JMO How would OW know that all forensics back him up? I thought the GJ evidence is supposed to be secret ?? I think it would be quite hinky if he or his attorney are privy to the evidence. Wish therewere a lawyer here. JMO

GJ evidence is secret. But there is nothing preventing communication between OW's attorney and the investigators.

My father was a defense attorney. He used to talk things over with the investigators at various stages of an investigation. He was often told about evidence they had. Or didnt have. Dad would call and say " are you really going to trial? My client has an alibi-your wasting your time.' And the reply might be " then why are his prints on the door?'

There is nothing hinky about a potential defendant being told what the forensics has determined.

BESIDES, OW has not been fired. he is still a cop. So there is nothing wrong with him being told by other cops what is going on.

I only know because I track and watch the space station when it does a fly by over my house ...I set it to send me an email on the NASA website, I go outside to watch!...and I have the NASA app that sends push notifications. :)

I thought that was talk about Mitchell. I could be wrong. I suspect even Josie could testify if the GJ wanted to hear from her. Seems they have pretty unlimited scope in what they consider and they may want to hear what the GF told her that OW said.

Officer Wilson is available to testify. If he was not available, if his girlfriend was not available, if the Chief were not available, then they might call Josie but she has a third hand account that may or may not be exact because people often add embellishments to stories they have heard. Remember "Whisper Down the Lane?" Even eye witnesses don't seem to be able to keep their stories straight. The Grand Jury would want to know what was Officer Wilson's belief at the time he shot MB. jmo

LOL you are strict! I could tell the truth as I remember it, but may not know every forensic detail about a scary event that went down in a minute! He probably didn't even know how many shots were fired, unless he still had the gun with him when he went to the hospital. Just saying.........JMO

OW is still a memebr of the police dept. He has not been fired. He has not been charged with anything. So why wouldnt he be allowed to hear if the evidence is supporting his story or not?

Aha. So that makes her a liar? Or were her words more like and his body jerked like he was hit? Or is it possible that it was her impression that he was shot but her impression was simply wrong? I guess that could be posited as lying or it could be said she was answering truthfully, albeit her perception was wrong. Or is it even remotely possible that MB was shot in the arm while his back was turned as some have posited? Or, it's possible that she really was lying, i.e. that she knew for a fact that MB was never shot with his back turned but actually did say he was shot with his back turned.

I'm just stating her early August interview has been debunked & why would the GJ waste time on her . . . but they have the time -- until Jan 2015!! Listen to all those who have something pertinent to the case & make your decision

All I know is I support ODW & all LEO & firefighters & EMTs out there not making much $$$$ keeping us safe! I am glad there is one less gang banging 🤬🤬🤬🤬 on the streets on StL -- ya, I said it!!! Oh, let's say 2 since Dorian is being protected by Holder's men :)

Of course he is going to know much of the forensics. For example, if the gun came back with no other prints on it, he may be asked pointedly by investigators, " why did u say there was a struggle over the gun when yours are the only prints...." OR ' why did u say MB shoved the door shut when his prints arent on it? ' OR just the opposite happened. If there are palm prints on the outside of the door and MBs prints on the gun, then OWs attorney might be told of that evidence. Because it would make a difference in his decision to testify or not.

My father was a defense attorney. He was quite often told things by investigators, before the trial. You just need to have good ongoing relationhips and it goes both ways.

Ok, so he can infer it from the questions asked. I get that and that makes sense. I guess what I'm wondering is, would he be given for example, the autopsy report, the toxicology report, the witness statements, the crime scene analysis, stuff like that.

Smart of McCulloch to have the gj hear from OW yesterday, not their normal meeting time today. Bet an enraged and deranged Shahid is somewhere doing evil things to his already hideously mistreated stuffed doggies.

thankfully they were focused on the County Council & not the GJ testimony ! Prayers for ODW & his family & all those affected by this tragedy

JMO I really don't know if that is ok or not. Maybe potential defendants can know, if they are not already charged...... Did the Ramsey's know pretty much of the evidence? I can't remember. They were not charged. JMO

At this point in time, Officer Wilson is still employed by the FPD. He has not been fired, nor charged with a crime. So why wouldnt he be privy to the facts in the investigation of his case?

Do you think that they are sharing that same information with the victim's attorneys as well? Or do the victim's rights not include that?

I can't put my finger on it and thus the reason I'm asking the questions but yes, something does seem hinky if they are giving evidence to one side and not another, not to mention the fact that the defendant can then craft his testimony to match that evidence. Yeah, that doesn't sit well with me at this stage in the game. But like my original question asked, maybe there is a duty to disclose such evidence at the GJ stage, not just during a trial.

I don't disagree with you if you're saying the GJ probably doesn't have any interest in hearing from Josie. I was only saying that she could be compelled to IF the GJ wanted her to.

Because usually LE doesn't open up their investigative file to the subject of an investigation.
