Defense of Justification

Law enforcement officer's use of force in making an arrest.

563.046. 1. A law enforcement officer need not retreat or desist from efforts to effect the arrest, or from efforts to prevent the escape from custody, of a person he reasonably believes to have committed an offense because of resistance or threatened resistance of the arrestee. In addition to the use of physical force authorized under other sections of this chapter, he is, subject to the provisions of subsections 2 and 3, justified in the use of such physical force as he reasonably believes is immediately necessary to effect the arrest or to prevent the escape from custody.

2. The use of any physical force in making an arrest is not justified under this section unless the arrest is lawful or the law enforcement officer reasonably believes the arrest is lawful.

3. A law enforcement officer in effecting an arrest or in preventing an escape from custody is
justified in using deadly force only

(1) When such is authorized under other sections of this chapter; or
(2) When he reasonably believes that such use of deadly force is immediately necessary
to effect the arrest and also reasonably believes that the person to be arrested

(a) Has committed or attempted to commit a felony; or
(b) Is attempting to escape by use of a deadly weapon; or
(c) May otherwise endanger life or inflict serious physical injury unless arrested without delay.
4. The defendant shall have the burden of injecting the issue of justification under this section.

In atypical approach, grand jury in Ferguson shooting receives full measure of case

The St. Louis County prosecutor’s office is taking an unusual approach with grand jury members who are weighing evidence against the police officer who shot and killed 18-year-old Michael Brown last month, experts and county officials said.

Instead of telling grand jury members what charges they believe police officer Darren Wilson should face, they are leaving it open-ended for now and involving the grand jury as co-investigators.

The prosecutor’s office is also presenting evidence to the grand jury as soon as it receives it, rather than waiting until the St. Louis County Police Department and the FBI have completed their investigations. Police probes are typically completed before a case is presented to a grand jury, county officials said.

Michael Brown protestors schedule I-70 shutdown for Wednesday

Details were released Monday of a planned civil disobedience shutdown of Interstate70 on Wednesday. The Justice for Michael Brown Leadership Coalition, who is organizing the event, says the shutdown is in response to Missouri Governor Jay Nixon’s refusal to appoint a special prosecutor in the fatal shooting of Michael Brown.

The shutdown is scheduled for Wednesday, September 10, at 3:00pm on I-70 at Hanley Road.

Brooklyn rapper Talib Kweli, who famously argued with CNN reporter Don Lemon on air in Ferguson a few weeks ago, is telling Billboard magazine his life was threatened by police in Ferguson while protesting the death of Michael Brown.

Ferguson City Council proposing changes to try to improve relationship with residents

Ferguson announced it is considering changes it believes will satisfy the concerns of some residents.

The city council said it will establish a police review board to oversee the police department. It said the board will include people who are not part of the police department or city government.

Ferguson City Council has taken major strides to begin rebuilding public trust with a slew of new programs and laws.

Several of the changes come as a part of the court system, including how court fines and fees are handled and a special docket for those who have garnered fines and fees from the municipal court for failure to appear.

The changes stem from several speaking out recently about the inability to be able to pay court costs and further fines received from Ferguson.

According to a study done by ArchCity Defenders, a non-profit organization that focuses on giving legal assistance to those with lower income, the City of Ferguson collected nearly $3 million from court fines and fees in 2013.

Ferguson police began seeking military assault rifles days before Michael Brown shooting

The August 9 fatal police shooting of Michael Brown — and the protests that followed — has focused attention on the militarization of police forces.

At the time of the most intense scrutiny, Ferguson Police Chief Tom Jackson said that his department did not even have a SWAT team and had not received any surplus military weapons or armored military vehicles through the Department of Defense’s 1033 Program.

But police wanted some. Nine days before the fatal shooting, police Chief Tom Jackson signed off on a request to obtain 30 M-4 rifles for the department's 53-member officer force, according to a weapons request form obtained by the Post-Dispatch via an open records request.

