GUILTY MO - Hailey Owens, 10, Springfield, 18 Feb 2014 #3

  • #121
With so much publicity here in Springfield, would they try to move the trial to another county? Could that be the reason for changing judges? To use all in the area? Also in regards to the house, seems that the police would have some sort of "security" on it since now everyone knows where the house is and would like to keep the scene as it was. In the movies, they take the jury to the scene, so do they do that in real life?

I've seen it done in real life as well (though that doesn't mean they'd need to in this case, necessarily). I suspect the light on and blinds up is just a security measure (by LE or owners) to discourage anyone from messing with the house right now.

With everything that happened in the Travis Alexander murder, they still found a jury in the same county that felt sorry enough for Arias to try to spare her life.

Hailey Owens murder case goes to 3rd judge

In Greene County, each side in a criminal case can request one change of judge before the preliminary hearing without having to give a reason, and the motion is automatically granted. If the case goes to circuit court for a trial or plea, each side can again request one change of judge without having to give a reason.

If an issue with a judge arises after those automatically-granted requests, a judge holds a hearing to consider arguments for a change of judge, or a judge recuses himself on his own because of a conflict of interest.

True, but 10,000 in the community didn't come out and hold a candlelight march when he was killed.

IMO, it's no wonder it takes so long for the Victim to get Justice. To me that is just a plain waste of time, money, and resources. So you are saying this the real deal for the Preliminary, because they have had their way. But when/if he pleads "not guilty" and it goes for a trial, they can do it all over again?

To me that seems more of a primitive mating dance than it does for courtroom decorum. JMO

Anyone know why the third judge? Both PD and DA had one, now a third ... who requested this change?

Or is this the DA's request? I'm getting behind.

I saw a local newscast a day or two after she was found, and a parent of one of her friends in the neighborhood said they had seen Woods in the neighborhood several times before Hailey was taken. They said he approached her daughter sometime before taking Hailey. Has this already been mentioned in one of the threads? I don't recall seeing it mentioned in the first, and I'm not up to date on the others.

Welcome MamaOwl thanks for your post.

I think I read something here about this. It is logical that he had been driving around before looking at other girls and for whatever reason he decided to grab poor Hailey when he did. He was determined to act on his sick desires and if Hailey's name wasn't here another girls would be. I just wish it was possible to find out what these perps were planning before they acted. Thank goodness he was caught and hopefully he will never be out again.

American short track skater Emily Scott has a connection to a tragic case in her hometown of Springfield, Mo.

After being eliminated from the women's 1,000 meters in Sochi on Friday night, Scott revealed that Wood was also her niece's gym teacher.

"It's definitely a scary thought," Scott said. "All my prayers go out to that family. It's heartbreaking."

Why couldn't they? I would think most schools do not separate elementary school children by gender for gym; they have gym with their classmates. When I was in elementary school, we didn't get changed for gym so that wasn't an issue (and if they did, a female teacher could be in the locker room).

Speaking of Missouri and the DP, there was another abduction and murder very similar to the Hailey Owens case in Kansas City in ... oh wait, it was in Kansas City, Kansas. Like I said, there is a state line in KC with different jurisdictions. Anyway, in 1999, ten-year-old Pamela Butler was grabbed off the street and thrown into a pickup truck in front of witnesses in the late afternoon after her killer, Keith D. Nelson, got off work. He had been seen the late-afternoon before casing the area. A neighbor tried to chase the truck but lost it. Within an hour or two Pamela was already strangled--across the state line in Grain Valley, MO. The killer was tried by the Feds and is on Federal Death Row. I am not sure what made the difference in Nelson's case where he was tried on the Federal level.

Could be Fed. case because he crossed State lines.

Its also possible that the public defender is getting advice from Dee Wampler's office. Though Wampler and his partner are working for Woods' parents, they have nothing to lose by sharing advice that could help the defense. Churning the judicial waters could help a defense argument that Woods isn't getting a fair trial, could delay the process and incresae the likelihood of a mistrial or numerous appeals.

The case against Woods is so strong, the best the defense can hope for is getting him out on bail and keeping him free as long as possible with delaying tactcics. Wampler and his partner are probably more experienced in using these tactics than Wood's attorney. Before the Casey Anthony trial, this kind of speculation would be outlandish, now not so much. That said, Springfield is a pretty sensible community, juries there will be difficult to manipulate.

Out on bail? after witnesses saw him abduct her? I hope not!:tantrum: if they can I'm glad we dont live there. He'd never get out on bail in Ohio.:seeya:

When I taught (back in the dark ages, lol) and when my kids went to school, they didn't separate the kids at the elementary level, but they also had 1 female and 1 male coach teaching the class in tandem. Not just a single coach of one particular gender.

I just thought it curious, that's all. Guess it varies by state and school.

I had males coaches in high school for sports. The golf coach to the boys was female, as was one of the swimming teachers. There were many opposite gender coaches. If they needed a players out of the locker room, they just sent another player in to get them. I don't think there is restrictions on gender for coaching now. That would pretty much violate the federal laws prohibiting discrimination.

I believe he's already been denied bail, hasn't he? (At arraignment.)

ETA: Here you go:

Imhoff ordered him held without bond, and set a preliminary hearing for April 7.

Public defender Chris Hatley represents Wood, and asked for a new judge for the preliminary hearing.

I don't remember ever seeing any articles that said he was a gym teacher, only a coach of football or a coach of boys sports.
