St. Charles quadruple murder trial pushed back due to COVID-19

ST. CHARLES COUNTY, Mo. (KMOV.com) -- The trial for Richard Emery, who is accused of murdering his girlfriend, her two children and her mother in December 2018, has been pushed back until June due to COVID-19 concerns.

St. Charles County prosecutor Tim Lohmar is seeking the death penalty in the gruesome murders of Zoe J. Kasten, 8, Jonathan Kasten, 10, Jane Moeckel, 61, and Kate Kasten, 39.

The trial was initially set for February 8 but has been pushed until June 14. The trial is expected to last three weeks. Due to the length of the trail and ongoing concerns over COVID-19, the trial has been delayed.

COVID restrictions lifting for St. Charles County court system

ST. CHARLES COUNTY, Mo. – The wait for justice is ending in St. Charles County. The courthouse has cleared the requirements to operate under Phase 3 of the Missouri Supreme Court’s COVID-19 guidelines, meaning criminal trials can again move forward.

It’s a huge step for cases the prosecutor says have been on hold for too long; at the top of the list, the death penalty case against Darren Emery.

Even with the courthouse open again, his trial has been delayed again.

“With the uncertainty, COVID, and how things may transpire in the future, we couldn’t risk starting a four-week trial now at this point in the calendar year,” Lohmar said. “So, we pushed that out until June; again, just delayed. But unfortunately, it’s a necessity right now.”

The trial was pushed back previously. It was initially set for February 8, 2020 then pushed to June 14. Now, a jury trial is set for Jan. 10, 2022. The trial is expected to last three weeks.

St. Charles County quadruple murder case postponed after public defender's death

ST. CHARLES COUNTY — A quadruple murder trial set to begin next week in St. Charles County was postponed Tuesday until September because of the recent sudden death of one of the defendant's public defenders.

A judge granted Richard Emery's request to delay the trial because of the Dec. 15 death of Emery's public defender, Charles D. Hoskins, according to Leslie Knight, a spokeswoman for the St. Charles County Prosecuting Attorney's Office.

Jury selection in Emery's death penalty trial was scheduled to begin before Circuit Judge Michael Fagras. The trial was continued to Sept. 6, Knight said.

In November, the court sealed Emery's case and docket ahead of the January trial date, making them publicly inaccessible in Case.Net, the state's online courts database. It was not immediately clear if the judge would unseal the case until closer to the new trial date.

No bond. DA will seek DP.
Trial was set to begin 2/8/21 continued to 6/14/21 continued to 1/10/22 & rescheduled due to death of public defender to 9/6/22 with jury selection. (expected to last 3 weeks).

I can't find his case number or any case with his name and date of crime on it. Not sure what has happened.

Well - let's see - at the last hearing 1/4/22 - His lawyers were planning to present a diminished capacity defense & it wasn't immediately know if the Judge would okay the new trial date of 9/6/22. Also in my notes: the court sealed Emery's case & docket ahead of the Jan. trial date making them publicly inaccessible in Case.Net - maybe that is why you can't find anything. Darn!! :(

But thanks for taking the time to look! Guess I'll just go ahead & put him on 9/6/22 for his trial date.