Supporters of Michael Brown's family renew call for arrest of officer

On the one-month anniversary of Michael Brown’s death Tuesday, a small crowd gathered in front of the Ferguson Police Department, calling for the arrest of the officer who fatally shot the unarmed teenager.

The Rev. Carlton Lee, National Action Network Ferguson chapter president; Brown’s family lawyer, Anthony Gray; and Brown’s parents, Michael Brown Sr. and Lesley McSpadden, were among those who gathered Tuesday morning.

Supporters of the Brown family said the evidence for arresting officer Darren Wilson was now overwhelming. Lee specifically referenced two peopleworkers who witnessed Brown’s shooting on Aug. 9 who recently stepped forward, corroborating other eyewitness accounts who said the teenager raised his hands in the air in a sign of surrender before his death.

News 4 Investigates: Ferguson PD deadly use of force policy

Ferguson police told News 4 it may take some time before an internal review of the shooting of Michael Brown, Jr is complete.

Ferguson officials told News 4 federal investigators are currently digging through years of internal police reports including more than four years of documents examining every occasion when the police department reviewed a case involving a possible use of force. The Ferguson City Attorney said those records will not be available to the public until the US Department of Justice is finished looking at them, which may not happen until October.

Two minutes earlier, Wilson had left a 911 call a half-mile away, on Glenark Drive, police and emergency logs show. He had accompanied an ambulance to the home, where a 2-month-old was having trouble breathing.

About 12:05 p.m., that same ambulance, infant in the back, came across Brown’s body in the road, said two ambulance administrators. The paramedic got out, walked into the crime scene, which was already roped off with yellow police tape, kneeled down, checked Brown’s radial pulse, then his carotid pulse, circled the body once, kneeled down again, and wiped his own brow.

When the paramedic determined Brown was dead, the care of his body legally transferred to the St. Louis County Medical Examiner. By law, police cannot touch the body. But since most medical examiners won’t set foot in the crime scene until it is processed by police, the fate of Brown’s body was back in police hands.

And for at least 10 minutes, videos taken by multiple residents show that his body lay uncovered.
The videos also show the crowd slowly building along the police tape.

At this point, accounts don’t clearly line up. Jackson said he called Belmar immediately. Belmar said he got the call 23 minutes after the shooting and called his chief of detectives moments later, about 12:30 p.m.

St. Louis County detectives on duty that day weren’t close to Ferguson then. They were at St. Anthony’s Medical Center, near Sunset Hills, 30 miles south. Six hours earlier, a man with a gun had entered a hospice house there, taken a clerk into the building to find drugs and then disappeared. The hospital had been on lockdown for hours. County SWAT teams had sent at least 13 cars to the scene.

When a St. Louis County watch commander, one of the first county brass to arrive at Canfield, contacted dispatch to get help in Ferguson, the dispatcher said, “They’re all working on that call down in South County. Let me know if you need them, and we’ll try to raise them. It’ll be an ETA from South County, though.”

And the scene was about to get much more turbulent.

At 2:11 p.m., Ferguson police logs captured reports of shots fired. At 2:14 p.m., ambulance dispatch noted additional gunshots, then a Code 1000, calling all available jurisdictions to help. Over the next 20 minutes, the first precinct dispatched more than 20 units from at least eight different municipal forces, from Bel-Ridge to St. John to Velda City.

At some point, Chief Jackson said he urged crime scene detectives to hurry up their work. “We’ve got to expedite,” Jackson said he told them. “They said, ‘OK, we’re expediting.’ But then we had a shooting over here, crowd’s coming in, and it’s really not secure there.”

McSpadden pleaded with the crowd, Whitaker said. “‘All I want them to do is pick up my baby,’” he remembers her saying. “‘Please respect him. Please move back.’ She would get a crowd moved back, and then another group would move up.”

The scene was so tense, commanders in charge stopped the investigation at points and directed investigators to seek cover. Detectives also were pulled away to help manage the crowd.

At 2:45 p.m., four more canine units arrived. At 3:20 p.m., tactical operations officers — the county SWAT team — began pulling in.
