I don't know which link has the SW's that aren't deleted, so I'm going to ask if one of you know how the verbage read in referance to the seapon. It was _________ and other items . . . It was strange wording I thought and a reason for it. Hey Paula thinks they have that weapon, but I don't figure that yet. I know these items listed in the first paragraph were things to look for and not things they had found.

Merci
Scandi,

In the 11/4 warrant for the SUV it reads " weapons and/or blunt objects that could be used as weapons"

In the 11/3 warrant for Birchleaf it reads " instruments or items used to cause the death of the victim"

Is this what you are looking for ?

I'm not totally sold on the mag lite being the weapon or the only weapon - in my mind it simply does not "measure up" - HMO of course. I'm also holding off on the conspiracy issue for a bit yet as we really have no clue at what point this investigation is at yet. Perhaps you could ask Mr. Crump if there are other returned warrants that can be obtained that demonstrate someone other than JY as being the focal point or even remotely considered as such in the probable cause sections.

I can understand with holding such warrants if there is someone else involved, however, I cannot see why the media was so quick to release only the warrants focused on JY as well as a copy of the NTO. I ques I have missed the other clues pointing to someone else. Considering this will indubitably be a death penalty case, lab backlogs, uncooperative persons and lawyers involved, 3 months does not seem very long to me at all. HMO
I was just reporting what this reporter told me from his sources "close to the case". Ed has been around the block a few times around here, so I think his sources are good. I doubt there are any warrants looking at anyone else of interest because I do not think they have any idea who that person is at this point. In fact, I am being interviewed Tuesday by LE since I viewed the autopsy photos. They are turning over every stone to solve this case/

That's it Charlie. Thanks for both SW's as I hadn't caught the one from the 14th.

If they thought the wounds were from a flashlight, and a maglite one to boot because of the gnurl marks the coroner would have noted to them, they could have thought it was a FL he would keep in his car.

How do you interpret 'instrements or items'?

RPD stated the shoulder wound was very graphic, and I took from that the disturbances to the skin were specific enough to where you could match a weapon to it. So they might have had a good idea right away what the weapon could be like Hey Paula has said and wanted the right to look for it, whatever it was.

Charlie, Since LE thought the weapon might be metal as they asked for that test, is there any tool about the same size and weight as that 3 battery maglight that would be metal that JY would use in his hiking over by Duffield? There is a reason they asked for that metal test, and the only metal I have seen on a maglight is inside the rim edge of the light part. It was an older Maglight. Maybe they found shattered glass on the floor that could be matched forensicly to a flashlight if that was used.

Items. You stated you thought there might be something else the perp used besides a weapon. What were you thinking of?

I don't doubt your source, I was questioning if the theory is JY hired someone, why did the press feel it was wise to release the warrants and NTO which point so obviously at Jy. Doesn't seem quite fair to me.

Scandi,

Sami told me this - with a very bloody head as Michelle would have had - would LE and the ME exclude doing a radiograph ? There could have been a bullet in there for all they knew at the time. So I think it might be SOP given the condition she was found in. With that in mind, it doesn't mean to me that the weapon was metal but it could have been.

Instruments in my mind mean anything that could have been consistent with the wounds to Michelle - a tool could work (would have to be grease free unless grease was recovered from her hair or wounds and not noted in the the AR as being collected). A fireplace poker could be used as an instrument, so could a lamp. The shoulder wound could well provide some insight into the instrument. As to the flashlight - I do believe there is a distinct possiblity if the torch end was used - given the force - the lens may well have broken. MagLites are shock proof but that doesn't mean they cannot be broken, especially the lens covers. JMO from having broken one.

Makes perfect sense to me Charlie. That Sami, she's gooooood! LOL I hadn't even thought of a bullet because I knew a gun wasn't used - learning it after the fact.

Our poster 5s brought up the fact there would have been another report from tecnhicians at the scene and what they found. I am surprised this report has not been made public like the AR. Maybe our resident Sheriff Barney has inquired about that. I still laugh every time I read that name here. What a guy he was.

We still don't know if Baden interpreted the drawings correctly to really have meant gnurling from the weapon and not just shading. I think I'll email that question to Greta for when she has him on.

Off to bed to watch the pre-game festivities. :woohoo: Gotta tell you Charlie, that Airborne works wonders when you have a cold. I'm 50% better, shooting for 100% by tomorrow! :D

Yes - that Sami girl is smart and I am glad she is here to keep us in line ! Yes the other reports, I knew there had to be additional supporting documents to the AR, as you know in the Vitale case these reports were released with the AR, which is why I questioned the completeness of this one. Must be a jurisdicational thing about what gets released and what does not. No biggie.

As to Dr. Baden, in his defense - he looked to me like he had just walked into the studio and had zero time to actually review the AR before he was questioned. I simply do not think he was properly prepared and as we all know - the TH's could care less and are sometimes even less prepared than their quests. I wish someone would pursue this issue of the machine that was brought in - still want to know what it is.

Enjoy the game Scandi - stay warm and I am glad you are feeling better !

