I agree Katy. Probable cause must exist - per the Fourth Amendment.

I posted the info regarding arrests prior to an indictment because there have been several pages of posts here insisting that it never happens, when, in fact, it does happen.

You know what kills me the most??? IF OW is indicted and then an arrest is made and it goes to trial....un unwarranted arrest may actually work AGAINST a conviction if it can be shown that OW was denied his rights of due process in any way. So it is in the family's best interest to have an arrest made if and when an indictment comes down. But I have a feeling they know that isn't going to happen. They are lining their ducks up in a row to put together a shortlist of grievances for after the fact. Hey...a lot of this is working...Feds investigating the entire FPD, city council meeting to eliminate "unfair" fines and fees, a dual investigation of the shooting...why stop now???

I don't think people were saying it never happens. I think they were saying it never happens without probable cause, and until the process plays out, there is not yet, probable cause. jmo

What 'words' are saying this represents?

IMHO the words the picture represents is the craziness of the way one side is demanding to be above the Constitutional Right to due process

Another lovely citizen. :slap:
She should be arrested as a terrorist threat.

President Obama is giving an address tonight on terrorism. Perhaps he will address the terrorist threats being made on American soil.

I'm not sure what the question is...are you asking me what words I think the picture represents? I guess I am saying that the picture of the family with Shahid tells me who they are aligned with. I think that's what you are asking. Long day.

So now, a failure to appear has no consequence? Why would anyone appear for a court date then?
So does this mean that the protestors that are angry about the court system are going to stop the civil unrest? Oh wait a a minute...tyhey are closing down the freeway tomorrow...because he was in sty street for 4 hours...because the livery company didnt have bullet proof vests and couldn't pick him up...the parents knew that...but now the protests are highlighting the 4 hours, as if it was the FPDs fault...

BBM

Well, I would, because it's the responsible thing to do.

I agree! I have no doubt that the GJ will not indict ODW & then civil cases will ensue until the Gentle Giant's juvie record is exposed

this has opened up an entire crazy train IMHO -- segregation to say the least ! And I thought we were fighting to be equal

They are not all rioting. They are not all wanting OW dead. They are not all horrible. I don't really like the term they. I don't like grouping people together as one unit. There are good people and bad people there. There are people who want justice and people who want revenge, however there is no they. To lump everyone together is obtuse IMO

It would be great if people would do the same for Officer Darren Wilson and the FPD.

Sorrel, Here is what we were agreeing on : [ no one said it never happens]

The purpose of the indictment is to get the green light for an arrest. The purpose for the grand jury hearings is for the prosecutor to show the jurors the evidence and they decide if there is cause for an arrest. If so, there is a True Bill, or an indictment. So yes, it is backwards to arrest someone before the indictment. jmo

ETA:

indictment
n. a charge of a felony (serious crime) voted by a Grand Jury based upon a proposed charge, witnesses' testimony and other evidence presented by the public prosecutor (District Attorney). To bring an indictment the Grand Jury will not find guilt, but only the probability that a crime was committed, that the accused person did it and that he/she should be tried

[Nobody said it never happens in the backwards way.]

I will say I'd never move to StL now. I think this is doing either a grave disservice to the city or it's serving as a public service safety notice to others to treat it as Detroit. If it's economically disadvantaged now, this will make it worse, in my opinion. Can't imagine any corporation deciding to relocate facilities to there. Lawlessness and volatile highway blockings and riots are not recruiting benefits. They cost money and hurt morale and productivity.

Justice isn't found on a highway threatening drivers.

Don't hold your breath.

I think he knows, just like their faux outrage over Michael lying there. It's being used to incite others and in turn use those angry masses to apply pressure. I think they're very aware of the facts of the case and that they do not warrant an indictment and if it's ruled justified, it scuttles any wrongful death suit. That's why they tiptoe around facts like the hand gash as we discussed earlier.

This is a very important thing to remember when it comes to the race hustlers.

All they need is an arrest for a civil suit.

It's the major reason why I am leaving for MSP -- I don't want to live in fear of reprisals

oy.

This case has become nearly impossible to discuss at this point without politics and the larger issues being alleged about the system in general and civil rights violation allegations.

Both MB and ODW are now completely lost in this greater debate and I have no clue how to post responsibly on this case anymore now that it is not just about the shooting but all that has come after.

I will watch from the sidelines and hope that true justice is served in this shooting and whatever larger issues come to light due to the shooting. For me the shooting is one topic. The greater social, economic, racial and justice system issues are separate. but thanks to the way this case has played out in teh press and in the court of public opinion it feels as if they are all now rolled into one big issue. I can't discuss the matters in that way. They will forever remain separate in my mind.

I will continue to come here for updates on the shooting case but from here on out, there is nothing more I can say on that specific topic that I have not already said 20 ways to Sunday.

Time to sit back and see what happens with the case of MB being shot by ODW. nothing more to be gained by my continued attempts to participate in that discussion.

Thanks for all the thought provoking reading these last weeks.
