I wonder what the sentence is for 2nd degree manslaughter- might he actually be released on his date of sentencing or soon after.

Wow, a 4+ year presumptive sentence for killing Justine.

Well, I guess there is no bringing Justine back. I hope they never let this man be in a position again where he holds a weapon. It will soon be time for him to do plenty of good in this world - in honour of Justine.

It is just hitting our MSM here - hearing about it on our morning TV news. The overturning is all due to a technicality.

Essentially, if the statute said "perpetrating an act eminently dangerous to another", instead of others, this wouldn't have happened.


The court has ruled that essentially a legal technicality means that Mohamed Noor was not guilty of murder.

.....the language in the third-degree murder statute states that it applies when a defendant kills someone “by perpetrating an act eminently dangerous to others and evincing a depraved mind.”

In its ruling the court said a person’s mental state must show a “generalised indifference to human life, which cannot exist when the defendant’s conduct is directed with particularity at the person who is killed.”

I wonder how much of this was due to pressure from the Somali community. By all accounts, that's why he was hired in the first place despite being an unsuitable candidate for police work.

I've always heard that wherever Somalis are settled, all the rules have to be changed to accommodate them, and you aren't allowed to criticize them.

Mohamed Noor has recently been returned to MN prison system after being housed out of state in part due to high profile nature of case. If Judge agrees to 41 months. 2/3's time served = 27 months. Noor has already done approx 29 mos. He would walk out of custody next week.