Scandi

The scene report has too much evidence like TOD and the subjective opinions of the ME based on the body position, ect.

I saw Dr Baden and he seemed poorly prepared. One can't go on the sketches for much , as they had very little detail to show bruising or other skin damage. These all come into focus when you actually see the photos. However, I do think he got the murder weapon correct.....a flash light.

Sami,

Since you are well versed and obviously skilled with things audio, a few questions for you if and when you have time. Since it has been reported that:

JY left a voice mail for Meredith about picking up whatever it was;

and there are rumors swirling that JY tried to call Michelle twice on Friday morning;

and an answering machine was taken from the home;

and other phones have been confiscated and analyzed for voicemail;

1. Can the voice mail left for Meredith (if recovered) be analyzed for stress levels (not sure that is the correct terminology but I know you know where I'm going)?

2. If Jy left any messages on the home machine - could the same be done ?

3. Could these voice samples be compared for variation against voicemails or messages left with anyone and occuring prior to the murder?

4. Under the NTO - what are the possibilites that LE recorded the activities and could this be used for comparison or would a specific voice sample be required ?

TIA
This one is best answered with a link that explains what can be done. These guys are independants.

http://www.audiorestoration.com/id.html

That helps to KISS for me, so I don't waffle on and it keeps the post short, lol :)

4: If the event was recorded on video, it would be so that no claims of 'force during the examination' would be able to be brought up later on if Jason ends up the subject of a trial.

The best voice sample for comparison would be to have him repeat the voice messages and record it, then compare....but as he is not talking....

Sami,

Thanks luv - amazing stuff. Did you notice in the NTO - second page under the section Evidence to be collected at CCBI:

"During the period of your appearance you will not be subject to interrogation or asked to make any testimonial statement except that required for voice identification".

Looks to me like he was pretty much required to make some required vocal passages for the purpose of voice identification at a minimum and looking at the link provided - voice quality relating to stress is a distinct possiblity. So I reckon there is a good possibility that LE has identified and/or verified the voice mail from JY to MF and may possibly have concluded the quality of same. Hoooo doggie ! Wonder if the phone conversation he had with LE was also recorded ? Hope so...bet the NTO procedure was a s well.

ETA - and then there were also messages noted on the answering machine from the bedroom that was taken under warrant. hmmmmmmmmmmmmm.

Otto,

Thanks for your offer to do a maglite for me :)

I'd appreciate it and if the Max progam stuff isn't compatible with my program my son is working on 'plugins' to enable me to use some stuff from other programs online.

He's working over time as I asked him if he can make a plugin where I can record the 3d models into like a video as I move them around but he is not sure if he can do it....but he's certainly trying. If all the swearing and grunting is anything to go by, lol. If he is able to do it, I'll be able to load the videos on the web somewhere, but it took him a few years to complete this program so I don't know how long that would take him to do if he can do it.

Hugs

If we can import the model into 3d max, I can easily make it into a video with full movement - depending on what you have in mind. In fact, if you let me know what the extension format on the model is, I can check right now and may be able to import it into max and animate it for you. You can have a look at the software here: http://usa.autodesk.com/adsk/servlet/index?siteID=123112&id=5972446 and see what you think.

With the maglight, if you have a visual ... online image, I'll duplicate it. Also, the file extension matters again so I know what to export it as ... so you can import it on your end.

Thanks Otto,

I had a look at the program, thanks :)

I asked my son and he said that the file extensions are .iu with import extensions .xoi and .iux

He downloaded a trial version of a program called Daz 3d and bought some of their plugins. He is having trouble creating extensions for me to be able to import and use some of their plugins, which is a big drats for me as I was watching him using the Daz program and it's great and similar to what he did. He got a hammer for me and when I imported it into his program it came up as a big blob with a circular handle, lmao...my kind of hammer :)

I'll work on it tonight and see how I go. RC gave me the maglite website so I've got plenty of dimensions to put in, the just have to scale them down to suit the model size.

Oooh, my wonderful son just yelled out that the Daz3D program should do what I want! Kiss my credit card credit goodbye!

RPD You have me in fits of laughter now, lol.

I looked at all the pics and didn't notice that the bottom one was your 'sig', so I cracked up laughing when Barney popped up :lol:

I won't be able to use the pics but thanks anyway. To make a 3D model with my program it has to be done by making a 3D 'cage' first then covering it with a 'skin'. We've decided to make the maglite semi transparent so that I can see through it at the injury sites.

My son (gawd I luv him) is making a hammer, a mallet, a lamp, a baseball bat and a candlestick holder on his computer so I can import them later. He said that if anyone thinks of any other weapons he'll make them for me too. I'll have to start paying him for this soon as this is going to take days of work and is putting his game programming on hold.

And now for my favourite quote from Shrek.....

Imports can definitely sometimes go insane - I think it's because all the parts map into the origin (xyz) instead of where they belong. I checked the export extensions for max and none of the extensions match. I'm just checking rhino 3d to see if that works ... nope. I sent you a couple of stills of the 3d model.

Looking forward to seeing it come together.
