So Miss Molly helped herself to all that furniture etc from the house, but she cannot sell anything u till after the trial. And if convicted or found responsible in a civil suit, sounds like she can never sell.

But it still makes we wonder - if he was so intent on returning to Ireland, even before he left, why would he sell his house and buy one in NC? To placate Molly? It would be very interesting to know exactly when the Irish house was sold and the NC house was bought.

Wasn't the house in Ireland the one that he and his deceased first wife had built together? He was starting a new life with Molly. If he came back to Ireland, probably they would want a house with no memories of what he had lost.

Yes, when I read that article this stood out to me:

" He said that Molly said she wanted validation. She wanted to be seen as his partner and not the nanny. She didn’t want people viewing her in that role and that she felt she was living in Mags’s shadow."

I wonder if Molly felt that Jason needed to make a grand gesture proving that Mags was the past.

Yes. It is unclear. But we do know the purpose of the statute is to prevent the "slayer" from benefiting from the death of his/her victim...that's the good news.

I've done a turnaround on this today...thanks for the info...after reading more of the law I think it says the slayer can keep her property, she just forfeits all her rights to it in her lifetime...and then, it goes to the beneficiaries of the decedent...the furniture might be considered chattel but that's a different story...I know about "income" from first hand experience...essentially a trust is set up and there is a structure to convert property assets to stocks and bonds called partitioning... and it requires only one party to force a property to sale...the "income" from a trust is dividends, interest, capital gains...the schedule D stuff...

But I thought that under NC Law, in the event of a divorce a step-parent (in this case Molly) could gain custodial rights if a victim of DV? As she and her father are using self-defense (because of DV) and Molly, her family/friends/supporters are claiming that she was a victim of DV, then why after seeking legal advise regarding any claim she may have had to custody (in the event of a divorce) of the children did she not follow through? I'm sure she would have been advised of this during her legal consultation? Also, and no disrespect intended, you also state that a lot of supporters (on both sides) have no personal relationship or even know either side yet speculate on what they think happened that night, and yet you did the same.

I don't know what happened and don't wish to speculate either, but certain things do not add up between the account given by Molly and her father about that night, as police statements and the autopsy report demonstrate. Molly and her father will eventually stand trial and it will be for the jury to convict or acquit based on evidence presented. All we can hope for is that justice will be done

The NC law seems to suggest to me that the Slayer has a life time interest in the asset however it does not go into details as to how the asset or any proportion, can be dissolved by the estate if they so wish. I would guess that there are provisions that deal with scenarios and also case law. It cannot be the case that the property has to remain in the ownership of both the Slayer & the estate until the Slayer dies. That would be a nightmare of a burden for the deceased family to carry which is why I suspect some form of trust mechanism. If I was researching Irish Law, I would be looking for all the Statutory Instruments linked to the legislation but no idea how it works in the US.

Capital Gain is never considered an Income under a Trust, the other two you mentioned are (but they are not Schedule D, am assuming that you are talking about the Irish Tax system, they are actually Schedule C & Schedule F). Capital Gains are taxed as Capital Taxes and if said gains were disbursed they would be considered a dilution of the initial asset. Only the beneficiary of the asset is actually entitled to it.

It is good that 50% interest in the property can be protected but I am hoping that the other 50% does not cause the family any further grief, either now or in the future.

It has been reported the kids were staying at a friends house but Molly collected the children at 11 pm and brought them home .Why this was done I dont know. Was he first attacked at this time ?

I wasn't aware of that. Wonder why the sudden need to bring the children home at that hour?

Where ARE her friends? Why did her Mother only visit twice in four years...in a family where Dad had a retirement income from the FBI plus income from a new job, plus income from Mom's job?

Who were her bridesmaids at the wedding? Was there just the one that she threw out? Who was that...a relative?

Strange that she seems such a anti-social figure??? Just my opinion of course.

Spot on, stmarysmead! Have heard MM had few, if any friends. For an attractive, young, woman, with a well connected family, I think it is a symptom of a deeper problem. That is until she came on the radar after Jason's murder. Then, many "friends" came out of the woodwork!!! In my opinion, these people have even greater issues!

Molly had 3 bridesmaid her cousin a relative of jasons and Im unsure of the 3rd one . I have that info somewhere and will post when I locate it. It was her cousin and her parents she threw out Im unsure if its the cousin that was the bridesmaid. I wanted get back to the baseball bat. Its was said there was wet and dry blood anybody know the timeline for blood drying onto an aluminium bat? Would this give us a rough estimate of the time he was killed . I don't know if there was dried blood on the landscaping stone.

I just thought of something. During the 911 call TM asks MM if JC had been drinking. Wouldn't that mean that he arrived at the house after the driveway socialising, or he would not need to ask? Just trying to work out the timeline.

Good catch. I would think it would mean that the parents arrived much later, after any "socializing" was done. If TM had spent the evening with Jason & MM and friends, he would know the answer to that.
Wonder if Jason even knew that her parents were coming? Could he have already been in bed when they arrived?
