Therein lies the problem. Once details emerged, the "gentle giant strolling home to grandmas" narrative fell apart.

So I had a random thought last night...after everyone went to bed, or put another way, after the thread closed for the night

I'm imagining that when we hear the evidence of this investigation, the tox screen results will be a big point of contention again.

Many who feel that the shooting is unjustified b/c the "MB wouldn't have acted that way," defense will be utilized as a way of illustrating that OW is guilty. We've already heard comments such as "why would he attack the cop," and "why would he run/charge toward an armed office" etc., etc.

Last night I thought, wait a minute, we know he had at a minimum pot in his system...and i immediately thought of Kevin Ward's seemingly crazy, inexplicable behavior on the track that led to his death.

Kevin Ward Jr. had enough marijuana in his system to influence his actions the night he was killed in a sprint-car accident with Tony Stewart, according to the district attorney who handled the case.

The 20-year-old Ward was killed when he was struck by Stewart’s car during an Empire Super Sprints race Aug. 9 at Canandaigua (N.Y.) Motorsports Park. Ward had gotten out of his car after a wreck, walked onto the track and was approaching Stewart's car when he was struck and killed.

“There is toxicology evidence in the case relating to Kevin Ward that actually indicated that at time of operation he was under the influence of marijuana,” District Attorney Michael Tantillo said during a news conference Wednesday afternoon.

“The levels that were determined were enough to impair judgment,” Tantillo said.

So it's seems more than reasonable IMO that the GJ could make the same conclusion regarding MBs judgement that afternoon, and the argument "he wouldn't have acted "that" way becomes hard to argue.

Add to this the notion he may have had other drugs in his system, and being amped from the robbery and it really isn't s stretch to understand why MB acted in such a reckless manner.

And people were saying " Pot doesn't make you act crazy like that" and I'm thinking that sounds familiar.

the 'new' pot isnt like the old sleepy, munchies, pot back in the day.

Being under the influence is voluntary, so the courts don't accept it as an excuse.

(Not that it will stop some MB defenders from saying it was a first and he didn't realize what it would do, and go back to the gentle giant characterization.)
