They are all equating "the pause" with the officer having time "to think" yet haven't mentioned that it could simply be a break in the action? For example..."freeze"...MB taunts, then rushes...bam bam bam bam bam bam....pause...MB hasn't been killed, only shot in the arm....another rush....bam....bam bam bam.

Oh, maybe because there are only 12 shots in the gun? Has anyone determined how many were on that tape? I think I've heard 12 more than anything- hard to count

I count 10 but that means nothing lol

It sounded to me like 11 shots and I timed it and come up with 8 seconds. I suspect that the recording did not capture the first shot that was fired inside the police SUV during the struggle.

I agree. Did not capture shot @ car. Tape was only 12 secs long. Shooting started a few secs into the tape.

General consensus on CNN is that this is a big "win" for the MB side. Anyone disagree with my assessment of CNN's assessment?

Meh. Don't see how anything short of actual footage of MB in a supplicant's pose, being peppered with bullets by OW, would score any points for the prosecution. MB looks mighty guilty, but I will wait and see.

Why does this female lawyer keep saying only a lawyer or such can understand this recording and its importance? :lol:

I think she was just trying to explain that her client, a layperson, really didn't think much of it, but when she had a listen, she felt that her professional opinion of it being potentially having significant evidentiary relevance, prompted him to turn it over to the authorities.

(I wonder if he might have been a bit hesitant due to the things he was saying in the audio??? LOL...:loveyou:)

If the whole shooting sequence only lasted seconds, then clearly he didn't have time to reload.
I'm not talking about reloading. I'm talking about how many rounds were in officer Wilson's gun to begin with.

To get 13 rounds in a gun with a 12 round magazine you have to chamber a round, remove the magazine and add one more round to it. I guess you could drop the magazine a bit and load a round directly to the chamber but that would be somewhat unwieldy IMO.

Wilson aim didn't start out so good, probably from that punch to his eye. IMO

Guy overheard in the other guys video ....describes it exactly... Wilson was missing.. Brown was fleeing...then doubled back bum rushing....

I'm watching CNN *good grief* about the audio shots. Does that say "alleged"? And already, people on tv are jumping all over as if there's no doubt about it!

Okay, so isn't any crime alleged until conviction? I get very confused on this.

But AFAIK, nobody has been charged NOR convicted.

And we know for sure that's an audio of OW shooting at MB? I'll wait until the FBI confirms this.

What's mind blowing to me is the guy never says, "holy sh$$ I think I just heard gun fire." Nope, he just continues on about how "purty" this girl is :scared:

What kind of problems. I think it is very logical to think MB assaulted OW when he was in his patrol car and that would immediately make him a felony suspect who needed to be apprehended and arrested. It would be no different if he was trying to apprehend a felon who had assaulted someone else and they were trying to escape.

This is all that is really required under MO law for OW to be justified in using deadly force:

is justified in using deadly force only …. when he reasonably believes that such use of deadly force is immediately necessary to effect the arrest and also reasonably believes that the person to be arrested (a) has committed or attempted to commit a felony;

And for it to be an assault to a police officer the assault doesn't even have to be severe injuries. A mere assault on a police officer of any kind in any manner is still a class a felony.

IMO

In the context of this case, the question is, was it immediately necessary. If it wasn't immediately necessary, you don't even get to the question of a felony having been committed or if there was a threat to life or limb. Outside of this case, some of the immediate questions I'd have about how that is interpreted is a situation where an officer unlawfully causes one to "commit a felony." Also, felony is a legal term that requires a trial or guilty plea before one can be said to have committed a felony. Is the officer the sole judge and arbiter or whether or not a felony was committed? Another question...under that interpretation of the statute a cop is justified in shooting you for passing a bad check, a class D felony. Something tells me (though I haven't researched it) that that just isn't going to fly with a jury if a completely non-violent, 80 pound woman is shot because she wrote a bad check.

During the audio tape segment the retired police guy was talking about the sound not changing. Would it really change that much? We are not really talking about a far distance here?

Alleged as in CNN is not sure that this is the audio of OW firing at MB, even CNN said they'd be checking with the FBI. But CNN is also covering it as it is fact without being verified.
