Mariah Woods homicide trial set for next fall

TIA!

Posted July 19, 2018

Aldophus Lee Kimrey II, 32, is scheduled to begin trial next September - but it may take several weeks before a verdict is reached.

A projected trial date has been set for the man charged in the death of 3-year-old Mariah Woods.

Adolphus Earl Kimrey II, 32, is scheduled for trial in September 2019, District Attorney Ernie Lee told The Daily News Thursday. An autopsy report from the N.C. State Medical Examiner’s office released Wednesday revealed Mariah’s cause of death as chloroform toxicity.

Kimrey was indicted before a grand jury Feb. 13 after being charged with first-degree murder Dec. 2, according to previous Daily News reports.

Kimrey is being represented by Walter Paramore and Brooke Mangum with the capital defenders office in Lumberton, according to Lee. He said 87 discs were provided to the defense in a large amount of discovery.

While Kimrey has moved through the system in a prompt manner, Lee said preparing for a trial takes a considerable amount of time, not to mention the length of the trial itself.

He is scheduled to begin trial next September, but it may take several weeks before a verdict is reached since the prosecution will be seeking the death penalty. Lee said capital trials can last up to four weeks, sometimes longer.

And Kimrey is not the only upcoming murder trial in Onslow County - Lee said 21 other murder cases are currently pending. Overall, the district attorney’s office is dealing with a caseload of more than 3,500 pending cases in Onslow County Superior Court.

Kristy Woods and Kimrey have a history with the Onslow County Sheriff’s Office, including: Kimrey’s arrest in 2012; an assault of a juvenile at the home in 2016; property damage at the home in 2016; and communicated threats, neighborhood disputes and a “suspicious incident” involving Kimrey two days after Mariah was reported missing, according to county records. I must have missed it earlier but this is the first I've read that KRISTY had a history with LE.

I've been reading that chloroform is used more than Rx or OTC medication specifically because it doesn't remain in body long, and therefore not easy to detect. This is collaborated in attached Dept of Health FAQ about chloroform poisoning:

Is there a medical test to show whether I’ve been exposed to chloroform? Tests can determine the level of chloroform in blood, tissue and the air you exhale. These tests must be done a short time after exposure because chloroform leaves the body quickly.

Investigators are not releasing whether or not they believe Mariah inhaled or ingested chloroform, but for chloroform to be measured in her blood at least a week after death, I'm wondering if it was injected. Curious if the alleged murderer also a known meth/heroin drug user?

In the same FAQ, it also states Chloroform "is used as a solvent for lacquers, floor polishes, resins, adhesives, alkaloids, fats, oils and rubber." I recall the arrest warrants for Kimrey, show he's accused of stealing two dressers around the time of Mariah’s disappearance. Also curious if Kimrey restored (stolen) furniture?..

Knowing nothing about his defense and/or team, how bad would it be if they argue Mariah accidentally took this "clear liquid with a pleasant, non-irritating smell and a slightly sweet taste" (i.e., chloroform), and that Kimrey is guilty only of disposing the body, and concealing the death. According to the autopsy, "there were no signs of a sexual assault or traumatic injuries to the brain, spinal cord, or eyes." Also, I couldn't find where abuse allegations filed by bio-Dad were substantiated. Another plus for defense (reasonable doubt).

If you think about it, it sure would take some pressure off of Kristy if she agreed that it was possible that Mariah's death was a horrific accident (and she had no knowledge of alleged prior abuse).

There's definitely a part of me that would rather see Kimrey locked up for the rest of his life than over-charged with death penalty (if room exists for reasonable doubt). MOO...

Just another example why getting a case to trial takes so long -- the courts are jammed with cases.
The cases and the personnel who participate just have to get in line. We see this in every case we follow.

BTW -- nothing new on Kimrey on the court docket today.

Kimrey was a A/C repair man.
This is my fear as well, in a nutshell, imo, will be the exact defense his lawyer will use!

What were the “shocking revelations”? I can’t listen to her. She annoys me too much.
No, nothing. I am now siding with everyone else on the credibility of NG

I can't believe no one knows where Kristy is hiding.

i think she's hiding in plain sight!
Perhaps with a relative..an aunt, a cousin, someone/somewhere safe from media and gawkers, and from vigilante activity. I cannot imagine how she might get through each day, whether she knew or she didn't know. How could you put one foot in front of the other, after something like this tragedy?

I know at one time she was staying with her best friend,
I can't believe no one knows where Kristy is hiding.
I know at one time she was staying with her best friend, however, they had a falling out and no longer speak to one another. No idea where she is now, but possibly in Kentucky with other family maybe??

I feel in her position over this case she'll be keeping her head down. Nobody has seen her in a wile, she's not likely out and about living the high life, but she's there hidden away.

  • #517
She is probably hoping if she keeps out of sight she will be out of peoples minds. Fat chance of that IMO. I would like her charged with the same thing as kimrey. Unless LE have a confession from someone i do not see how they can prove it was kimrey who actually used the chloroform.

That and it's about time that parents are held accountable when they don't protect their children from harm. Especially from someone they invited into the home. I'm so tired of "moms" who put boyfriends over the lives of their children.

Nothing new on the docket for Kimrey today, 08/03/18.

I wonder what they mean by Kristy continues to cooperate.
Is she throwing Kimrey under the bus to get a Karla Homolka deal.
Is she completely throwing Kimrey under the bus, or admitting her partisipation in the murder of her sweet baby girl?
