<modsnip>

There was a trial I watched in which the jury did not understand the word, but they actually asked the judge. They came back guilty (no I don't remember which case it was).

Wonder if they are having problem with agreeing that QT guilty of the 3rd degree arson? He has to be guilty of that charge to be guilty of the Capital Murder charge. Per Instrustions

Did they not understand the instructions? I’m shocked!

You mean did they unanimously not understand unanimous? ;)

This is one reason I'd be in favor of professional juries or at least some kind of better screening. Every juror should at least be able to understand the words used in their instructions in order to be able to follow the instructions.

At first I thought someone jumped the gun, and that it was simply going to be a note to the Judge saying they could not come to an agreement about the verdict.

I thought they were probably returned to the courtroom due to an error, but it doesn't appear that was the reason

Was there any indication if the verdict on the paper was guilty or not guilty ?

Jury back

Jury being brought in...

Nothing said about a verdict reached...

:thinking: I have a hard time believing they didn’t know they had to be unanimous. MAYBE since they couldn’t agree on a verdict they just decided to write something down and let the truth that they didn’t agree come out when they were polled. Just a guess.

Verdict Reached

Unanimous!

NOW they have a verdict.

UNANIMOUS!

Here is my theory of what happened...
The jury was split so after the Allen Charge, one or some of the jurors reluctantly changed her mind. She felt some pressure to return a guilty/not guilty verdict but once she got into the courtroom change her mind back to her original conviction.
