Prosecutor to seek death penalty in killings of mother, son

A Missouri prosecutor plans to seek the death penalty against a man charged with fatally stabbing his girlfriend and her 13-year-old son in a New Year's Eve 2020 attack that left two other children injured.

A Missouri prosecutor plans to seek the death penalty against a man charged with fatally stabbing his girlfriend and her 13-year-old son in a New Year’s Eve 2020 attack that left two other children injured.

Besides facing two counts of first-degree murder, King also is charged with assault and child abuse because Plumb’s then 7- and 14-year-old daughters were stabbed but survived the attack in the family’s west Springfield home.

Okay - this is a long one - but these are my first notes I have on this case. I wanted to get all his hearings in my notes & what has happened. Will shorten it up a bit!

Friday, April 21st:
*Status Conference Hearing (@ 2pm CT) - MO - Stephanie Plumb (32) & her son, Dylan Moore (13) shot to death by her BF, Dec. 31, 2020 & 7 & 14 year old daughters were stabbed but survived the attack, Springfield. *Brandon Corbin King (31/now 33) arrested (1/4/21, served with arrest warrant), charged (1/5/21) & arraigned (3/5/21) with 2 counts of 1st degree murder (Stephanie & Dylan), 2 counts of 1st degree assault or attempt (serious physical injury or special victim) 7 & 14-year old daughters, 6 counts of felony armed criminal action & 2 counts of abuse or neglect of a child (serious emotional or physical injury/no sexual contact) for 7 & 14 year old daughters. Held without bond. DA will seek DP (2/25/23).
Court documents say King told police he killed Stephanie Plumb & her son, Dylan Moore, because he was planning to flee the state to avoid prosecution in a forgery case & wanted to eliminate potential witnesses. Besides facing two counts of 1st degree murder, King also is charged with assault & child abuse because Plumb’s then 7- & 14-year-old daughters were stabbed but survived the attack in the family’s west Springfield home.
1/1/21 Update: Judge assigned. Felony complaint filed by prosecuting attorney Dan Patterson. Probable Cause statement filed. State's request for arrest warrant & to detain pending trial filed. Exhibit A to Arrest Warrant filing. Warrant issued. Doc ID: 21-GRARW-3, for KING, BRANDON CORBIN. Probable Cause found. Warrant Issued. Warrant signed 1/1/21. Bond Set in the amount of: HOLD WITHOUT BOND. The court further finds reasonable grounds to believe the defendant will not appear on summons; is a danger to the crime victim, the community or another person. DETAIN PENDING TRIAL OR OTHER DISPOSTION. The Court further finds, pursuant to the Missouri Constitution, Article I, Section 32.2, Sections 544.457 & 544.676, RSMo, & Missouri Supreme Court Rule 33.01(d), that, by clear & convincing evidence, based upon the showing & available information in the State's Request for Arrest Warrant & Pretrial Detention & the probable cause statement filed herein, no combination of nonmonetary conditions & monetary conditions will secure the safety of the community or other person including the victim(s) & witness(es) & the Court, therefore, denies bail herein & orders the defendant detained pending trial & any other stage of the criminal proceeding. 1/4/21: Pretrial assessment filed. Arrest warrant served. 1/5/21 Update: Arraignment held. State by APA Bliss. Defendant in person by video from Greene County jail. Defendant appears does into appear within 48 hours of arrest due to case not begin assigned a Judge until yesterday. Defendant advised of rights under Rule 33.06. Public safety assessment ordered. Bond hearing set 1/11/21. Charges were read. Defendant plead not guilty. Public defender is ordered to appear with defendant at bond hearing.
1/11/21: Attorney Hackathorn by telephone. State by PA Patterson. Attorney Hackathorn advises that public defender office has not completed conflicts check; the Court concludes that it is not appropriate to conduct bond hear in this case without defendant having counsel. The Court notes that the State was prepared to proceed with bond hearing today. Bond hearing reset on 1/15/21. 1/13/21: Motion request for discovery. Motion to allow accused to appear in his own clothing & without visible restraints at all court appearances & notice of hearing. Motion to record or transcribe all court proceedings & suggestions in support thereof. Motion to preserve evidence & notice of hearing. Motion to preserve all investigatory notes.
1/15/21 Update: Preliminary hearing. Defendant with attorney Hayes. State by PA Patterson. Hearing held on record. Court makes findings & rulings as set forth in Order filed herein. Preliminary hearing on 2/5/21. Defendant continued held without bond per Order.
1/19/21 Update: Motion hearing. Court receives request for still camera, audio recorder, video camera & microphones in the courtroom for preliminary hearing & other hearings in associate Circuit Court; said request is filed in the case file & made a part thereof. Court finds said request to be timely. Any objections to said request shall be filed no later than 1/25/21. Hearing on said request & any objections set on 1/26/21. Should defendant re-file defendant's motion to allow accused to appear in his own clothing & without visible restraints at all court appearances, said motion will be taken up at that same court setting. 1/21/21: State's first media discovery Rule 25.07 filed by PA Patterson.
