I don't know what goes on in Florida, but in Texas the judges do not take lightly someone making wholly unsubstantiated allegations that have no factual basis in legal documents. I learned in one of my best friends protracted custody battles.
One better have their proof ready, doctor or hospital reports, police reports. Even with all of that, one may not be permitted to bring it up in a custody hearing, for example, if those matters are still under investigation and not yet adjudicated...they are only allegations. In fact not only can the client be in trouble the judge can order fines and sanctions for bringing something before the court "in bad faith" . If one is found to have made false allegations to Child Protective Services in some states it is a FELONY. So, I am shocked that the defense took these unsworn statements with no proof to back them up and published them. It is pretty clear they chose that path because they know they will never be allowed at trial. Even if Roy's ex were permitted to testify, the state would make mincemeat with her testimony in record time. What is interesting to me is all the starting and stopping on the tape. It makes me wonder what in the world went on that was so egregious that when the defense interviewed J. Jordan he felt compelled to tape record it and turn it over to the State. obtaining documents to substantiate...step two
considering the source and how well their credibility will hold up...step three
considering the motives of the person making the accusation...step four
do a mock cross examination to see what type of witness you have ...step five. I would think there should be at least a perfunctory attempt to determine if this will fly.
Not every one that is willing to make an allegation is to be taken seriously...most of these folks imo are pretty incredible...what is that girl's name.....Joy, for example.
What a colossal waste of the good taxpayers of Florida's money to go have a mini trial to indulge the defense in this exercise in futility. The jury is going to despise the defense for these antics. I am sure there are children to be educated, poor to be given shelter, elderly to attend to and a number of better ways for the taxpayer dollars to be spent there. What a waste. Shame on them!
