The look on son2's face as son3's fist is coming is priceless. They know I am hormonal as heck right now- and it is better to humor me. :) Due to the math, son3 ends up taller than the truck but exactly where a 6'4" person would be in relation to the door window of a Tahoe.

The shooting happened shortly after the robbery. It didn't happen during the robbery.

Can the argument not be made that they were still in the process of fleeing the scene of the robbery? I understand that at some point the commission of the felony has to end, but they hadn't even made it back to wherever they were going. I don't know. I'm just asking.

Perhaps that shot went off when Brown was assaulting Wilson.

And they'll be able to determine that based on distance and trajectory.

Hmm, well, I think if DW had been the one killed then felony murder charges would be possible for DJ (is MO even has that statute, some states don't) but if that had been the case this would have been a 24 hour wonder and we wouldn't be here discussing it.

Case that is an example of where one was found guilty of felony murder when his co-conspirator was killed. Brief facts: Defendant and deceased set up drug deal. Deceased went in to buy drugs from an FBI informant, but instead tried robbing him, started shooting up the place. FBI busted in and shot the deceased, killing him obviously. Defendant found guilty of felony murder (felony being attempting to buy the drugs)(murder because his co-conspirator was killed when the FBI shot him).

I find it hard to believe that the audio recording is a hoax. It has been reported that the person recording was using a video chat/text application for smart phones called "Glide". This program does not store the video files on the smart phone but rather "in the cloud" i.e. on an external server. I am sure that the FBI would be able to obtain a copy of the file along with server records from the company maintaining the server. The server records would provide an accurate time stamp for when the video was recorded. If in fact this is a hoax a person would have to be extremely stupid to use an application like "Glide" that stores files "in the cloud"

I wonder if these "experts" did any research on this subject before they were invited on CNN to shoot their mouths off?

Ok- Had MB stand in son stand on a 2 inch board with sneakers on to make measurements come out the same as the tahoe door/window height- as we have bigger tires- ( and son is taller than I thought). Yes, they are used to Mom and her WS re-enactments; they have done it for another case - or two :)

eta; son stand in for OW is only 5'7". You can see he is leaning a bit towards his younger brother. MMV as to son sitting's height vs OW's actual sitting height

Ok, so IF this incident happened in the way most are saying (that MB was shot while charging at OW) to me MB must have known what the outcome would be, so basically he was suicidal, unless he was messed up on some sort of crazy drug(and I sure don't mean weed), then I have a hard time buying that. Why on earth would he charge him like that, doesn't make sense to me, the baddest of bad criminals wouldn't do that, this is either a suicidal or psychotic act. Would love to see the tox report. I'm still staying in the fence with this case so far, but am open minded.

That is some good research! I wouldn't have thought charges could be brought against a co-conspirator (co-perpetrator? I don't know the word that applies here, even though I think DJ was just along for the ride, not actively intending anything) if LE was the one who did the shooting, TIL.

I really did not give them a choice :happydance:: told them the Board needed visuals! Son3 only weighs 185- and has arms on the shorter side, so imagine another 109 pounds and about 3 inches in arm length reaching in for OW's gun as well as striking OW.

eta: if you look at the pics, "OW" would have had to reach up to reach "MB"'s neck if he was standing upright- and would have little leverage....

RE: audio Has the FBI confirmed that it is a hoax? Tom Fuentes, former FBI, Cnn analyst, if I heard him correctly, said that initially, he thought it was a hoax ,but,he added that the FBI may have the whole gunshot event captured and that the final portion of the audio may have been ok'd for release where the first part, was NOT released because of the language not allowed for public airing, possibly. We need the FBI to debunk it's authenticity, if that is the case. JMO

You're right that it would be easily identifiable as a hoax, yet my understanding is this guy has pulled off a number of them. And the guys in the interview aren't your average talking heads, as in they aren't ignorant of this type of evidence. Guy #1 is a former LAPD police officer, and guy #2 is a former FBI assistant director.
