The prosecution would therefore need to corrobrate what Spencer is claiming, and for that they would need evidence that she is dead and that DS was at the scene.

Here is all the jury will need to find Doug guilty of premeditated murder:

1.) The Walmart receipt for the hat, gloves, tarp and shovel dated the day before Venus disappeared;

2.) Expert testimony from an expert witness whose field is tire tread forensics;

3.) Ricky Spencer's testimony

4.) The transcription of the tape recording in which Doug Stewart stated he could use his father's .357 magnum to solve his problem with Venus;

5.) The fact Venus is nowhere to be found and there has been no bank account activity;

6.) The tarp cover with the fingerprints of the Walmart clerk who rang up the sale and/or Doug's fingerprints on it;

7.) The Walmart security video of Doug purchasing the hat, gloves, tarp and shovel;

8.) Etc. Etc. Etc. :woohoo:

It will be different in trial. Spencer will be vigorously cross-examined, the defence will attack his version of events, so the prosecution would need to corroborate. They still have to prove that she is dead/kidnapped and be able to place him at the scene.

You are concerned that no tears were shed and that indicates a lack of remorse, but it could equally well indicate that the story was made up for reasons unknown. The prosecution would therefore need to corrobrate what Spencer is claiming, and for that they would need evidence that she is dead and that DS was at the scene.

So you are saying that RS did not impersonate DS? That DS was not impersonated in VA??

The elephant in the room was the alibi DS created using an imposter. Right or wrong, I am willing to bet that it will hold an incredible amount of weight in the end. (Not unlike the 31 days that passed in the Casey Anthony case)-Sure a good defense team can pick away at details small and large, but if they cannot explain away the reason why DS would choose to exchange id info with RS and have RS be seen around town at the ATM and paying bills, well then much of their hard work will be for nothing. JMO.

They do not need evidence that Venus is dead actually if they can prove beyond a reasonable doubt that the circumstances preclude her being alive.

The standard of proof will be higher in the trial. Yup. The prosecution now has some time to try and find her.

What a horrible, horrible story this is.

If Doug didn't murder Venus, why isn't his family pleading with the public to help find her or for Venus to come home, now that Doug is locked up on a 4 million dollar bond!

That in itself is the icing on the cake, the proof in the pudding!

And if Doug had nothing to do with her disappearance, why wasn't he looking for her?

I don't think you should accuse Natal of that, Natal has been following this case from the beginning and makes very clear, concise and well-thought out points.

So...

If I robbed a bank and then some gangster got word I was bragging about it and had me gunned down so his posse could go get the cash from my house...I am the murder victim right? But I'm still also a bank robber aren't I? Had I not bragged about it, I would likely not be dead. Had I not robbed a bank, I would likely not be dead. However, here I am...dead, not my fault...I am scared of gangsters, I know that bank robbing is wrong, it's no excuse for what was done to me, but it is relevant.
I've also followed this case from the beginning and I can say with 100% certainty that VS did nothing to cause this murder.

Oh my dear loving God. And this guy went along with this? Why??? Oh my God poor Venus. And those poor little girls.
And what was the justification for killing her supposed to be ~ because DS told him Venus had wiped out the bank accounts? Truly amazing what people will agree to go along with. :furious: MOO

But what do the Ds matter in the grand scheme of things?
She's dead, he killed her.
I'd say his report card looks worse than hers could ever look if you want to "grade" their actions.

I'm really hoping this thread does not continue down this path of digging up and judgeing the victim's past actions.

WS is a victim friendly forum. Speaking ill of the dead victim is not very victim friendly.

Whatever Venus did in life does not make it "ok" for DS to have murdered her.

Gotta wonder why he didn't feel the court system wouldn't handle the matter appropriately. But he made the decision to be judge, jury and executioner. That's not how we roll.

This was one of the bomb shells today for me.

Yikes! I missed that. Wow. It's amazing (and frightening!) how easily people can be manipulated to believe a killer.

I wonder why they have not had earthmoving equipment out to that farm. I would dig up the whole frikken thing.

April 26 the fields would be bare. Planting soon after. Nice hiding place in plain sight.

Especially in light of the testimony that Dad knew the plan.

I agree with you. It's not ok at all. Nobody is saying that what he did is "ok". Did someone say that? Please let me know where someone says what DS did is "ok". Thanks!

This was a strange deal. RS was telling the story about Doug and his conversation. A conversation that took place after Doug allegedly killed Venus. RS said something like "now that you killed your wife are you going to kill me; because that would really suck". One of the women in the front row erupted in laughter. This was a tense situation.
