I think the guy who wanted to roll George on his side might get a lighter sentence than the others.

It might get him off the aiding and abetting second degree murder charge completely, since that statement undercuts the required intent for aiding and abetting.

Charges upgraded against former Minneapolis officer Derek Chauvin in George Floyd death

Murder 2, is that you meant to kill someone. Murder 3 is that you didn't mean to kill someone, but they died.

Keep in mind though that Chauvin is charged with unintentional second degree murder committed during the commission of another felony.

Too be honest, whether Chauvin gets convicted for third degree murder or unintentional second degree murder won't matter for sentencing, since the sentencing guidelines for both are the same.

http://mn.gov/msgc-stat/documents/Guidelines/2019/MinnSentencingGuidelinesCommentary.pdf

The guidelines say 150 months for someone with no priors, with a range of 128 to 180 months.

I cannot find any information at all regarding his release. This would be a travesty of justice, if true. The protesting and riots we've seen so far will look like a picnic in the park if, indeed, Officer Chauvin is no longer incarcerated. :(

My Brother was called to active Guard Duty in Baltimore the minute the Governor of MD requested their service. (He will soon be sent to the nation's capital, if the protests continue). This, IMO, would be a total slap in the face to all of the men and women risking their life and health to protect the citizens they've been called to serve. When I spoke to him earlier, he indicated that these riots are just as bad as a war zone- if not worse. The idea of harming another US citizen (if necessary) weighs heavily on his mind. He asked me to pray for all of them- the experience has been terrifying at times.

Anyway; sorry for the long post. Do you have a link you can provide? (I'd kinda like to give my Brother a heads up, if true).

This is the latest information I can find:

Derek Chauvin, fired officer charged in George Floyd's death, moved to two detention facilities in same day

[...] "Derek Chauvin, the fired Minneapolis police officer who is now charged with murder and manslaughter in the death of George Floyd, has been moved to a second detention facility in the same day. CBS station WCCO-TV reports Chauvin had previously been held at the Ramsey County Jail after being taken into custody in Minnesota".

"On Sunday afternoon, he was transferred to the Hennepin County Jail. Just hours later, he was moved to a department of corrections facility in Oak Park Heights, WCCO reported". [...]
Many thanks to your brother for his service, JDough!

I hadn't looked at the family fundraisers in a couple of days.. they have more than doubled in 2-3 days, and they are now up to $9 million.

Almost 48 hours later - Up to $12.8 million now with 467,700 donors after 7 days.

Yes, it normally is 10 percent to the bonding agent. (Money that isn't returned).

Probably safer in custody, but I bet he doesn't agree. Plus his wife has started divorce proceedings, which complicates money issues. moo

She won't have to worry about fighting him for his pension, doubt he's getting it since being fired.

MOO, isn't that how it works? You lose pension if fired for such offense?

Under TOS, I can't post the link to the court case because the case involved another officer who was not involved in George Floyd's death.
<rsbm>

You can link to the case ... just don't bring other names to the board (initials are okay).

Within the link there is a photo of the mural. I had missed a post as to the background on the mural so googled...

mural.JPG

Co-creator of George Floyd mural is an Episcopalian with a passion for social justice art - Episcopal News Service

“The sunflower represents longevity and loyalty,” Herrera said. “I wanted to use that also because it represents life.” The names of other victims of police violence – Tamir Rice, Philando Castile, Freddie Gray, Michael Brown, Breonna Taylor, to name a few – were positioned as the sunflower’s seeds. They were seeds that never got to be flowers themselves,” Herrera said.

Inside the letters of Floyd’s name are small, faceless figures in blue, raising fists for justice. The depiction of Floyd is based on a photo, and below his face are the words “I can breathe now.”

Goldman told the St. Paul Pioneer Press that she was hesitant to add those words, which were suggested by a local resident, because she didn’t want to put words in Floyd’s mouth.

“We wanted to be certain that it felt appropriate,” Goldman told the Pioneer Press. “We didn’t have any black artists in the group, and we wanted to make sure the community felt like that statement was representative.”

Another resident conducted an informal poll of people in the neighborhood, and they were overwhelmingly supportive of adding that phrase, Goldman said. Even so, the artists asked someone from the local community, not the artists, to paint those letters as the mural’s final touch last week.

“We wanted to make sure the community had the final word,” Herrera said.

Now Herrera said he and other artists are working on second mural that will be displayed on a building not far from the first.

When I think about poor George having COVID, I have to keep reminding myself that it's bad karma to wish bad karma on others, even if they are murderers. It's hard.

@mickey2942 thank you for pointing out that police officers earn far more than than their base pay. OT pay is where they make their money and it's available whenever they are needed. Answer a call during a meal break - OT. Finish paperwork - OT. Event detail - OT. Protests & Riots - all the OT they want.

Most PD offer stellar retirement options. At 20 years, 50% of their highest year and a full benefit package. As a result of committing murder, Derek Chauvin was terminated months shy of 20 years.

Chauvin's arrogance must have been over the top, when he should have tread lightly to meet that mark.

Under what situations is a pension forfeited? When fired? When convicted of a felony while on duty?

I'm wondering if he's lost his pension completely now.

Anyone know or have input? TIA

This is one of the three doctors (has 253,000 followers, he's legit) that we follow on the COVID19 thread that has chimed in (pulmonary Doctor guy, critical internist and ... forgot the other)

He goes into how much force on occlusion of artery on side of neck is needed (for those that watched wrestling in the 70's and 80's where they did this to put someone out, remember how quick it was to put someone out.. same thing but this case by knee)

@13:31 - "In looking at what happened to George Floyd, it wasn't a hanging or a strangulation, so finding facial swelling or petechail hemorrhaging would be less likely. Thankfully, there was a video in this case as without such, had it not been, there would be no chance these officers getting prison time."

He then goes into asphyxia -> loss of consciousness etc.

At 17:00, he goes into his disagreement with the ME report, and how it was incomplete as if they hadn't considered the videos at all, and didn't even list the levels of meth or fentayl. (which for us trial followers, we know that ME's should and must consider all as such in the report for conclusion, and the drug levels should have been in the report!)

ETA: I do think that it's very key also as to those filming... as all of the police body camera's were (appeared to be) pointing at a police car, or at the crowd AVOIDING MOO filming of George's distress and appearance!

Thank God for the person that continued and continued and continued to film.

While I wish Chauvin would get 1st degree murder charge, it has to be premeditated.
Exactly. Does anyone honestly think he intended to kill him? I have doubts about that, and I am as sympathetic to GF as anyone. I would be surprised you'd find 12 people on a jury who agreed it was premeditated murder.

But he knew he had no pulse.

Just to clarify because the local news is confusing - he tested positive back in April? Was he sick then and that was the reason he was tested? They are making it sound like it was a huge surprise he came up positive due to the autopsy?

Why is it going to be hard to get convictions for all 4?

That is what Morning Express is saying.

His one facial expression when he looks at the phone seems to me that he knew what he was doing was wrong.
