point, they know if it was a blood stain and whose it is. There must not be enough to indicate she is no longer alive, hence the additional testing....or, it is not hers. I dont think, if I am SPECULATING, he shot her in the car. If he took her and killed her. IF.

Maybe stabbed her? Messy. Knocked her out first? IF she is deceased that is.

I hope she is not.

One of the most recent articles on May 22 said LE was still waiting for the blood stain test. I was surprised.

Police were still awaiting laboratory results on a substance found in the pick-up truck that appeared to be blood, Risko said. The substance was found on one of the truck's doors.

Thanks Bean...I think that there is a certain amount of wiggle room in that statement. They might be waiting to see if the substance contained tissue and what kind of tissue it might be. DS or whomever may have treated the stain with something that diluted it or made it difficut to determine quantity....I still believe that they know whose blood it is or at least whether or not it is Venus'. Do they have to wait in line behind all of Detroit's many violent crimes for CSI results, I wonder? Some of this seems to be taking an awfully long time...I think it was around May 5th when they first examined the vehicles...it is now May 26...I cannot understand how a crime with a possible living victim could take so long to invesitigate...

Police search Leonidas Township home of Douglas Stewart's parents in missing-person investigation of Venus Stewart
May 26, 2010, 10:56AM

http://www.mlive.com/news/kalamazoo/index.ssf/2010/05/police_search_leonidas_townshi.html

Police served a search warrant last week at the St. Joseph County home and farm of Douglas Stewart’s parents, authorities said.

Michigan State Police investigators seized “some items” during the search Friday but did not find Stewart’s wife, 32-year-old Venus Stewart who has been missing since April 26, Lt. Mike Risko said Wednesday.

Risko declined to say what, or how many, items police seized from Douglas Stewart’s parents home, which is located in the 50100 block of Fulton Road in Leonidas Township.

Risko said Wednesday that Stewart, who recently resided in Newport News, Va., is currently staying at his parents’ residence.

Risko said Wednesday that Douglas Stewart, 29, remains the sole person of interest in his wife’s apparent abduction and police are still awaiting the results of lab analysis that is being conducted on suspected blood that was found in a Dodge pickup truck and a Mercury Sable that belong to Douglas Stewart.

snip

In addition to waiting on results from the state police crime lab, Risko said police also are still trying to transport the pickup truck back to Michigan to get a closer look at the vehicle’s tires. The move is part of an attempt to confirm whether the tires on the truck match tire treads that were found at the scene of Venus Stewart’s disappearance.

Hopefully someone can get hold of the search warrant and make the documents available online for viewing. I'm surprised the author of this article didn't make more of an effort to discover what items were seized during the search.

Let's not forget the Chandra Levy case. Perhaps Venus was being watched by someone else and taken by a stranger or neighbor. I am just thinking outside the box, had he hired someone to kill her, I feel this person would have cracked or given something up - something would have linked to a payment or someone would have bragged. And if it was him can we all agree the drive would have been long and the cover up disposal of her body would have had to come after his return home?

What is the hold-up on transporting that truck??? I don't get it...I hope they have it by now and just are not saying...if DS did this, he sure got that truck up and back pretty darned quickly...

I am absolutely flabbergasted that they still have not gotten the truck in spite of having had the search warrant since May 5th! It's 3 weeks today. Are they waiting for a flatbed sale at the local U-haul? TM already said the blood in the truck is from DS. I was wondering how she knew that and it could be that the bloody nose DS got was while he was driving. She did say that LE told her it was DS's, so I think they may have ran a preliminary test on it and it matches DS's blood type. My guess is it's the Mercury that will have VS's blood in it. Moo

Here's what I saw that TM said about the blood. She doesn't specify who she heard it from.

Venus's mother says she heard about what police found.

"I heard that they found blood stains, but they were Douglas's and not Venus's."
