If they fought over the gun, and if it was pointed towards the officer at some point, and it was shot during the struggle, then it is a class A felony, imo. That would be an attempted murder charge if he had a Sig pointed point blank range at the officer and was attempting to fire it.
Oh yes. Totally agree with this. The struggle INSIDE the officer's patrol vehicle, the assault to the HEAD and EYE/ FACE of the officer, and the discharge of the gun, IMO, makes this a Class A felony (maybe several Class A felonies) beyond a shadow of a doubt.
This wasn't a little bump or shove of a LEO. And if the assaultive blow was actually in the very near vicinity of the eye and eye socket, one could argue that the intent was to disable the vision, and consciousness, and clear thinking ability of the officer--to in fact, substantially disable his ability to respond. Combine that with the struggle over the gun, and the actual discharge of the gun inside the patrol vehicle--- and yeah, just no way would that be less than at least one, if not several, Class A felonies, IMO.
And remember, at the time of the assault and struggle inside the car, Dorian Johnson was.....where? Standing right there watching? He sure wasn't pulling MB off the officer, or trying to persuade MB to STOP. There were TWO suspects. Dorian Johnson was no innocent bystander on the sidewalk when this started. The officer had to be intensely worried about BOTH of them. And he had no idea at this point if either one, or both, had guns or other weapons. And with one suspect attacking him and trying to get his gun inside his vehicle, what was the officer to do? Counsel them? Hug them, and ask them how they were feeling about attacking a police officer? Sheesh.
Dorian Johnson has managed to cut himself a deal (IMO) to make him look completely innocent in all this. As if he was just crossing the street when it happened. IMO, he deserves criminal charges. He is getting off scot free, IMO.
