MN - Justine Damond, 40, fatally shot by Minneapolis LE, 15 July 2017 #3

The jury can even choose 2nd degree manslaughter as a lesser charge. The jury is an eclectic mix, I actually think Noor will be found "Guilty", with a very minimal sentence.

How Justine Ruszczyk's killer may get off
9:28am Apr 27, 2019

States have a specific statute in place, like Minnesota, that allows police officers protection that I don't have," Mr Halberg said.

"That's a statutory protection that you can kill someone if you believe it's reasonable based on fear at the time."

Noor told the court he was startled by Ms Ruszczyk tapping the top of his police car.

Earlier today, Ms Ruszczyk’s neighbours testified they heard a noise before the shooting.

Prosecution is expected to call one more witness on Monday—rebuttal, I assume. Do we know who it is? Maybe another use-of-force expert? (Just a wild guess.)
I hope there is another neighbour who didn't hear any noise before the shooting.

Btw what happened to the "sexual assault" screaming? Was that ever tracked down?

F irst if ever a trial should be seen by the public this is it...not just some reporters scattered comments and no chance to see this guy on the stand. I live near the crime scene and go by frequently...based on my reading here and a few news reports I am concerned that Noor will only get manslaughter and for me this is murder. In courts these days here there is a pro Somali bias and depending on the jury they could actually feel sorry for him. I so feel for the family that had the strength to pursue this case but am not optimistic. I would do all possible not to call police where I live based on current climate. From this case I have learned the importance of staying inside no matter how curious you are and if indeed she pounded on the car clearly out of frustration...well that sealed her fate. Probably just trying to get their attention but not smart. The prosecution does need someone very credible and close to verify that there were no sounds such as this pounding...although this would be much louder inside the car. Noor should never have been a cop and was pushed thru the training and on the street in record time because the then police chief had her quotas.
Are there any reporters tweeting from inside the courtroom? I just find after the fact reports. Thanks.

I doubt Noor will get a prison sentence because of his safety in prison.

I have found this police shooting of particular interest, because MSM has pretty much put this trial on "Mute". Haven't seen a word about this on CNN, MSNBC, whereas the shooting in Ferguson was nightly news for months on end. And there wasn't even a trial with that shooting.

I'm concerned the jury will hang and being sequestered they'll give up and return a "not guilty". moo

I love your posting and your message: i was thinking i wish there was court TV for this trial ( Court TV will start sometime in May): this trial should be seen by the public and I so agree with you that the jury might feel sorry for him: i sure don't feel sorry for him: This is a case that cries for justice and my fear is Justine will not get the justice she so deserves. This is one of the most tragic and saddest cases involving a police shooting --- she was a total innocent.

Sadly, that’s a real possibility.

I don't think so, the jury makeup is interesting, with a lot of highly educated people, an immigration officer, a doctor, those people are not usually easy to make agree with things they don't believe in...it actually surprised me that they accepted a federal officer on the jury. Usually the defense wants people like that gone.

It only takes one.......

I agree. I think the prosecution clearly proved their case.

The definition of second-degree manslaughter is: By the person's culpable negligence whereby the person creates an unreasonable risk and consciously takes chances of causing death or great bodily harm to another.

He created an unreasonable risk by shooting at someone, at close range , when he had no indicators of a threat. He noticed her pink top, he noticed her blonde hair, he did not notice a weapon and yet he consciously shot her. That's negligent IMO.

Since the slap on the car story didn't come out until 3 days later, I wouldn't give that any weight at all.

The minimum he's guilty of is 2nd degree manslaughter and I think he'll be lucky if that's the only charge he's found guilty of.

If after the rebuttal witness and closing arguments the jury gets the case by 1pm on Monday, I'd bet the farm, if I had one, on a verdict by Tuesday at the latest. Guilty.

yes just one...does anyone have a rundown on the jury...I am right here in Minneapolis but don't know too much about the jury profiles. I do know the political climate here will result in many people being upset no matter what the verdict but I think more will be outraged with a not guilty.

Well I sure hope you are right Rocco.

Respectfully Snipped from the link posted above:

The jury--12 jurors and four alternates--consists of four women and 12 men. The jury includes half-a-dozen minorities, with four born outside the U.S. including two from the Phillipines, one from Pakistan and another from Ethiopia.

Professionally, the jury includes a Minneapolis firefighter, an OB-GYN physician, a restaurant host and a Homeland Security Immigration officer.

thanks...interesting bunch...everytime I drive past that scene of the shooting I think to myself how could any police officer lucky enough to get that area for their "beat" expect an ambush. We have many areas that such a feeling would be rational...that area is just not one of them and is, in fact, far from some of the more troubled areas. I recall in reading part of Noor's background this comment "Noor also took a psychological test in 2015 that showed he disliked being around people and had difficulty confronting others. Still, a psychiatrist found Noor was “psychiatrically fit” to work as a cadet officer " Sourced...Records: Cop accused in Australian's death can't take stress

That is pretty troubling but pressure was on to keep him on track to become the first Somali officer in the 5th precinct. Obviously in retrospect he was a bad hire but I think this mentality is still alive and well.

Concern I have is jury blames some of this on the police climate in our city including their hiring policies and all the things that have come out in trial about body cams being used when they wanted but not consistently and all the bad moves made at the crime scene...will they see Noor as the victim? Could happen. For me this is far from an easy not guilty and given the lesser included charges not so sure this deliberation will be quick. Again hope I am wrong.

The prosecution has stated that the neighbor who said she heard noise before the shooting gave inconsistent statements. If true, the jury might question her testimony and not give it much weight. I really wish there had been more in depth reporting on those inconsistent statements so we knew what they were.

He better get prison time if found guilty. Both charges carry a minimum penalty of three years in prison.
