What County is Anderson being prosecuted in? I looked up the case in Cass County, but all I find are closed traffic convictions.

Ugh. I just finished following a California case where a woman claimed that her intense meth use created a psychotic break that resulted in the death of her baby (Justice Rees). Thankfully the jury found her guilty of murder anyway. The judge warned pretrial that intoxication is not an acceptable defense yet her lawyers still went ahead with the claim.

IMO it's time to get rid of all intoxication-related defense claims, including drunks killing people with their cars. And frankly, in Alayna's case if Anderson is mentally deficient then why has no one reported any odd behavior in the past? He was staying over at his victim's house FGS and interacting with her parents.

Ooh, I'm so mad. :furious:

He doesn't have a defensible position, so this is what his attorney has to work with. Anderson better enjoy his two years or so in county jail. Then it's off to State prison for the rest of his life. No jury would ever give him less than LWOP.

The man accused of the murder of 5-year-old Alayna Jeanne Ertl on Wednesday asked a judge to dismiss the charge.

Zachary Todd Anderson, 26, Coon Rapids, appeared in Cass County District Court in Walker with his public defender for a contested omnibus hearing in front of Judge Jana M. Austad. A contested omnibus hearing is a pretrial hearing dealing with admissibility of evidence where the judge decides whether the case proceeds to trial, as stated under the Minnesota Court Rules.

Anderson's public defender, Scott Collins of Thief River Falls, filed a motion March 24 asking the judge to dismiss murder charges against Anderson, suppress evidence gathered during the investigation or move his trial to another county.

In October, Anderson was indicted by a Cass County District Court grand jury and arraigned on 19 criminal charges, including eight counts of first-degree murder, one count of second-degree intentional murder, four counts of kidnapping, two counts of first-degree criminal sexual conduct, one count of second-degree criminal sexual conduct, one count of theft of a vehicle and two counts of interference with a dead body.

Collins asked the judge to dismiss the indictment against Anderson on the grounds that there is insufficient probable cause to indict Anderson, alleging that his constitutional rights were violated by authorities after he was arrested. In the court document, Collins argued that Anderson did not wish to provide a statement to investigators and he had not waived his rights to remain silent.

Cass County Attorney Christopher Strandlie, who is prosecuting the case, stated motions were heard at the hearing and briefs are due by May 10. He stated the judge will then issue an order sometime after that.

The defense also asked the judge in its motion to move the case out of Walker, stating Anderson would not receive a fair and impartial Cass County jury to hear the case against him.

First, it astonishes me when creeps like this plead 'not guilty'. Then, really raises my blood pressure when their attorney tries to get evidence suppressed on a bs technicality.

This &%$#* took Alayna from her home. Drove her to his Dad's cabin, raped, then killed her, and hid her body. He felt so bad, he was going to kill himself. But couldn't get the job done.

Why won't these killers just plead guilty? Families suffer an average of two-three years, while these cases wind their way through the system heading to trial. It just isn't right ...

He should be shown no mercy. He certainly didn't show little Alayna or her family any. Those photos of her devastated parents and brother at her funeral have stayed with me.

'Zachary Todd Anderson was scheduled to appear Friday in a Cass County District Courtroom in Walker for a pre-trial hearing in front of Judge Jana M. Austad. Instead he entered a plea of guilt to first-degree murder involving first-degree criminal sexual conduct with sexual penetration.

Cass County Attorney Benjamin Lindstrom, who prosecuted the case, said the mandatory penalty in Minnesota for this crime is imprisonment for life without the possibility of release. Anderson was sentenced immediately after entering his guilty plea.'
